The meeting was called to order at 9:00 A.M. by Mayor William

III. Minutes of the Regular Meeting & Public Hearing of December 14, 1990
Tne Town Clerk advised that there was an error in recording the
motion and vote concerning the Sipp Site Plan Review. She stated that
the record should reflect that Commissioner Armour seconded the motion
for approval of the plan, not Commissioner Wallace, and that the vote
was: Comm. Armour; AYE, Comm. Cross; AYE, Comm. Stahl; AYE, Comm.
Wallace: NAY, and Mayor Koch; AYE. Commissioner Armour moved and Commis-
sioner Wallace seconded that the minutes of the meeting of December 14,
1990 be approved as amended and all voted AYE.
IV. Additions, withdrawals, deferrals, arrangement of agenda items
The Town Clerk requested that two items be added under Commission
Action. The first item requested was the notification of a Public Hearing
being held by the Countywide Planning Commission, which would be item
IX.C. and the second item was to establish a date for consideration of
the Historical Preservation Ordinance, which would be item IX.D. There
was no objection to the additions and Mayor Koch directed they be added.
V. Announcements
Mayor Koch announced that the Town Commission would be holding a
Public Hearing on January 21, 1991 at 5:01 P.M. for the purpose of having
second reading and adoption of the "Land Development Regulations, Zoning
Ordinance Amendments and Amendments to Planning Board Duties to provide
for Architectural Review responsibilities.
VI. PUBLIC HEARING
A. Variances -Board of Adjustment
1. Mr. & Mrs. Mason Heydt, 2883 Banyan Blvd., Circle N.W.,
Boca Raton, F1. 33431 requesting a variance to permit
construction of a second story to an existing non- conform-

William Mayer, Chairman of the Planning Board advised with the new
design submitted by Mr. & Mrs. Heydt, concerns of property owners in
the neighborhood had been satisfied. In view of the fact there were
no objections to the plan as presented, the Planning Board recommended
that the variances be granted as requested with the provision that in
the future there be no other variances granted for the property, he said.
There was no comment from the public and Commissioner Armour moved that
the variances be granted as requested with the provision that no
additional variances in the future will be approved. The motion was
seconded by Commissioner Stahl. Roll Call: Comm. Wallace; AYE, Comm.

VII. Site Plan Review
A. Mr. & Mrs. Mason Heydt, 2883 Banyan Blvd., Circle N.W., Boca Raton,
F1. 33431 - Improvements to an existing structure including addition
of two bay windows, a second story addition and a single story
addition at 541 Banyan Road.
Mr. Mayer reported that the Planning Bd. recommended approval of the
site plan as presented. There was no comment from the public and
Commissioner Armour moved to approve the site plan as presented, seconded
by Commissioner Stahl. Roll Call: Comm. Stahl; AYE, Comm. Armour; AYE,
Comm. Wallace; AYE, and Mayor Koch, AYE.
B. The Architects Studio as agent for Mr. William Lamson, 5565 N.E.
29th Ave., Ft. Lauderdale, F1. 33308 requesting an amendment to a
previously approved si b� plan to remove an outside stairway and
stairwell, eliminate 2 round, wood columns, and to redesign the
roof, changing the roof line at 3777 N. Ocean Blvd.
Chairman Mayer of the Planning Board stated that the Board had recommended
approval of the site plan as presented. There was no comment from the
public.
Mayor Koch passed the gavel to Vice Mayor Armour declaring that he had
a conflict in this matter as his firm had participated in the sale of
the property upon which this improvement is being made.
Vice Mayor Armour asked if there was any comment from the Commission.
There being none, Commissioner Stahl moved and Commissioner Wallace
seconded that the site plan be approved as presented. Roll Call: Comm.
Wallace; AYE, Comm. Stahl; AYE, Vice Mayor Armour; AYE, and Mayor Koch
abstained. Vice Mayor Armour returned the gavel to Mayor Koch.
VIII. Reports
A. Town Manager
1. Water Usage
Mr. Flannery advised that the water usage was down 17.6% as compared to
this time last year. He added that this is not a per capita figure but
total usage. Commissioner Stahl commented that in the report dated
December 11, 1990 that had been prepared by Mr. Flannery regarding the
water consumption, there were no per capita comparisions. He noted that
the Town must determine what population figure was used in the Comprehensiv
Plan to determine the per capita figure that the Town is attempting to
reduce, and felt that it would be necessary to contact the Planning
Consultant with regard to this. Mr. Flannery advised the Commission that
he would like to have Comm. Stahl work with him and the Planning Consultant
if there were no objections from the Commission as Commissioner Stahl had
done a great amount of work on this, calling attention to the graphs that
Comm. Stahl had circulated to the members of the Commission prior to the
start of the meeting. There were no objections to Mr. Flannery's sug -_:_
gestion.

