AWARDING CONTRACT FOR THE HAYWARD AVENUE PUMP STATION
AND FORCE MAIN REPLACEMENT PROJECT/CONTRACT NO. 04-11
WHEREAS, pursuant to Resolution #05-37, the Borough of Carteret ("Borough")
authorized the preparation of bid specifications and contract documents and
advertisement for receipt of bids for the Hayward Avenue Pump Station and Force Main
Replacement Project/Contract No. 04-11; and
WHEREAS, the Borough has previously received bids for said project on June 9, 2005;
and
WHEREAS, initially, B & B Construction Co., LLC submitted the lowest bid for said
work; and
WHEREAS, based upon the above bid, the Borough authorized the award of a contract
to B&B Construction for said work; and
WHEREAS, B&B Construction advised the Borough that it had made an error in its bid
submission and requested that it be allowed to withdraw its bid for referenced project;
and
WHEREAS, the Borough's Consulting Engineer for the project, Hatch Mott
MacDonald, has advised the Borough that releasing B&B Construction from the
requirement that it construct the project work consistent with its bid on the same is
appropriate under the circumstances; and
WHEREAS, Hatch Mott has further advised Borough that the second lowest bidder for
the project, Scafar Contracting, Inc., has agreed to honor its original bid proposal for the
project, as set forth in a letter from Hatch Mott dated September 9, 2005, a copy of which
is attached hereto; and
WHEREAS, in light of the information detailed in the Hatch Mott correspondence and
the recommendation contained therein that a contract for the project work be awarded to
Scafar Contracting, Inc.; and
WHEREAS, the Borough's Chief Financial Officer has certified that funds are or will be
available for the award of a contract for said work.
NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of
Carteret, County of Middlesex and State of New Jersey as follows:
1. That the Borough hereby awards the bid for the Hayward A venue Pump
Station and Force Main Replacement Project/Contract No. 04-11 to Scafar
Contracting, Inc., in the amount of $1 ,452,050.00 for the Base Bid.
2. That the appropriate Borough Officials are hereby authorized and directed to
enter into a contract with Scafar Construction, Inc., 225 Pacific Street,
Newark, NJ 07114, for the Hayward Avenue Pump Station and Force Main
Replacement Project/Contract No. 04-11 in the amount of$I,452,050.00 and
in accordance in all respects with the request for proposals and bid on the
same.

3. That Resolution No. 05-237 awarding a contract for the above referenced
project to B&B Construction Co., LLC is hereby rescinded.
4. That a copy of this Resolution shall be forwarded to the Borough's
Purchasing Department and Hatch Mott MacDonald for distribution to Scafar
Contracting, Inc..
