Commissioner Wallace pointed out that there is an error in the firs
name of Mrs. Hupfel which should be Margaret rather than Florence. The
Town Clerk confirmed that it would be changed. Commissioner Wallace then
moved to approve the minutes as amended, seconded by Commissioner Cross.
All voted AYE at roll call.

C ' A. Town Manager
1.Bi- monthly water use
Mr. Harrington called attention to the report that had been
included in the agenda packet. He pointed out that 2 of the multi- family
developments have had an increase in usage and that he had contacted them
with regard to this. He was pleased to note that the usage from the private
clubs and the Town was down. Mr. Harrington reminded that the goal is to
reduce the consumption by 20% by the end of next year as compared to the
base year.
2.Sewer Survey Update
The Town Manager distributed a list of questions that he felt
could be a part of the questionnaire that is to be sent to the residents
in areas of the town which the private sewer would not be available to.

He suggested that the members of the commission review the list and
contact him regarding any changes they feel may be needed. Mr. Harrington
went on to advise that he is in the process of compiling a different list
for those who are in the area that could be served by the private sewer
system and added that he believed that the detail on cost, etc. that has
been provided by Mr. Hallock of the Gulf Stream Homeowners Improvement
CAssociation should be a part of that. The Town Manager believed the
survey should not be sent until the month of November in order to get
a larger response. Members of the Commission were in agreement. Mr.
Hallock offered to appear at a workshop meeting to answer any questions
the residents may have after receiving the survey material.
3. Hurricane Activities
Town Manager Harrington reported that all employees assisted
with the various tasks associated with evacuation of the town and securing
the town property and records. He stated that everything went smoothly
but there is additional equipment and supplies that should be added to
the town inventory for such emergency situations. Mr. Harrington stated
that he would elaborate on this during final budget deliberations. He
also reported that the Gulf Stream Golf Club had been very cooperative in
preparations for the hurricane and had participated in the clean up
activities afterward.
B. Town Attorney
Attorney Randolph had no report.
C. Finance Director
1. Financial Report for August 1992.
In the absence, with notice, of Finance Director William
Gwynn, Town Manager Harrington reviewed the report. There were no questions.
Commissioner Cross moved that the financial report for August be approved
as submitted, seconded by Commissioner True. Roll Call: Comm. Wallace;
AYE, Comm. Cross; AYE, Comm. True; AYE, and Mayor Koch; AYE.
D. Architectural Review and Planning Board
1. Regular Meeting to be held on September 23, 1992
2. Zoning Regulations for Decks & Mechanical Equipment (Ord.92/7)
Town Manager Harrington, in the absence of Chairman Orthwein,
reported that the Board had recommended adoption of this ordinance. He
added that since that time it has been noted that there should possibly be
a change in paragraph (2), Section. 66 -199. Mr. Harrington explained that
as written, paving, decks, etc. could extend into the setback areas provided
the structure was no more than four inches above the surrounding finished
grade elevation. He believed that the word "surrounding" should be replaced
with "highest abutting" pointing out that in some instances, there are
retaining walls where pools have been constructed on property where the
Cgrade drops sharply. The Commissioners agreed that this should be changed.
3. Regulation of Structures on the Beach (Ord. 92/8)
The Town Manager advised that the ARPB had felt that the
shade structures should not be permitted east of the dune or seawall but
were concerned that they are permitted thru a process with Palm Beach County
and the State of Florida. As a result they recommend that they be permitted
with the conditions that are set out in proposed Ordinance 92/7. The
Commissioners believed that structures should not be permitted east of the
dune or seawall and agreed to discuss the matter further at the Public
Hearing that would follow this meeting.

E. Police Report
Chief Schultz presented his report as distributed and added that
two new officers had been hired, Ron Inman who started on August 17, 1992
and John Haseley who started on September 5, 1992.
F. Construction in Progress
C The Construction in Progress Report revealed there to be
$7,725,436 worth of construction in progress during the month of August,
1992 and fees collected in the amount of $18,816.55.
VIII. Items for Commission Action
A. Ordinances -First Reading
1. Ordinance #92/2 Adopting & Enacting a New Code for the Town
Town Manager Harrington explained that this Ordinance
covers the new code that was distributed earlier, reminding that all of the
previous code and the Ordinances that had been adopted since the previous
code had been adopted are now organized into one book with no changes being
made except in the organization and titles of sections. He added that the
Land Development Regulations hwe been organized into one section of the
Code called Part B. and reprints of this Part B. are available for purchase
by the public. The Town Clerk read Ordinance #92/2 by Title. There was
no comment from the public. Commissioner True moved that Ordinance #92/2
be approved on first reading. The motion was seconded by Commissioner Cross.

