SUMMARY STATEMENT:
Tom Kerr, representing the Cemetery District, is requesting the City convey to the Cemetery District, at no cost, the property currently deeded to the City was originally donated for
use as a cemetery. Mr. Kerr prepared legal descriptions for the two sections created when Deinhard was extended, leaving the street and right of way as City property. At the August
14th Council meeting, staff requested direction and Council indicated support for the conveyance of the parcel to the north of Deinhard, but wanted to discuss the parcel to the south
with the Cemetery District. The City can convey this property to the District at no cost to the District. The original donation does not restrict the use of the property.

the value or minimum price of the property to be conveyed to transfer both parcels to the Cemetery District at no cost, with a restriction that the property can only be used as a Cemetery
or the land reverts to the City. Directed the City Clerk to publish a summary of this action and provide notice of a public hearing on September 25, 2003 to consider an Ordinance effecting
this transfer.
RECOMMENDED ACTION: Adopt Ordinance 787, authorize the Mayor to sign on behalf of the Council and direct the City Clerk to publish and record all documents necessary
to complete the transfer of this property.
