COUNCIL MINUTES
AUGUST 23, 1972
INITIATION:
1. Mayor Briggs called the regular meeting of the City Council to
order at.7:35 p.m. on Wednesday, August 23, 1972, the meeting
having been changed from the second Tuesday by .action of the
Council at previous meeting.
2. The invocation was given by the Reverend Edwin Linberg, Pastor,
Temple City Christian Church, 9723 E. Garibaldi. In the invocation,
special tribute was paid to the memory of Virginia Harker, wife of
former Councilman William Harker, who had died of cancer the
previous day.
The Pledge of Allegiance to the Flag was led by Mayor Briggs.
4. ROLL CALL:
Present: Councilmen - Dennis, Gilbertson, Merritt, Tyrell, Briggs
Absent: Councilmen -None
Also Present: City Manager Koski, City Attorney Martin, Planning
Director Dragicevich, Regional Engineer Kriegel, Parks and
Recreation Director Kobett, Administrative Assistant Biel.
5. APPROVAL OF MINUTES:
It was moved by Councilman Merritt, seconded by Councilman Gilbertson
and carried to approve the minutes of regular meeting of August 1,
1972, as mailed, Councilman Dennis abstaining. Councilman Dennis
advised that he had reviewed the tapes of the August 1 meeting, and
that he was familiar with forthcoming items of unfinished business
and prepared to vote on same.
A special citation in recognition of Outstanding Pedestrian Safety Program
Activities, awarded by the American Automobile Association, was presented
by Don Hoffman, Public Safety Consultant, Automobile Club of Southern
California, to Mayor Briggs on behalf of the .City. In the presentation,
Mr. Hoffman stated that the Outstanding Pedestrian Safety .Program
Activities Award was based on evaluation of the community's accident
records system, specific pedestrian control legislation, enforcement of
pedestrian and driver behavior, traffic engineering service for
pedestrians, community traffic safety coordination, school traffic safety
and public information and education.
UNFINISHED BUSINESS:
6. PUBLIC HEARING: 7:30 p.m. Re. Adoption by Reference of New Los
Angeles County Electrical Code - ORDINANCE No. 72 -359, 2nd read.
City Manager Koski presented background information, advising
that in adopting by reference the County Electrical Code, that
a- Public Hearing was required, which hearing had been set by the
City Council at a previous meeting and due notice given.
Mayor Briggs declared the Public Hearing open, and invited those
present who wished to speak for or against the Ordinance to come
forward.
Dale Ingram, P. 0. Box 229, El Monte, spoke in favor of the
ordinance, advising that this would standardize building requirements
with those of the county and other areas where the code has already
been adopted.
Gordon Kriegel, Regional Engineer, advised that the code had the
concurrence of the Building and Safety Committee, the Los Angeles
Chamber of Commerce, and Electrical Contractors Association.
No one else came forward to speak.

Councilman Tyrell moved to close the Public Hearing, seconded
by Councilman Merritt and unanimously carried.
City Attorney Martin presented Ordinance No. 72 -359 entitled
AN ORDINANCE AMENDING ORDINANCE No. 68 -270 OF THE CITY OF TEMPLE CITY
BY ADOPTING BY REFERENCE THE LOS ANGELES COUNTY ELECTRICAL CODE AS
CONTAINED IN THE 1972 EDITION OF THE LOS ANGELES COUNTY ELECTRICAL
LAWS AND PUBLISHED BY. THE JOURNAL OF COMMERCE AND INDEPENDENT REVIEW,
AND MAKING OTHER AMENDMENTS, for second reading by title only.
Councilman Tyrell moved to waive further reading and adopt, seconded
by Councilman Gilbertson and unanimously carried.
PROPOSED AMENDMENTS TO TEMPLE CITY MUNICIPAL CODE: Re. Zoning.
A. ORDINANCE No. 72 -358: 2nd read. Re. Consideration of C -3 Zone
and Related Amendments.