Koch; AYE.
2. Ordinance #92/6 Providing for Occupational Registration Fees
Mr. Harrington reported that due to a change in the Florida
Statutes, it had been necessary to amend the Town's Ordinance which provides
for Occupational Licensing. He added that this change will lower the
revenue from this source but that he had taken this into consideration
when preparing the new budget. The Town Clerk read Ordinance #92/6 by
title. There was no public comment. Commissioner Wallace moved and Commis-
sioner True seconded that Ordinance #92/6 be approved on first reading.

B. Resolutions
1. Resolution #92 -6 Expressing Appreciation to Town Employees
for responding to the recent hurricane emergency.
The Town Clerk read Resolution #92 -6 in it's entirety. Commissioner Cross
moved that Resolution #92 -6 be adopted, seconded by Commissioner Wallace.

2. Resolution #92 -7 Expressing Appreciation for Hurricane
Assistance from the Gulf Stream Golf Club and It's Employees

Wallace moved adoption of Resolution #92 -7, seconded by Commissioner True.

III. Consideration and recommendations for or000sed Zonina Code Amendments.
A. Ordinance #92/3 Providing a restriction on the size, color,
construction and location of real estate signs.
The Town Clerk read the ordinance by title. Randy Ely, Town Resident, was
recognized and stated that he was opposed to having real estate signs
displayed in a wire frame that is stuck in the ground. He felt they are
unsightly in that they are always being moved by lawn people, etc. and end
up being crooked or leaning over. He favored a provision to require that
the signs be placed on posts at the same maximum height as the ordinance
is providing. Mr. Ely, being affiliated with a real estate firm, stated
that it would make no difference in their business as to which type was
decided upon.
Commission Wallace asked to go on record once again as being opposed to all
signs in town. However, she questioned if a compromise were possible by
permitting one post on which to mount a sign, no part of which would be
higher than four feet above grade. Commissioner True felt the metal frame
signs are more in keeping with the character of Gulf Stream.
Scott Tiernan was of the opinion that post signs are more aesthetically
pleasing and suggested that the Commissioners drive along AlA and compare
Cboth styles. He asked to go on record as being only concerned with beautifying
the Town.
Mayor Koch passed the gavel to Commissioner Cross, declaring a conflict of
interest in that the real estate firm with which he is associated is actively
engaged in business in the town.
Attorney Randolph advised that if substantive changes were to be made in the
proposed ordinance, it may be necessary to have a second, first reading. He
added that these public hearings are held to receive public input and changes
can be made, but that may require extra readings.

Commissioner Wallace reminded that when the ordinance was first proposed,
which was several months previously, both the Commission and the Architectural
Review and Planning Board had discussed the provisions at length with the
ARPB recommending approval of the Ordinance as proposed. She also recalled
that there were a number of residents present for these meetings who are
expecting the ordinance to be adopted as propsed.
Members of the Commission asked Mr. Tiernan and Mr. Ely to present examples
Cof the two types of signs under discussion at the next hearing. Acting
Chairman Cross asked if there was a motion regarding a recommendation for
Ordinance #92/3. Commissioner Wallace moved to recommend to the Town
Commission that Ordinance #92/3 be approved on first reading, seconded by
Commissioner True. Roll Call: Comm. Wallace; AYE, Comm. True; AYE, and
Acting Chairman Cross; AYE. Acting Chairman Cross returned the gavel to
Mayor Koch.
B. Ordinance #92/4 Providing that recreational equipment or com-

Town Manager Harrington reminded that in discussion of this ordinance during
the presentation of the recommendation of the ARPB, he had suggested.that
a change in paragraph (2), Section. 66 -199 be made; changing the word
"surrounding" to with "highest abutting ", with reference to the grade in
the area of the proposed construction. The Commission members and Attorney
Randolph were in agreement with this suggestion. Commissioner Wallace moved
that Ordinance #92/7 as amended be recommended for approval on first reading.
The motion was seconded by Commissioner True. Roll Call: Comm. Wallace;
AYE, Comm. Cross; AYE, Comm. True; AYE, and Mayor Koch; AYE.
E. Ordinance #92/8 Regulating the construction and location of

