Mayor Koch stated that a discussion related to limiting the period
for construction would be held first. He added that the Commission had
asked Mr. Harrington to obtain information from other municipalities that
regulate construction activity. He asked Mr. Harrington to present his
findings.
Town Manager Harrington reported that the Town of Palm Beach prohibits
the operation of dredges, pile drivers, engines operated in such a manner
as to emit odors or noises offensive or disagreeable to the inhabitants
of the town, sand blasting machines, concrete and /or pumping manchines,
and jackhammers from December first to May first. He added that they
also prohibit any other class of machinery or appliance which in its
operation would render the enjoyment of property within the town less
agreeable than if such appliances or machinery were not operated. Mr.
Harrington advised he was advised by code enforcement in Palm Beach that
this provision was enforced only when complaints are received. He said that
the enforcement is done by noise measurements being taken and compared
to noise standards that are established in a separate section of the Palm
Beach Code that deals with all different types of noise. Mr. Randolph
stated that a noise ordinance is a rather complicated document and he
questioned if the Town of Gulf Stream was interested in going to this extent.
Mr. Harrington suggested that he and Mr. Randolph review the existing
nuisance section of the Gulf Stream Code and attempt to make it more
restrictive in an effort to address the problems that are not covered by
enumerating the heavy equipment that would be regulated during the winter
season.
Several from the audience supported a seasonal regulation of construction
work. Mr. Charles Velie, President of the Civic Association, advised that
the Civic Association believed the provisions of the Palm Beach Ordinance
as outlined would be beneficial to the residents of Gulf Stream. Commis-
sioner Armour suggested that Attorney Randolph and Town Manager Harrington
prepare a document for review along the.lines that have been discussed.
The other Commissioners were also in favor of this suggestion.

Commissioner Wallace reminded that Mr. Harrington had made some suggestions
in his memo of April 2, 1993 with regard to further restricting the hours
of construction during the season. She stated that one of the suggestions
was to prohibit construction on Saturday during the season and the other
was to shorten the work day. Mrs. Wallace questioned if there was any
interest in either or both of these suggestions. Commissioner Armour
was opposed to shortening the work day, pointing out that it is a benefit
to have the jobs completed as soon as possible and shortening the work
day amounts to quite a large number of hours when computed over the entire
season. Mayor Koch observed that there is very little work done on Saturday,
unless there is an emergency. Mr. Harrington stated that most of the work
that is done on Saturday is on the inside of the building. All Commissioners
agreed that Saturday work is not usually a problem, and they asked Attorney
Randolph to prepare a section for consideration that would prohibit work
on Saturday from December 1, to May 1 unless the work is being performed
within an enclosed area. Mr. Harrington asked if it is intended to
prohibit work on holidays, adding that holidays are not prohibited working
days under the current provisions of the Code. The Commissioners asked
that Mr. Harrington prepare a recommendation with regard to this.
With regard to applications for improvements that require variances and
site plan reviews, Commissioner Wallace advised that many residents had
voiced their objections to variance and site plan reviews taking place
during the summer months when many are not in residence to monitor the
developments. She stated that she realized that almost any work that is
to be done must go through the review process, but added that she hoped
in the future that these requirements could be reviewed and perhaps altered
to transfer the authority for approval on some of the items to the Town
Manager. Mrs. Wallace suggested that applications for demolition permits
and for new houses not be acted upon during summer months. Attorney
Randolph cautioned about refusing applications over a lengthy period, adding
that the longer they are delayed, the more likely it is for the actions of
the Town to be challenged. Members of the Architectural Review and Planning
Board who were present stated that notices are sent to the property owners
in the area of the proposed improvements well in advance so everyone knows
what is being proposed in time to investigate the matter. They did not
believe it necessary to suspend all operation during the summer.
Charles Velie, town resident, stated that residents were concerned about
some of the newer houses being constructed in that they are too large and
do not fit the character of Gulf Stream. Mr. Velie advised that this was
not the consus of the Civic Association. His personal feeling in this
matter is that applications not be heard during the months of July,
August and September as the members of the ARPB and Town Commission are
placed in a difficult position if no one is present to object at the hearings.
Various persons spoke both pro and con on the matter but did not come
forward to have their remarks made a part of the record. A show of hands
from the audience indicated that most favored having no action taken on
applications during the month of August. The staff was instructed to use
this as a guide for any proposed legislation.