Commissioner Armour pointed out that he had an item directed to water
conservation under Items by Commissioners later on the agenda and advised
that he would just as soon address the subject at this time. He reminded
that Mr. Gwynn, Financial Director, had included funding in the budget
to purchase software for water billings that would enable him to show
comparisions of water consumption from billing period to billing period
or annual comparisions and questioned when that would be in operation.
Mr. Gwynn replied that he had been assured that the software would be
compatible with his hardware but when he went to purchase it, he found
that it was not. He advised that he is now searching the market for
another software program, otherwise he will have to add a piece of
hardware to his other equipment.
2. Increased Franchise Fees from Cable TV Service
In reply to a question at the December, 1990 meeting, Mr. Flannery advised
that in order to increase the percentage of fee, naa3% of the goss revenue
collected by Leadership Cable in Gulf Stream, it would be necessary to
have a new agreement and the current one does not expire for 15 years.
He added that the fees to the Town would increase automatically when
Leadership increases its fees to the subscribers, since the Town's fee
is based on the gross revenues of Leadership.
3. Declaration of Surplus Property
Town Manager Flannery called attention to the list of surplus property
that was included in the agenda packet which included the large truck
that had been used by the maintenance department, three police vehicles
that had been taken out of service when the new ones were delivered, a
double axle trailer, and a street sweeper attachement for the tractor.
He asked that these items be declared surplus property to enable him
to advertise them for sale thru sealed bids. Commissioner Armour moved
that the items listed be declared surplus property and sold via sealed
bids. The motion was seconded by Commissioner Stahl and all voted AYE.
4. Request for mailing of agendas.
Mr. Flannery advised that he had received a request from Mr. Dean Hill
that the Town advise the residents that agendas will be mailed prior to
each meeting on their request to do so and he was bringing it to their
attention since it would be a departure from the current procedure of
just supplying meeting dates. Mayor Koch and Commissioner Armour felt
that the dates of the meetings for each quarter, included with the water
bills would be ample citing the fact that there are frequently matters
discussed that are not on the pre- meeting agendas and further noting
that in the matter of variances, the property owners within 300' are
notified of the meeting. Mr. Hill was recognized and read a notice
about requesting agendas that he would like to have placed in the water
bills, adding that he did not feel that it was adequate to just advise
the dates of meetings. Commissioner Wallace was sympathetic with Mr.
Hill's request but suggested that the Town first try advising the dates
O to see how it works. With the members of the Commission in agreement,
Mayor Koch directed Town Manager Flannery to include the meeting dates for
each quarter and a brief summary of pending items along with water billing.
Mr. Flannery announced that he would be leaving for 2 weeks of active
duty with the Coast Guard beginning January 20, 1991 to February 4, 1991,
adding that there is a possibility that it could be extended in view
of the uncertainty of the situation in the Gulf.
B. Town Attorney
There was no report from the Town Attorney, Mr. Randolph.
C. Planning Board
There was no report from the Planning Board.

D. Financial Director
1. Reply to the Auditor's Management Letter received 12 -5 -90.
Mr. William Gwynn called attention to the reply to the auditors comments
that was in the agenda packet. He advised that he has implemented a
policy to expense any item costing $500 or less, immediately; had
recommended to the Town Clerk that daily deposits be made where it is
practical; has commenced a policy to bill past due water accounts on
the second month and subsequently make phone calls; will propose budget
amendments if needed during the fiscal year; has reviewed the new log
Cfor occupational licenses that the Town Clerk has established; and
discussed the need for an annual physical inventory with the Town Manager.
He went on to advise that the first inventory will be a very time
consuming task but then should be much easier in subsequent years. Commis-
sioner Stahl felt a date, such as a certain month, should be established
for this to be completed each year. Mr. Gwynn suggested that the first
inventory should be completed and then possibly a date established for
future inventories. Commissioner Armour moved that Mr. Gwynn's reply
to the auditors comments be accepted, seconded by Commissioner wallace
and all voted AYE.
2. Financial Report for December, 1990
Mr. Gwynn reviewed the financial report that had been included in the
agenda packet noting that the investments in the money market fund were
most likely the highest they will be for the year since a good portion
of the tax money had been received. The Commission noted that the
expenditure accounts for streets and sanitation appeared to have lower
balances than should be expected at this time of year and Mr. Flannery
was asked to review them and report back. Commissioner Armour moved
that the financial report for December, 1990 be approved as presented,
seconded by Commissioner Wallace and all voted AYE.
E. Police Department
Chief Schultz reported there were 3 criminal cases, small crimes,
investigated, 120 traffic citations, including warnings, given, 2 accidents
handled, 7 code violations investigated, 33 alarms answered, 5 assists
given to other departments, 44 miscellaneous service calls answered, and
35 directed patrols given. This was a total of 250 incidents.
F. Construction in Progress
The report revealed that the total amount of permitted work in progress
in December, 1990 was $11,979,055.
IX. Items for Commission Action
A. Emergency Medical Services for 1991
Town Manager Flannery advised that negotiations had been underway on an
administrative level between the Town of Ocean Ridge, the Town of Briny
Breezes, the Town of Gulf Stream and Bethesda Ambulance for a new
contract for Emergency Medical Service. Mr. Flannery reminded that the
C! current contract expires February 22, 1991 and that Bethesda had informed
the Town that it would be necessary that they be paid a subsidy of
$115,000 in order for them to meet expenses. He advised that the City
of Delray Beach would furnish the service for $59,000 per year to Gulf
Stream but that it would not be the "dedicated" service. He stated that
the three Towns had arrived at formula based on the winter population
and the number of calls for service for each Town which was 608 for
Ocean Ridge, 208 for Briny Breezes, and 208 for Gulf Stream. He further
stated that he is recommending that the contract would be for a 19 month
period which would place the expiration date at September 30, 1992, the
same date as the Ocean Ridge Fire Contract expires. He also advised that
any rate negotiations would take place in May, 1991 and cancellation by
any party would have to be a minimum of 6 months prior to expiration.