City Manager Koski advised that Council had held first reading
on proposed ordinance relating to C -3 zone and related changes of
zone, which had incorporated certain changes from the recommendation
of the Planning Commission as set forth in Resolution No. 72- 462PC,
and that it had been returned to the Planning Commission for further
consideration as amended. Certain clerical amendments recommended
by the Planning Commission were set forth in draft form for
consideration by the Council, which were reviewed and included on
several items. City Attorney Martin presented Ordinance No. 72 -358
entitled AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTIONS
9390 AND 9410 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO PERMITTED
USES IN THE C -2 AND M -1 ZONES; REPEALING SECTIONS 9400 THROUGH 9404
OF THE TEMPLE CITY MUNICIPAL CODE, DELETING THE C -M ZONE, AND THE
ADDITION OF NEW SECTIONS 9400 THROUGH 9404 ESTABLISHING A NEW C -3
HEAVY COMMERCIAL ZONE IN THE CITY AND IMPOSING THE REGULATIONS
THEREOF UPON CERTAIN AREAS AND PARCELS IN THE CITY, for second
reading by title only. Councilman Merritt moved to waive further
reading and adopt,, seconded by Councilman Tyrell and unanimously
carried.
Councilman Merritt moved that the changes made in Ordinance No.
72 -358 were clerical only, and do not affect the ordinance, seconded
by Councilman Tyrell and unanimously carried.

B. ORDINANCE No. 72 -360: grid read. Re. Change of Zone from
R -4 to C -2
, 5302 thru 5336 Rosemead Boulevard.
City Attorney Martin presented Ordinance No. 72 -360 entitled
AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING THE ZONING MAP
OF THE CITY OF TEMPLE CITY BY REZONING CERTAIN PROPERTIES, for
second reading by title only, advising that the content of this
ordinance for proposed zone change was in harmony with the uses
set forth in Ordinance No. 72 -358, just adopted. Councilman Tyrell
moved to waive further reading and adopt, seconded by Councilman
..Gilbertson and unanimously carried.
I 8. LEASE AGREEMENT: City -owned Property, 5843 Temple City Boulevard
City Attorney Martin advised that in accordance with Council action
at their previous meeting, a lease agreement had been prepared for
lease of City -owned property located at 5843 Temple City Boulevard,
with Leland C. Meeks as lessee. Councilman Tyrell moved to approve
and to authorize the Mayor and City Clerk to sign, seconded by
Councilman Merritt. A roll call vote on the motion was taken, the
motion carrying with three "yes" and two "no" votes, Councilmen
Gilbertson and Dennis voting "no." Councilman Gilbertson stated that
he did not wish to tie up the property for three years, hence was not
in favor of the lease.

9. RECOMMENDATION FROM TRAFFIC COMMISSION - Meeting of August 2, 1972
City Manager Koski presented the recommendation from the Traffic
Commission relative to changes recommended by the Council for .
certain signals to begin full operation at 7 aomo instead of 6 a.m.,
which was concurred in by the Traffic Commission with the exception
of Las Tunas Drive at Oak Avenue, which the Commission recommended
retaining at the 6 aomo hour, as set forth in memorandum dated
August 4, 1972. While reviewing the recommendations from the
Traffic Commission, Council also studied those signals presently
on full 24 -hour operation, considering that these may be placed
on flashing red from 12 midnight to 6 a.m., with the intersections
of Lower Azusa and Arden, and Freer and Santa Anita, to be flashing
yellow for major street and flashing red for minor street.
Councilman Tyrell moved to approve the recommendation of the Traffic
Commission for beginning hour of full operation for certain signals
to be at 7 aomo instead of 6 a.m., as set forth in memorandum dated
August 4, 1972, with the exception of Las Tunas Drive and Oak Ave.,
which should commence at 6:30 a.m., and to request the Traffic
Commission to study those traffic signals presently on full operation
to be placed on flashing operation from midnight to 6 a.m. The
motion was seconded by Councilman Gilbertson ,and . unanimously - carried.
10-> RECOMMENDATION FROM PARKS & RECREATION COMMISSION - Meeting of
August 2 and August 16, 19720
STANDARDS FOR USE OF PARK: The recommendation from the Parks and
Recreation Commission concerning standards for use of Park was
received by the Council and referred to study session.
NEW BUSINESS:
11, AGREEMENT FOR COMMUNITY RECREATION PROGRAM WITH COUNTY OF LOS
ANGELES (unincorporated Territory - Emperor School);:
City Manager Koski advised that the agreement submitted by the
County for the City of Temple City to conduct community recreation
program at Emperor School carried an amount of $2,375 to be paid
by the County of Los Angeles to the City upon demand, which amount
reflects an increase of $181 over the 1971 -72 program. He advised
that the Director of Recreation had reviewed the proposed agreement
and feels that an adequate program can be offered, and that the
program at Emperor School is part of the agreement previously
entered into with the school district, to provide a program .within
the district. Councilman Tyrell moved to approve and to authorize
the Mayor and City Clerk to sign, seconded by Councilman Gilbertson
and unanimously carried,
12. RESOLUTION No. 72 -12268 Setting Zero Tax Rate for City of Temple
City for Fiscal Year 1972 -73.
