HomeMy Public PortalAbout20101201 specialSPECIAL COUNCIL MEETING DECEMBER 1, 2010 1 CALL TO ORDER The Special Council Meeting of December 1, 2010, was convened at 5:38 P.M. by Mayor John Landwehr. ROLL CALL The following Council Members were present for the roll call: Present: Carroll, Griffith, Koon, Medin Penfold, Pope, Scrivner, Struemph, and Weber Via Phone: Harvey Absent: None A quorum was declared present. BILLS PENDING Mayor John Landwehr distributed copies of a proposed motion and discussion was held regarding negotiations between the entities affected by the surtax discrepancies paid by the County for the past several years. Councilman Rich Koon asked if the motion would need to include rescinding previous action taken by the Council on this issue, and City Counselor Nathan Nickolaus stated the motion could include such language, and the ordinance previously enacted could be rescinded at another Council meeting. Following the lengthy discussion, Councilman Bob Scrivner made the following, motion, which was seconded by Councilman Rich Koon. "I move that the City Counselor be directed to file suit against Cole County in regards to the unpaid sales tax monies if the settlement agreement signed by the City is not signed by the County and delivered to the City by 3:00 p.m. on Thursday, December 2, 2010, and the approved settlement be withdrawn at this time." The motion was approved by the following roll -call vote: Aye: Carroll, Griffith, Koon, Medin, Penfold, Pope, Scrivner, Struemph, and Weber Nay: None *Councilman Harvey participated in the meeting via telephone, but did not vote. SPECIAL COUNCIL MEETING DECEMBER 1, 2010 2 ADJOURNMENT A motion was made by Councilman Bryan Pope for adjournment, seconded by Councilman Dave Griffith, and approved unanimously at 5:50 P.M.
