HomeMy Public PortalAboutAB 04-98 attch - City Prosecutor RFQCITY OF MCCALL, IDAHO REQUEST FOR PROPOSAL FOR CITY PROSECUTOR SERVICES General Information: The City of McCall is requesting proposals (RFP) from law firms or individual lawyers interested in serving as City Prosecutor on a contractual basis. The Prosecutor will represent the City in the prosecution of all misdemeanor criminal violations covered by the McCall Municipal Code and/or Idaho Code. Proposals are requested for the period beginning June 11, 2004 and ending July 12, 2004 at 3:00 p.m. The City presently contracts with outside counsel for prosecution services. The City anticipates entering into a one or two year contract for prosecution services upon completion of the RFP process. Background: The City of McCall is located 100 miles north of Boise. Incorporated in 1913, McCall has grown to an, area of 8.5 square miles, with a population, of over 3000. The McCall Police Department has ten (10) commissioned police officers, and two (2) administrative staff. The following table shows the total number of criminal cases filed in the Valley County Court: Services Requested/Qualifications: The City Prosecutor shall serve, under the title of City Prosecutor, as criminal prosecutor for the City and will represent the City in the following matters and provide the following services: Legal representation on all criminal matters including, but not limited to preparing for and appearing in court at arraignments, pretrial hearings and motion hearings, assisting McCall Police Officers with search warrants, responding to crime scenes when necessary, and prosecuting jury trials and appeals to the District Court. Legal research and legal consultations with the City of McCall Police Department; specifically, the City Prosecutor shall provide legal training to the McCall Police Officers at a mutually agreeable time and place, but in no event less than once every 2 months. Review all public records requests and consult with the Police Department in preparing the appropriate response (under the Idaho Public records Act) to the requestor of the record. All Responders must designate an attorney who will be accountable for contract performance. Respondents must identify one attorney as the City Prosecutor. This lawyer must appear at the Valley County Court/McCall Court Annex on an ongoing basis. The City Prosecutor must have prior work experience in criminal law. Prior experience as a prosecutor is strongly preferred. The contractor must provide continuity of representation while at the same time ensuring effective back-up coverage. Any lawyer who may be called on as a back-up attorney must have current awareness of the City of McCall ordinances, police policies/procedures, and court rules so that he/she is fully prepared to provide prosecution Services in the event of an unanticipated absence. The Contractor must ensure the availability of attorneys and support staff is consistent with efficient delivery of prosecution services, including coverage for regular vacations. The contractor needs to be able to involve more than one attorney in the delivery of prosecution services if efficient case management so requires. The Prosecutor must be responsive to the Police Department, defense attorneys and witnesses. For example, the City expects phone calls to the Prosecutor to be returned in a timely manner. The City anticipates that a caller would get a response from someone who is familiar with prosecution issues by the end of the next business day for non-urgent matters and immediately on urgent matters. Prosecution Philosophy: A key factor in selection of the contractor will be how well the Respondent fits with certain overall City objectives. The City of McCall is committed to a philosophy of Community Oriented Policing with a focus on family issues and domestic violence. In addition, the City of McCall is emphasizing youth issues, drug interdiction, underage and over-serving alcohol and traffic safety. Contractor must be prepared to work cooperatively with other members of the City team in support of these objectives. The City of McCall expects the Prosecutor to be a strong advocate in responding to domestic violence. The Prosecutor's filing decisions and agreed dispositions of cases need to be consistent with community concerns about patterns of domestic violence. The City will continue to have the services of a Domestic Violence Advocate. The Prosecutor is to have regular contact with the Domestic Violence Advocate, particularly for discussion of upcoming cases. Compensation: The City presently pays a flat rate per month for prosecution services. Respondents may propose a flat rate for prosecution services, an hourly rate for services, or a combination of the two. For example, it may be desirable to have a flat rate for basic services plus an hourly rate for special projects. Requirements of the Proposal: Please include the following in presenting your proposal Experience: Summarize experience relevant to prosecution services. Identify the attorney who would be the City prosecutor, and the attorney designated for contact on administrative matters, if different. Include resumes of all attorneys who will provide prosecution services. Method of Service Provision: Describe method of service delivery, philosophy, and approach, and what makes you unique with respect to providing prosecution services. Proposed Fee Structure: Identify your proposal regarding compensation. Also describe what expenses would be charged to the City. Identify whether you would charge for travel time or mileage to the McCall City Hall, Valley County Court House, or the McCall Court House Annex. Statement of Contract Compliance: Discuss how you plan to provide malpractice insurance coverage. References: Identify three (3) references who can attest to your experience and capabilities as they relate to services requested. The references must include contact name, address, and telephone number. Proposal Modification and Clarifications: The City will not reimburse the Respondents for the RFP or for any costs associated in the preparation and submission of proposals or for attendance at subsequent interviews. Furthermore, this RFP does not obligate the City to accept or contract for any express or implied services. The City reserves the right to negotiate regarding the terms and compensation for any proposal. The City reserves the right to request any Respondent to clarify their response or to supply any additional material deemed necessary to assist in the evaluation, and to modify or alter any or all of the requirements herein. Selection Process: The City of McCall staff will select a short list of candidates for interview by the City Council during late July or early August. Selection of a finalist will be based on the Council’s judgment as to the best match between the City's needs and the background and proposal of the Respondent. Time and Place for Submittal of Proposals: Three copies of each proposal must be submitted by no later than 3:00 p.m. on July 12, 2004 to the City of McCall City Clerk located at 216 East Park, McCall, Idaho 83638. Proposals received after 3:00 p.m. on July 12, 2004 will not be considered.