ORDINANCE 92/2: AN ORDINANCE ADOPTING AND ENACTING
A NEW CODE FOR THE TOWN OF GULF STREAM, FLORIDA;
PROVIDING FOR THE REPEAL OF CERTAIN ORDINANCES NOT
INCLUDED THEREIN; PROVIDING A PENALTY FOR THE
VIOLATION THEREOF; PROVIDING FOR THE MANNER OF
AMENDING SUCH CODE; AND PROVIDING WHEN SUCK CODE
AND THIS ORDINANCE SHALL BECOME EFFECTIVE.

THE TOWN OF GULF STREAM, FLORIDA proposes to modify zoning regulations
within the areas shown on the map by adoption of zoning ordinances amending
the regulations contained within all zoning districts of the Town as set

A. Ordinance #92/3 Providing restrictions on the size, color,
construction and location of real estate signs.
Mayor Koch passed the gavel to Commissioner Cross, declaring a conflict of
interest in that the real estate firm with which he is associated is
actively engaged in business in the town.
The Town Clerk read the Ordinance by title. There was no comment from the
public. Commissioner Wallace moved to approve Ordinance #92/3 on first
reading as recommended by the Local Planning Agency, seconded by Commissioner
True. Roll Call: Comm. Wallace; AYE, Comm. True; AYE, and Acting Chairman
Cross; AYE. Acting Chairman Cross returned the gavel to Mayor Koch.
B. Ordinance #92/4 Providing that recreational equipment or
commercial vehicles be parked so as to be fully screened from

The Town Clerk read the ordinance by title and there was no public comment.

Commissioner Wallace moved that Ordinance #92/7 be amended at paragraph (2)
line 5 in Section 66 -199 by replacing the word "surrounding" with "highest
abutting" in reference to the grade in the area of the proposed construction.

Commissioner Wallace then moved the approval of Ordinance #92/7 on first
reading as amended and recommended by the Local Planning Agency, seconded
by Commissioner True. Roll Call: Comm. Wallace; AYE, Comm. Cross; AYE,
Comm. True; AYE, and Mayor Koch; AYE.
E. Ordinance #92/8 Regulating the construction and location of
beach shade huts.
The ordinance was read by title by the Town Clerk and there was no comment
1 from the public. Commissioner Wallace believed that beach shade huts should
not be permitted and all others agreed, citing the hazards from storms
and the aesthetics along the beach. Commissioner Wallace moved that ordinance
#92/8 not be approved on first reading, as was recommended by the LPA, and
that at some future time, consideration be given to an ordinance which would
prohibit structures seaward of the dune or seawall. The motion was seconded
by Commissioner True. Roll Call: Comm. Wallace; AYE, Comm. Cross; AYE,
Comm. True; AYE, and Mayor Koch; AYE.
It was announced that a Public Hearing would be held on September 28, 1992
at 5:01 P.M. at which the ordinances that have been approved on first reading
will be presented for second reading and adoption.
IV. Presentation of the proposed budget and proposed millage rate for
fiscal year 1992 -1993.
A. Discussion from the Commission and the Public
Town Manager Harrington presented the budget in the proposed
amount of $1,188,800 which reflected a proposed millage of $3.2655 per $1,000
of assessed value for operating purposes and a rate of $.8058 to cover the
debt service. He then called attention to the budget for the enterprise
fund in the amount of $254,000.
Mayor Koch stated that the rolled back rate for the operating fund is $3.3045
per $1,000 of appraised and he was pleased that the proposed millage is a
little less than that. He further stated that he had been prepared to
suggest some additional reductions but after having considered some of the
needs with regard to emergencies such as hurricanes, he felt the budget should
remain in tact as proposed. The other Commissioners were in agreement.
V. Adoption of Tentative Millage Rate for Fiscal Year 1992 -1993.
Commissioner True moved that a tentative millage rate for the
operating fund for fiscal year 1992 -1993 in the amount of $3.2655 per $1,000
of assessed value be adopted. The motion was seconded by Commissioner Wallace.