Town Manager Harrington remarked that the discussion thus far had centered
around construction related activity and he questioned if there was any
interest in placing additional regulation on maintenance activities such
as lawn mowing, etc. Mr. Harrington advised that at the present time the
property owner may perform his own maintenance work at any time, as may
the persons who are directly employed by him. He added that this does not
apply to those working under a contractual arrangement. There was no
desire to change the existing regulations indicated.
V. Items by Commissioners
A. Mayor Koch
Mayor Koch had no items for discussion.
B. Vice Mayor Armour
Vice Mayor Armour suggested that at such time as there are openings for
appointments on any of the Town Boards or Committees, a form listing the
name, address, education, business or profession, length of residencey
in Gulf Stream, etc. be submitted by those who are interested in the
positions.
Commissioner Armour voiced a concern regarding code enforcement of the
ordinances that have, and will in the future, be adopted. He asked if the
police department was assisting the town manager and if perhaps it might
be necessary to have a code enforcement officer. Mr. Harrington advised
that the police department is assisting him in the code enforcement but
that he is in the process of making some changes in the procedures that
are used. He did not feel that another employee was need for this task.
Mr. Armour asked if there are any changes in process with regard to the
water conservation program and rate revisions. Mr. Harrington advised he
is gathering data after which he will be making some recommendations.
Regarding the matter of the tree trimming on AIA, Commissioner Armour
asked for an update. Mr. Harrington advised that DOT has yet to provide
a survey of the right -of -way and the DOT departments and employees are
fighting among themselves over this. He went on to say that he met
with them again approximately two weeks ago and believes they are making
some progress. Mr. Harrington reported that when the last storm blew
several trees down on AlA and caused broken limbs that did not fall, he
called DOT about the condition and they sent a crew the following day to
correct the problems and take away the debris.
_ Commissioner Armour asked if there would be any maintenance work to be done
on the streets and /or town buildings. Mr. Harrington advised he is checking
on the conditions of the streets periodically and that a considerable
amount of maintenance had been done on the town buildings, which he intends
to detail in a memorandum to the Commissioners. Mr. Harrington and Chief
Schultz advised that there is driveway repair needed at the police department,
adding that the parking lot needs to be expanded and a sunken storm drain
repaired. Mr. Harrington stated that a considerable amount of landscaping
is needed at the town hall site but that he did not want to spend any un-
budgeted funds during this fiscal year as unbudgeted funds had been used
for storm drainage repairs this year and he wanted to have a reserve to be
available in the event of a storm this summer. It was mentioned that
perhaps donations would be available to assist with this problem and that
the Beautification Committee connected with the Civic Association make
recommendations regarding the re- landscaping.

Mr. Armour closed by reminding that efforts will continue toward annexing
the parcel to the north of Place Au Soleil that is owned by FIND.

E. Commissioner Wallace
Commissioner Wallace began by expressing her appreciation to Chief Schultz
for conducting the recent crime prevention session for the residents and
added that she is hopeful that there will be more of them in the future
and that group leaders can be organized to assist with crime prevention.
Mrs. Wallace expressed concern that residents do not feel they have enough
information as to the dates of meetings and action that has been taken by
the Commission. She advised those present that meeting dates are published
each week in the Palm Beach Post in the "Community Calender" and questioned
if newsletters could be sent three times a year, perhaps with some other
mailing from the Town. Mr. Harrington advised that at this time, in addition
to the "Community Calender", the Town delivers an agenda prior to the
meetings to both the Civic Association and the Place Au Soleil Association.
Commissioner Wallace called attention to a letter from Robert Howes,
President of the Hidden Harbour Estates Subdivison Central Committee request-
ing that the budget for 1993 -1994 include funding to clean up fallen branches
and trees in the bird sanctuary adjacent to Hidden Harbour, and to repair
the seawall that appears to be in a state of imminent collapse. Mr.
Harrington advised that he will be visiting the site and will have a report
for the Commission, but most likely not until the June, 1993 meeting. Commis-
sioner Armour reminded that when dredging was being undertaken in the town
several years past, it was determined that as a bird sanctuary, improvements
would be very limited due to possibly destroying the natural habitat of
the sanctuary. There was concern in this regard expressed from some of
the members of the audience and Mayor Koch advised that this matter would
be fully reviewed with public input welcomed prior to any decision being
made.
VI. Items by Staff
A. Police Chief Schultz
Chief Schultz stated that he had intended to discuss repairs of the parking
area at the police headquarters but that it had been covered during Commis-
sioner Armour's presentation.
B. Town Manager Harrington
Mr. Harrington stated that he had believed this workshop would possibly
address issues involving the 1993 -1994 budget. He urged that he be made
aware of needed projects in time to be considered at the budget meetings.
He mentioned again the re- landscaping of the town hall and police department
sites. Mr. Harrington also advised that he had been informed by the Little
Club that drainage pumping equipment on their property had failed and it
is necessary that a new pump be purchased and installed. He reminded that
the Town has a contract with the Little Club which provides that the Town
share in the cost of operation since the Town utilizes this as a part of
the storm drainage system. Mr. Harrington stated that the Town's share of
the replacement cost is $8,500 and that the Little Club will carry the
entire cost until such time as the Town can reimburse them in the 1993 -1994
fiscal year.