Mr. Flannery advised that the monthly figure is not yet firm but the
maximum per month would be $2,000 for Gulf Stream. He stated that
it is expected that we will have something more definite in another week
and it may be necessary to have a special meeting to consider a contract
if in fact the Commission directs that negotiations continue with
Bethesda. Commissioner Wallace stated she felt much more comfortable
with having Bethesda housed at the Town Hall than having response from
a site several miles away. Mayor Koch declared a conflict in this matter
in that he is a member of the Board of Trustees for Bethesda Hospital.
O Vice Mayor Armour.moved that Town Manager Flannery continue negoiations
in line with the report he had given, seconded by Commissioner Stahl.

Mayor Koch abstained.
B. Items by Commissioners
1. Water Conservation - Commissioner Armour
This item was addressed under the Town Managers Report.
C. Countywide Planning Council Public Hearing
Mr. Flannery advised that the Palm Beach County Municipal League was
asking that representatives of the member Town's attend the Public
Hearing on January 14, 1991 at 7 P.M. in order to show support for their
Resolution opposing most of the authority being assumed by the Countywide
Council. He pointed out that Gulf Stream had not supported the League
Resolution due to the fact that they had previously taken a stronger
position against the demands of the Planning Council and they did not
want it to appear that they had weakened from that. Mr. Flannery stated
that Mayor Koch was designated the voting member in the League but that
other representation was also welcomed. Attorney Randolph advised that
if a vote were to be taken, the representatives should make it clear
that while they do not support the League Resolution, it is only because
Gulf Stream has taken an even stronger position against the demands of
the Countywide Planning Council. Mayor Koch indicated he would attend
and Commissioner Armour stated that he may also attend.
D. Date for consideration of a Historical Landmark Ordinance.
It was reminded that at the Public Hearing, there was no action on this
item and there had been a request from the Civic Association membership
that no public hearing for adoption be held for at least 90 days. Attny.
Randolph suggested that he prepare a composit of changes that had been
suggested by various commissioners within the next few weeks which could
be circulated to the members of the Commission prior to the February
Meeting. He felt that they could be discussed then and he could be
given some direction as to what to include in the document. This was
agreeable to all members of the Commission

It was noted that the Town of Gulf Stream had previously taken action on
this matter.

Mayor Koch felt that as neighbors the Town should support this reasonable
request. All the Commission Members agreed. Mayor Koch directed Town

Commissioner Armour moved and Commissioner Wallace seconded that
the meeting be adjourned. All voted AYE and Mayor Koch adjourned the

Certified Public Accountants, received December 5, 1990.
Capitalizaton Policy
I have implemented a policy that any fixed asset item that cost $500.00
or less be expensed immediately.
Bank Deposits
I have recommended to the Town Clerk that daily deposits be made where
practical.
Water Fund Receivable Policy
I will commence a policy with the Town Clerk to see that past due accounts
are reviewed and contacted for collection.
Budget Appropriations
I will propose to the Town Commission proper budget amendments, if needed,
in the fiscal year.
Occupational Licenses
I will review the log system to be used to account for all licenses
issued or unissued.
Fixed Assets
I will discuss with the Town Manager the need for an annual physical
inventory to be taken.

The Town of Gulf Stream proposes to approve a Resolution regarding
the Comprehensive Plan for the area shown in the map in this
advertisement.
A Public Hearing on the Resolution will be held before the Town of
Gulf Stream Commission on Monday, January 21, 1991 at 100 Sea Road,
Gulf Stream Florida 33483 commencing at 5:01 P.M. The Commission
shall consider a Resolution approving adoption of comprehensive
plan amendments pursuant to the Settlement Agreement between the
Town of Gulf Stream and the State of Florida Department of
Community Affairs.

A Resolution of the Town Commission of the Town of Gulf Stream,
Florida adopting amendments to the comprehensive plan of the Town
of Gulf Stream, authorizing the forwarding of the amendments to the
State of Florida Department of Community Affairs and authorizing
Town Officials to undertake the necessary measures to effectuate
the requirements of Chapter 163, Fla. Stat.
