WHEREAS, McCall Skateboard Park Association, (the “Concessionaire”) wishes to operate a concession in McCall City Parks; and,
WHEREAS,
the City of McCall, Idaho (the “City”) may grant permission pursuant to Section 8-14-4 (F).1, McCall City Code, pursuant to a concessions agreement or special permit, to operate commercial
uses in a City Park; and,
WHEREAS, the Concessionaire has paid all negotiated fees for this Concession Agreement; therefore,
The City and the Concessionaire enter this agreement under
the following terms and conditions:
1. The Concessionaire shall be allowed to operate a concession cart for the sale of food and beverages in the following locations:
a. Legacy Park
b. Fairway
Park
The Concessionaire must have a valid hawkers permit and have paid all applicable fees before being allowed to sell concessions.
This Agreement conveys a non-exclusive right to
the Concessionaire to operate within the above-listed City Parks; the City reserves the right to grant other agreements or special permits as it sees fit.
The Concessionaire shall maintain
the area around its stands free of debris and shall leave the City Parks in as good or better shape than when Concessionaire set up.
The Concessionaire’s equipment will be subject to
inspection by the City Manager or his/her staff at any time.
The Concessionaire holds the City, its agents, officers and employees harmless from liability for any injuries whatsoever
to persons or property resulting from its operations in the City Parks and shall defend and indemnify the City, its agents, officers and employees from any claims arising from such operation.
Neithe
r the Concessionaire nor its employees are agents or employees of the City nor shall any insurance or benefits of any kind be a part of this agreement.
The hours of operation shall
be limited to 6:00 a.m. to 11:00 p.m., Tuesday through Sunday.
The term of this Agreement shall be from July 1, 2004, through September 30, 2004, but may be renewed by mutual agreement in writing. Fees shall be prorated for an extension of time.
The
negotiated fee for operation of a concession cart is $200 per month, through the term of this Agreement.