Town Manager Harrington reported that Place Au Soleil Assoc. is relandscap-
ing the entrance area to Place Au Soleil and incorporating Xeriscape
designs. He recommended that the Town reconfigure the sprinkling system
to accomodate the new installation, adding that this would meet one of the
commitments made in the water reduction plan. Mr. Harrington then addressed
the matter of preparing a new personnel manual that had been mentioned
earlier in the meeting by Commissioner Armour. He reported that while he
Chad begun work on this, it is now evident that some help will be needed
from someone specifically engaged in this area of expertise. Mr. Harrington
cited the continually changing laws and regulations of State and Federal
Agencies that must be taken into consideration when dealing with and
regulating personnel. In closing, Mr. Harrington reminded that he had
mentioned several months ago that the Palm Beach County Municipal League
had asked Gulf Stream to sponsor one of their meetings since all other
municipalities in the County have done so. At that time, he had suggested
that it be held at the Bethesda Hospital facility as the Town Hall was
not large enough to accomodate such a gathering. Town Manager Harrington
advised he had been talking to officials at the Village of Golf in regard
to this and it had been suggested that the Village of Golf and the Town
of Gulf Stream co- sponsor a luncheon at the Bethesda Hospital facility.
The members of the Commission favored this suggestion and Mayor Koch offered
to make the necessary contacts with Bethesda Hospital.
VII. Items by Organizations
A. Gulf Stream Civic Association
Mr. Charles Velie, President of the Civic Association, advised that the
matters with which his organization was concerned had already been addressed.
B. Place Au Soleil Association, Inc.
Mr. Charles Russell, President of the Place Au Soleil Association stated
that they were intrested in some type of legislation that would require
properties to be properly maintained, which would include the yards as
well as the structures themselves. Mr. Harrington advised that there are
limitations as to how far the Town can go with this but that he and Attny.
Randolph would make every effort to address this as far as possible.

NOTICE OF APPLICATION FOR DEVELOPMENT APPROVAL
Mr. Richard K. Brooks, Jr. of RKB Architects Planners, Inc. as agent
for Gerry and Mary Lepkanich, the owners of real property located at
3223 North Ocean Boulevard, Gulf Stream,Florida, has submitted an
application for a site plan amendment to permit the addition of two
second floor bedrooms and an open, outside stairway to the structure
under construction at the aforementioned location. The proposed
addition would be added on the south side of the structure and would
extend fifteen (15) feet south from the south wall of the approved
structure. The proposed addition would extend to within thirty (30)
feet, eight (8) inches of the south property line. Complete application
materials are on file with the Town of Gulf Stream Planning and
Building Department located at 100 Sea Road, Gulf Stream, Florida 33483
and may be inspected during regular business hours which generally
included non - holiday weekdays from 9:00 A.M. to 4:00 P.M.
The Town of Gulf Stream Architectural Review and Planning Board will
consider the subject application at its meeting on April 28, 1993 at
9:00 A.M., in the Commission Chambers in the Gulf Stream Town Hall
located at 100 Sea Road, Gulf Stream, Florida 33483 and shall make a
recommendation to the Town Commission regarding the subject application.
Said meeting may be adjourned from time to time and place to place as
may be necessary to hear all parties and evidence.

application at its meeting on May 14, 1993, at 9:00 A.M., in the
Commission Chambers in the Gulf Stream Town Hall located at 100 Sea
Road, Gulf Stream, Florida 33483 and shall make a final decision

time to time and place to place as necessary to hear all parties and
evidence.

Mr. Edward Knight of Shannon Ginn Construction Company as agent for Mr.
George Elmore, the owner of real property located at 1320 N. Ocean
Bouleverd, Gulf Stream, Florida, has submitted an application for a
Special Execption to permit the installation of a construction trailer
on said property. The subject installation is proposed to consist of
a temporary job trailer for the general contractors field office, the
size of which would be ten (10) feet by thirty (30) feet and would be
located on the east side of the property approximately fifty (50) feet