City Manager Koski presented Resolution No. 72-1226B entitled
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
INDICATING NO CITY TAX RATE"' FOR' THE FISCAL YEAR 1972 -73, Council-
man Tyrell moved to adopt, seconded by Councilman Gilbertson and
unanimous] y carried
13. RESOLUTION No. 72 -1227: re. Levying a Special Assessment Tax
Within the Temple City Municipal Lighting District for Fiscal
Year 1972 -73,
City Manager Koski presented Resolution Noe 72 -1227 entitled
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
LEVYING A SPECIAL ASSESSMENT TAX WITHIN THE TEMPLE CITY MUNICIPAL
LIGHTING DISTRICT FOR THE FISCAL YEAR 1972 -73, which resolution
provided for no increase in this special assessment tax over
the previous year. Councilman Tyrell moved to adopt, seconded
by Councilman Merritt and unanimously carried.

14. RESOLUTION No. 72 -1228: Re. Request for Allocation of County Aid -
to- Cities Funds for Maintenance of Select System Streets,
City Manager Koski advised that the County of Los Angeles has
appropriated funds for maintenance of the City's approved select
system streets in the amount of $41,186. Councilman Merritt
moved to adopt Resolution No. 72 -1228 entitled A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF TEMPLE CITY REQUESTING AN ALLOCATION
AND PAYMENT OF COUNTY AID -TO- CITIES FUNDS FOR THE MAINTENANCE OF
SELECT SYSTEM STREETS. The motion was seconded by Councilman
Tyrell and unanimously carried.
15. .RESOLUTION No. 72-1229: Employment of Temporary Personnel
(Recreation)
Councilman Gilbertson moved to adopt Resolution No 72 -1229
entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY APPOINTING TEMPORARY PERSONNEL, seconded by Councilman Tyrell
and unanimously carried.
16. RESOLUTION No. 72 -1230: WARRANTS & DEMANDS, Demand Nos. 6402
thru 6498, in the amount of $22,358,95.
Councilman Gilbertson moved to adopt Resolution No. 72 -1230
entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $22,358.95,
DEMAND NOS. 6402 THRU 6498, seconded by Councilman Tyrell and
unanimously carried.
17. COMMUNICATIONS:
A. Temple City Host Lions - Request to Place Banner Across
Las Tunas Drive and Temple City Boulevard, Oct. 2 -8, 1972.
Councilman Merritt moved to approve the request of Temple City
Host Lions to place banner across Las Tunas Drive and Temple City
Boulevard, October 2 -8, 1972, in connection with Lions Club
WHITE CANE DAYS, subject to required insurance and prompt removal
of banner, seconded by Councilman Tyrell and unanimously carried.
B. Petition for Additional Tennis Courts - Live Oak Park
Council received a petition signed by Mrs. Marva Packey,
10628 Roseglen Street, Temple City, and 50 others, requesting
additional tennis courts to be provided at Live Oak Park. The
matter was referred to the Parks and Recreation Commission for
consideration in the development of the Live Oak Park complex.
C. PLANNING COMMISSION. RECOMMENDATION - Meeting of August 22, 1972.
Re. Conditional Use Permit for Service Station, northwest
corner of Oak and Las Tunas (Standard Oil)
-City Manager Koski presented the communication from the Planning
Commission advising of the Commission's action in granting
Conditional Use Permit No. 72 -375PC to establish and operate a
new automobile service station (Standard Oil) at the northwest
corner of Las Tunas Drive and Oak Avenue, subject to certain con-
ditions, He advised that the Commission found that the applicant
had met the standards, therefore granted the Conditional Use Permit,
however that because of location and proximity of the subject
property to the core area of the downtown business district, it
maybe desirable to have reverse bay areas, and that the Council
may wish to appeal_ the decision of the Planning Commission.
Ray Youmans, 9532 E. Live Oak, owner of the present Standard Station
in the next block whose station was to be vacated to undertake the
new operation, spoke to the Council in favor of the proposed
structure and answered inquiries of the Council. Following dis-
cussion, Councilman Tyrell moved to appeal the decision of the
Planning Commission, based primarily on the esthetics of the pro-
posed structure, seconded by Councilman Merritt. A roll call vote
on the motion carried, Councilman Dennis voting "no."

