SUMMARY STATEMENT: Staff
published a notice of Public Hearing for March 11, 2004 to consider requesting judicial confirmation regarding our declaration of ordinary and necessary expense and associated indebtedness
for the construction of a water storage tank and associated infrastructure. The notice was not properly published and the hearing had to be re-noticed. The notice has been properly
published. Attached is a draft petition prepared by the City Attorney. In conjunction with the judicial confirmation, we must obtain approval from DEQ for State Revolving Funds loan
proceeds to fund the project. Although we anticipate being able to fully fund the project with SRF proceeds, it is important to leave additional options open so our recommended action
refers to funding approval.
RECOMMENDED ACTION: Staff requests Council conduct that public hearing and if, following any comment the Council desires to move forward they make the
following motion:
Direct the staff to seek funding approval for the necessary improvements to our domestic water system facilities and petition the court for judicial confirmation
of this action at the appropriate time and authorize the Mayor and City Attorney to sign all necessary documents.
