Presents the following Ordinance Seconded by Councilman
AN ORDINANCE AMENDING AND SUPPLEMENTING THE
CODE OF THE BOROUGH OF CARTERET CREATING A NEW
CHAPTER ENTITLED PERMITTED PETS
WHEREAS, research has demonstrated that our elderly population live longer and
happier lives when they have opportunity to reside with a loving pet as a
companion; and
WHEREAS, the Mayor and Council of the Borough of Carteret are deeply
concerned about the health, safety and welfare of the Borough's elderly residents;
and
WHEREAS, as such, the Mayor and Council wish to promote the health, safety
and welfare of the Borough's elderly population by advancing the opportunity for
these residents to own and keep pets in their homes and lives; and
WHEREAS, the Governing Body has determined that it is in the public interest to
adopt certain regulations to further this public interest; and
WHEREAS, pursuant to N.J.S.A. 40:48-1 the power to adopt ordinances for the
public health, safety and welfare of the Borough and Its residents Is coterminous
with the police power of the Legislature.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the
Borough of Carteret (the "Borough") that the Code of the Borough of Carteret is
hereby amended and supplemented to create a new chapter entitled "PERMITTED
PETS" to include the following:
Section 1.
Permitted pets.
A. It shall be unlawful for any landlord making available for
rent within the Borough a single family dwelling unit or space for
the same, not otherwise a part of a multi-family building, to
preclude the tenant(s) of said unit, at least one of which is 55 years
of age or older, trom owning and keeping one spayed or neutered
cat or dog in the rental premises. If the qualifying tenant chooses to
own a dog, the dog can not weigh more than 25 pOlinds.
B. The qualifying tenant shall comply with all other
applicable ordinances of the Borough with regard to the ownership
and maintenance of his/ her cat or dog.
C. Any violation of this chapter shall be punishable as
provided for in Section 1-17 of the code.

All ordinances or parts thereof inconsistent with the provision of
this ordinance are hereby repealed limited to the extent of any
such inconsistency.
If any section, paragraph, sub-division, clause or provision of this
ordinance is adjudged invalid, such adjudication shall apply only
to the section, paragraph, sub-division, clause or provision so
adjudged and the remainder ofthis ordinance shall be deemed
valid and effective.
It is the intention of the Mayor and Council of the Borough of
Carteret, and it is hereby ordained that the provisions of this
ordinance shall become and be made a part of the Code of the
Borough of Carteret. The sections of this ordinance may be
renumbered or relettered to accomplish such intention, and the
word "ordinance" may be changed to "section," "article,"
"chapter," or other appropriate words.
This ordinance shall take effect thirty (30) days following its
passage and publication as according to applicable law.
