SUBJECT: City Council Meeting Report
V. CONSENT AGENDA
A. Approve LMCIT Liability Waiver Form for 2018 — The City is required to approve the
LMCIT form each year. Staff recommends approval.
See attached. form.
B. Resolution Designating Polling Places for the 2018 State Primary and State General
Election — The requirement for cities and school districts to designate their polling places
and combinations by December 31 of each year is due to law changes passed this year
(MN Laws 2017, Chapter 92; M.S. 204B.16; 205A.11). This change goes hand -in -hand
with the establishment of uniform dates for special elections. Staff recommends approval.

C. Resolution Granting Final Plat Approval of Lunski Nelson Addition — Dean Lunski has
made an application for a final plat for the Lunski Nelson Addition. The final plat is
related to the Medina Senior Living Facility site plan and preliminary plat, which were
approved by the City Council on September 19, 2017. Staff recommends approval.

D. Approve Development Agreement by and Between the City of Medina and Lunski
Development Medina, LLC — The City Attorney has provided a draft development
agreement for consideration by the City Council. If the Council approves the final plat, it
would be appropriate to take a second action to approve the development agreement.
Staff recommends approval.

E. Ordinance Establishing the Lunski Nelson Addition Storm Sewer Improvement Tax
District — The Council held a public hearing on establishing a storm sewer improvement
tax district for the property at the November 8 meeting. This ordinance is now presented
for action as well. Staff recommends approval.

F. Resolution Authorizing Publication of the Ordinance Establishing the Lunski Nelson
Addition Storm Sewer Improvement Tax District by Title and Summary — Staff
recommends approval of the resolution authorizing the publication of the ordinance by
title and summary in lieu of the entire ordinance.
See attached resolution.
G. Ordinance Regarding Solid Waste Storage; Amending Chapter 5 of the City Code — The
City Council had a policy discussion at the October 17, 2017 work session to address the
location of solid waste storage containers and the challenges with enforcing the current
ordinance Staff recommends approval of the updated ordinance allowing the cans to be
stored on the side of the garage without screening. This will bring the majority of the city
into compliance.

H. Resolution Authorizing Publication of the Ordinance Regarding Solid Waste Storage;
Amending Chapter 5 of the City Code by Title and Summary — Staff recommends
approval of the resolution authorizing the publication of the ordinance by title and
summary in lieu of the entire ordinance.

VII. OLD BUSINESS
A. 2040 Comprehensive Plan Update — The City Council reviewed the entire 2040
Comprehensive Plan at their work session on November 8th. The Planning Commission is
scheduled to review the plan at their November 14th meeting. If the Planning Commission
does not recommend any additional changes to the draft Plan, staff will request that the
City Council approve the Plan at the November 16th meeting and authorize submission to
the Metropolitan Council for review. The Metropolitan Council has up to 120 days to
review and take action on the City's Comprehensive Plan after the City submits a
complete plan. The Met Council has up to 15 business days after submission to determine
if the plan is complete.

Recommended Motion: Adopt resolution approving the 2020-2040
comprehensive plan update and authorizing submission to the Metropolitan
Council for official review.
X. APPROVAL TO PAY BILLS
Recommended Motion: Motion to approve the bills, EFT 004379E-004389E for $5,993.00 and
order check numbers 046590-046623 for $188,244.73.

SPECIAL MEDINA CITY COUNCIL MEETING MINUTES OF NOVEMBER 8, 2017
The City Council of Medina, Minnesota met in special session on November 8, 2017 at
5:00 p.m. in the City Hall Chambers. Mayor Mitchell presided.
I. ROLL CALL
Members present: Anderson, Pederson, Martin, Cousineau, and Mitchell.
Members absent:
Also present: City Planner Dusty Finke and City Administrator Scott Johnson.
II. 2040 COMPREHENSIVE PLAN — JURISDICTIONAL COMMENTS AND
COUNCIL REVIEW
Finke provided the City Council with the 2040 Comprehensive Plan. Finke also provided
background on the proposed changes and requested City Council comments.
Council reviewed each chapter of the proposed Comprehensive Plan and provided
comment to Finke. Council directed staff to proceed with option 2 in the staff memo if
the Metropolitan Council continues to take the position that Medina's staging of
development is inconsistent with Metropolitan Council policy.
Finke will present the proposed plan to the Planning Commission on November 14,
2017. If no significant changes are requested by the Planning Commission to the
proposed plan, then Finke will bring forward a resolution approving the 2040
Comprehensive Plan to the November 16, 2017 City Council Meeting.
IV. ADJOURN
Mayor Mitchell adjourned the Work Session at 6:50 p.m.

26 Moved by Pederson, seconded by Cousineau, to approve the October 17, 2017 special
27 City Council meeting minutes as presented. Motion passed unanimously.

29 B. Approval of the October 17, 2017 Regular City Council Meeting Minutes
30 It was noted on page ten, line 32, it should state, "Martin stated that the City was not
31 asked by the Metropolitan Council to add significant residential development to the City
32 and therefore there is a thought that this is an the City has an opportunity to keep the
33 residential development low." On page ten, line 45, it should state, "...plan they arc
34 currently being reviewed reviewing by the Metropolitan Council." On page 11, line 10, it
35 should state, "...ensured endeavored to stage development so that..." On page 11, line
36 6, it should state, "...not everyone wants that this type of development to occur, noting
37 that the residents are not-afl sad disappointed that..." On page 11, line 8, it should state,
38 "...staging and we speak for them. Representation is out obligation."

40 Moved by Cousineau, seconded by Anderson, to approve the October 17, 2017 regular
41 City Council meeting minutes as amended. Motion passed unanimously.

5 Johnson recognized Loren Kohnen for his 38 years of service, noting that he would be
6 semi -retired.

8 Mitchell suggested that the City express appreciation to Kohnen for his years of service
9 with a letter.

11 Moved by Martin, seconded by Anderson, to approve the consent agenda. Motion
12 passed unanimously.

16 A. Comments from Citizens on Items not on the Agenda

19 B. Park Commission
20 Scherer reported that the Park Commission will not meet in November. He stated that
21 the grant is moving forward and the volleyball court at the Fields of Medina will be
22 constructed the following day.

24 C. Planning Commission
25 Finke reported that the Planning Commission will meet the following week to conduct
26 two hearings and consider finalization of the Comprehensive Plan.

28 VII. NEW BUSINESS

30 A. Hamel Fire Department Contract Update Request (7:09 p.m.)
31 Johnson reported that the Hamel Fire Department is requesting a five-year extension of
32 their contract.

34 Martin stated that the department is looking to achieve durability and longevity to
35 negotiate with providers for financing of equipment. She stated a longer life contract is
36 more financially viable. She stated that there are also benefits for recruitment. She
37 believed that this would be a good compromise and noted that the department has done
38 a wonderful job in its recruiting efforts. She stated that all is going well and therefore she
39 has no reservations on the proposal. She stated that sometimes the paperwork is the
40 greatest headache in administrative work and this longer contract would allow the
41 organization to focus on the task at hand of providing fire protection services. She
42 stated that the City is very proud of the department and appreciates the benefit they
43 provide to the City.

45 Pederson stated that he can fully understand the need for a longer contract. He also
46 expressed appreciation for what the department provides to the City of Medina and
47 thanked the department for their service.

49 Anderson concurred with the previous statements.

51 Cousineau thanked the department for the service they provide.
