There V. Announcements A-. Dates of meetings scheduled in September & October, 1991 1. Town Commission Regular Meeting - September 13 at 4 P.M. was announced by the Town Clerk 2. Public Hearing for Budget Consideration - September 13 at 5:01 P.M. was also announced. 3. The Public Hearing for Budget Adoption would be held on September 24, at 5:01 P.M., the Town Clerk stated. Regular Meeting -Town Commission page -2- August 14, 1991 4. Mr. Harrington advised that the ordinances to amend the zoning code were in preparation and would be presented to the Architectural Review and Planning Board at their August and September meetings. He suggested that two public hearing dates in October be established for the adoption process with the Town Commission. The Commissioners agreed to hold the Regular Meeting of the Commission on Monday, October 7, 1991 at 4 P.M. and the first public hearing and first reading of the G Ordinances at 5:01 P.M. on October 7, 1991. The second reading, which must follow in two weeks from the first reading, will be held on October 21, 1991 at 5:01 P.M. VI. Site Plan Review A. Bill Rosenberg, Rosenberg Design Group, 10749 S.W. 104th St., Miami, F1. 33176 as Agent for Mr. & Mrs. Bruce McKinney, 3603 N. Ocean Blvd., Gulf Stream, F1.- Renovations to existing dwelling, driveway and landscaping. Joan Orthwein, Chairman of the Architectural Review and Planning Board, advised that the ARBP had recommended approval of the request with the exception of the gate that was planned for the driveway. She explained that the ARPB had found the design, a rising sun, unacceptable. The Board had felt a more traditional design would be better suited to blend with the others in the area. Mr. Rosenberg presented the site plan to the Commission explaining that by changing the garage door facing south to have it face west would make it possible to install a rock garden and water feature that would been seen from AlA with the door to be screened from view with plant material, some of which is currently in place. He advised that the surface of the existing driveway would be changed to pavers and the deck around the existing pool would be slightly increased. He presented color renderings of the proposed inprovements. Mr. Rosenberg explained that he did not have a new gate design to offer as Mr. McKinney had been out of Town and there had been no opportunity to confer with him. Mayor Koch passed the gavel to Vice Mayor Armour advising he may have a conflict in that his firm participated in the sale of the property some time previously. Vice Mayor Armour questioned of there would be any major change on the north side and if there would be any conflict within the historical corridor. Mr. Harrington advised that there is no change on the north O side and the plans had been submitted prior to zoning in progress being declared with regard to the corridor. However, he added that there is nothing in the proposed renovations that would conflict with regulations in the corridor ordinance. Commissioner Cross moved to approve the site plan as presented and recommended by the ARBP with the exception of the design of the gate, with a new design to be presented to the ARPB for a recommendation and submitted to the Commission at the next meeting. Regular Meeting -Town Commission page -3- August 14, 1991 Vice Mayor Armour returned the gavel to Mayor Koch. B. Carr Driveways, 612 Industrial Ave., Boynton Beach, Fl., Agent for W. Grant Williams, 3145 Polo Drive, Gulf STream, Florida- Addition of a circular driveway and landscaping improvements. Mrs. Orthwein advised that the ARPB had recommended approval of the site plan provided the width was reduced to 18 feet. The Board felt the requested width of 20' was out of proportion with the property. Mr. Harrington explained that the property did not currently retain the first inch of rainfall and was non conforming in that regard. He stated that the engineers design related to this project provided for additional retention in the rear yard and a retnetion area in the landscaped portion in the front between the two driveway exists. Members of the Commission pointed out that there are currently flooding problems in that area and expressed concern that the addition of more paving would add to the existing problem. Mr. Harrington suggested that a perc test could be required from the applicant to better determine the effectiveness of the planned retention areas. Commissioner Stahl moved that the Site Plan Review of the Williams project be continued until such time as the necessary tests have been submitted and reviewed with funds being authorized for review of the project by an independent engineer hired by the Town. Water Usage. Town Manager Flannery reported that the water consumption as compared to this date in 1990 was down by 6% and due to there having been problems with one of the meters in Delray, further calculations were not possible. B. Town Attorney Attorney Randolph had no report. C. Financial Director Mr. William Gwynn reported that the last tax check had been received and the cash projection to see the Town thru expenditures for August, September, October and November was right on target. Report on Meeting of July 17, 1991 Chairman Orthwein reported that the only item considered, other than those being considered at this meeting and the Firday Meeting, was an informal site plan review for a single family dwelling to be constructed on the south 100' of the Speer property. She reported that the plan in the preliminary stage had been favorably received and that a formal site plan review for the project would be held at the ARPB meeting on August 21, 1991. Police Report Chief Robert Schultz presented his report of activity for the month of July, 1991 and added that during the month of July, a probationary officer had been terminated and Officer Sindone had completed courses to satisify the mandatory recertification. F. Construction in Progress The report as circulated revealed there to be construction in progress C in July, 1991 in the amount of $5,967,974. VIII. Items for Commission Action A. Adoption of General Orders for Police Department Town Manager Flannery explained that Chief SOiultz had prepared the document and submitted to Attorneys Carson & Linn for review and recommendations, which were implemented, and is now prepared to implement the orders. Commissioner Stahl questioned if it is necessary for the Commission to adopt them. Attorney Randolph stated that if the Commission desires to do so, they may adopt them, or, after having reviewed the content, direct the Town Manager to promulgate them. He did recommend that a letter be obtained from Carson & Linn stating they had reviewed the orders and found them to be acceptable. The Commission directed that this be done and presented to the Commission for review. B. Items by Commissioners Commissioner Armour questioned if the dispatching contract with the City of Delray Beach had been properly executed. Town Manager Flannery advised that it had been and that the Town has a copy in the file. Commissioner Armour also asked if the hydrants had been checked and was advised that they had not been. IX. Corresnondence A. Draft of Water Conservation & Irrigation Ordinance proposed by Palm Beach County and Draft of the Document as proposed to be amended -Palm Beach County Municipal League. Commissioner Stahl observed that this is but another move on the part of the County to usurp Municipal authority and questioned if any of the other municipalities were opposing this. Attorney Randolph advised that the Town of Palm Beach was writing in opposition to both of the drafts. The Commission then directed that Attorney Randolph provide language for the Town to do likewise. B. Letter opposing proposed Water Conservation & Irrigation Ordinance drafted by Palm Beach County -City of Boynton Beach. This was made a part of the official record. C. Resolution #47 opposing delegation of DER authority to Palm Beach County DERM -Town of Lake Park The Clerk explained that Gulf Stream had taken a similar action several months earlier. D. Anthony for 2nd Vice President of Fla. League of Cities -Lake Worth This resolution was made a part of the official record of the meeting. F. Resolution #91 -899 Urging legislation to encourage the use of recycled and recyclable paper in the conduct of Governmental Business -Palm Beach County Commission CThis was also made a part of the official record. Commissioner Stahl called attention to a letter that had been received, after the agenda had been prepared,from Palm Beach County Municipal League addressed to the Palm Beach County Commission regarding their intention to present the Countywide Planning Council issue to the voters by referendem. He questioned how this can be stopped because he felt the County position would be voted on favorably. Attny. Randolph agreed with Commissioner Stahl's prediction and stated that the best way to defeat this is to inform the plublic as to why this would not benefit them. Commissioner Stahl felt that the press was at fault in that they have never presented both sides of the question. He stated that all reporting had been slanted toward the Countywide Planning Council position with nothing being said for position that the municipalities are taking. X.