18. TIME FOR THOSE IN AUDIENCE WHO WISH TO SPEAK:
A. Mrs. Penny Graham, Graham's Music Store, discussed activities
and plans of the Chamber of Commerce.
B. Mrs. H.aze_l_.W_hippe rman.._,_and Miss. De.bb.i _..P.r u ne r i , Lower Azusa
Road, spoke in behalf of the proposed signal on Lower Azusa
Road at the Midway Shopping Center complex, to be placed at
Doreen Avenue.
1.9. MATTERS FROM CITY OFFICIALS:
A. City Manager Koski advised that funeral services for Virginia
Harker, wife of former Councilman Harker, would be held on
Friday, August 25, 1972, at 11 :30 a.m. at Rose Hills.
B. Parks & Recreation Administrative Institute - Nov. 5 -10, 1972
Councilman Tyrell moved to approve the request of the Director
of Parks and Recreation to attend Parks and Recreation Admin-
istrative Institute to be held in Asi1omar, Nov. 5 -10, 1972,
with tuition and transportation expenses paid, seconded by
Councilman Gilbertson and unanimously carried.
C. Amended Master Street Tree Plan - Bogue Street, from Baldwin
Avenue to Live Oak Park.
City Manager Koski presented a communication dated August 17,
1972, from the Maintenance Superintendent, outlin•ing:a-
proposed amendment to master street plan for Bogue Street,
since .space available for street trees had been reduced upon
the installation of sidewalks. Councilman Gilbertson moved
to concur in the amended plan, seconded by Councilman Tyrell
and unanimously carried.
D. League of California Cities Annual Conference - Oct. 15 -18,
1972 - Anaheim, California.
City Manager Koski advised that registrations for the League
of California Cities Annual Conference to be held in Anaheim
from October 15 - 18, 1972, were now due, and requested
authorization for official representatives, Councilmen,
Commissioners and staff, to attend, as set forth in the budget.
Councilman Gilbertson moved to approve, seconded by Councilman
Tyrell and unanimously carried.
E. Councilman Merritt noted that root damage had occurred from
a street tree located the first house south of Live Oak,
east side of Baldwin.
F. Councilman Gilbertson called attention to new Senate Bill 37
(Marks) which was another effort toward regionalism, and
advised that he would attend a meeting to be held in Long
Beach on September 15, 1972, the day following the SCAG
Conference.
G. Councilman Gilbertson advised that he would be unable to
attend an Urban Problems Committee Meeting to be held
September 7, 1972, when a recommendation that a regional
entity to solve problems would be made, but that he plans
to file a written report.
H. Councilman Gilbertson advised that he had received three
complaints recently regarding dogs running loose, and
suggested additional patrol for the morning hours. Mayor
Briggs set the matter for a study session.

J. Councilman Merritt requested that the matter of moving
vacant buildings into the City be studied and standards
set so that old and unsightly buildings could not be
moved in. Mayor Briggs referred the matter to the Planning
Commission.
K. Lower Azusa Road - Traffic Signal.
City Manager Koski presented a report from the Traffic
Engineer setting forth criteria by which a decision may be
made for determining the best location of a traffic signal
on Lower Azusa Road in the vicinity of the Midway Shopping
Center. He advised that the standards indicate the signal
should be placed at Halifax in order to have two controlled
intersections; that if the signal is placed at this location
it will also assist at Pal Mal and Doreen, while if it were
placed at Doreen there would be no protection for the other
locations and that the shopping center should be revamped
for ingress and egress. He noted that the owner of the
shopping center was willing to contribute one - fourth of the
cost for a signal, and that the City of El Monte had also
agreed to share in one - fourth of the cost.
Councilman Tyrell.moved -to approve the installation of a
traffic signal on Lower Azusa Road at Halifax, and to author-
ize the preparati:on.:of'plans and specifications and advertising
for and receiving of bids, seconded by Councilman Dennis and
unanimously carried.
70. ADJOURNMENT:
Councilman Gilbertson moved to adjourn at 9:55 p.m., seconded by
Councilman Dennis and unanimously carried. Next regular meeting
of the City Council to be held on Tuesday, September 5, 1972,
at 7:30 p.m. in the Council Chambers of the City Hall.
