RESOLUTION 91 -3081
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TEMPLE CITY TO CONSIDER AN ALTERNATE PLAN
TO SOCIAL SECURITY FOR PART TIME EMPLOYEES
WHEREAS, it is determined to be in the best interest of the
City of Temple City and its employees to provide a Qualifying
Retirement System ( "Qualifying System ") to all employees not
currently eligible for such a Qualifying System, thereby meeting
the requirements of Section 11332 of the Omnibus Budget Recon-
ciliation Act (the "Act ") and Section 3121(b)(7)(F) of the Inter-
nal Revenue Code (the "Code ");
WHEREAS, it is the intent of the City Council of the City of
Temple City to adopt such a Qualifying System as an alternative
system to Social Security for employees not currently covered
under a Qualifying System;
WHEREAS, Final Regulations regarding the formulation, quali-
fication, and installation of such alternative plans have not
been issued, and proposed regulations are unclear and subject to
change;
NOW, THEREFORE, The City Council of the City of Temple City
does resolve, determine and order as follows:
SECTION 1. The City Council of the City of Temple City does
hereby intend to adopt such a Qualifying System effective January
1, 1992, for the benefit of employees employed on that date and
hired thereafter; and,
SECTION 2. The City Council of the City of Temple City
hereby authorizes the Financial Services Director and the Assis-
tant to the City Manager as Plan Administrators to select and
implement, upon approval from the Council, a Qualifying Plan
pursuant to the final regulations for Sec. 3121(b)(7)(F) of the
Internal Revenue Code when issued by the Internal Revenue Serv-
ice;
SECTION 3. The Plan Administrators are hereby authorized to
take whatever additional actions are necessary to maintain the
participation of the City of Temple City in the Qualifying Plan
and to take whatever other actions are necessary to comply with
Section 11332 of the Act, Section 3121(b)(7)(F) of the Code, and
relevant regulations issued or as may be issued.
