SUMMARY STATEMENT: The first step in the process
for judicial confirmation of an ordinary and necessary is the public hearing on the matter. Attached is a copy of a resolution to notice a public hearing. We will notice the hearing
and conduct it on March 11th, 2004. Mike Moore is reviewing the previous judicial confirmation and there is a slight possibility that it could be used to cover the continuation of the
master plan and the construction of the water tank. Since his office will issue the legal opinion, he wants to first confirm whether or not the existing action will suffice. If we
learn after posting for the hearing that we do not need a second confirmation, we will cancel the hearing.
RECOMMENDED ACTION: Pass Resolution No.04-01 and authorize the Mayor to
sign.
