I am very frustrated by your terse conclusion that: There are no public records responsive to your request for (1) metadata and electronic information records associated with the creation of the October 18, 2011 incident report by Officer Ginsberg and (2) a disposition record for any metadata and electronic information records associated with the creation of the October 28, 2011 incident report by Officer Ginsberg. Chief Ward testified under oath that Officer Ginsberg created his incident reports on a computer. Computers automatically create Metadata and Electronic Information Records when activities such as Ginsberg writing his report takes place on that computer. This information is captured on a hard drive. You claim these records don't exist and never did. But that is not possible. Your failure to acknowledge that this is not possible or to explain how these records never existed is perplexing to me. I don't know how else to ask you to provide these records for my inspection. Your quickness to add, "We consider this matter closed." is additionally uncooperative and frustrating. I am going to try once more try to at least locate the computer that Ginsberg used and hopefully that will bring me closer to obtaining the public record I seek to inspect. Therefore, I am asking you AGAIN to please produce for my inspection the record I requested of you on Sep 29, 2013 which you promised on Oct 3, 2013 you would respond to in 3 days. That record is: The serial number of the computer used by Police Officer Ginsberg to create incident reports during the period of time from August 1, 2011 to August 1, 2013. For your reference, this original request and your response is attached to this email and titled 10 3 13 C O'Hare GINSBERG CSN intake.Ddf. Please note, the serial number may be found on any of the following public records: 1. the documents that accompanied the purchase of this computer, 2. the warranty information for this computer, 3. the inventory record of public property for this computer 4. the manufacturer's identification label affixed to this computer Also note, FS 119.011(12) "Public records" means all documents, papers, letters, maps, books, tapes, photographs, films, sound recordings, data processing software, or other material, regardless of the physical form, characteristics, or means of transmission, made or received pursuant to law or ordinance or in connection with the transaction of official business by any agency. This serial number is a public record. When the Town purchased this computer, the sale was a "transaction of official business by any agency". the computer's serial number was "made or received... in connection with the transaction of official business." Your prompt reply will be most appreciated.
