Idaho Fish and Game Department
This agreement made and entered into this ___day of ___ by and between the City of McCall, the party of the first part,
hereinafter referred to as the “City” and Idaho Fish and Game Department, the party of the second part, hereinafter referred to as “Idaho Fish and Game Department”.
WITNESSETH:
That
the parties hereto desire to enter into a Partnership Contract Agreement.
That the parties hereto desire to reduce their partnership contractual agreement to writing upon the following
terms and conditions, to-wit;
TERM: It is understood and agreed that the party of the second part shall own and be responsible for the maintenance of the Fish Pens at Brown Park to
the party of the first part for a period of one year commencing __________ and to terminate ______________. The terms of the contract will be automatically renewed on an annual basis
for four additional years, after which the parties by mutual agreement may continue indefinitely.
2. RESPONSIBILITIES OF IDAHO FISH AND GAME DEPARTMENT: It is understood and agreed
that Idaho Fish and Game Department will provide to the City the following:
a. Idaho Fish and Game Department will own and be responsible for the maintenance of
the Fish Pens at Brown Park.
3. RESPONSIBILITIES OF CITY: During the contractual term of this Agreement, the City shall provide Idaho Fish and Game Department the following:
a.
The City will provide a match of 50% for the Grant.
b. The City will provide access to the docks at Brown Park during normal operating
hours (six o’clock to eleven
o’clock).
c. The City will be responsible for the maintenance of the docks.
4. TERMINATION: This Agreement may be terminated by the City if is determined the service is not in the
best interest of the City. Termination will be ninety (90) calendar days after Idaho Fish and Game Department is notified
in writing of the termination. In contrast, Idaho Fish and Game Department may terminate the contract if it is determined that the agreement is not in their best interest. Idaho Fish
and Game Department will provide a minimum of ninety (90) calendar days after the City is notified in writing of the termination.
