Be cautious of opening attachments and clicking on links.  Hate crimes rise to highest level in 12 years amid increasing attacks on Blacks, Asians, FBI says By David Nakamura Today  at 12:56 p.m. EDT The number of hate crimes in the United States rose in 2020 to the highest level in 12 years, propelled  by increasing assaults targeting Black and Asian victims, the FBI reported Monday. In all, the federal agency tallied 7,759  hate crimes last year, a tumultuous 12 months marked by a global pandemic, a divisive presidential election and  upheaval in the economy. The total marked an increase of six percent from 2019 and the most since 2008, when 7,783  hate crimes were reported. It is the sixth time in the past seven years that the number of attacks rose. The number of  hate crimes reported has increased by nearly 42 percent since 2014, according to federal data. Attacks targeting Blacks  rose from 1,930 to 2,755, and the number targeting Asians jumped from 158 to 274, the data showed. Those figures  come as civil rights groups have warned of increasing hostility toward minorities, amid a rise in white nationalism and an  increase in violent crime levels nationwide. Attacks targeting Whites rose to 773, an increase of about 16 percent.  Congress mandates that the FBI collect hate‐crime data annually based on reports from local law enforcement agencies.  In 2020, the number of agencies that participated in that effort fell for at least the second consecutive year — to 15,136,  which is 422 fewer than in 2019. Of those agencies that did participate, the vast majority reported no hate crimes.  Congressional Democrats and civil rights advocates have criticized what they describe as a large undercount in the  number of hate crimes and other bias incidents, saying local police are poorly trained in how to identify and catalogue  hate crimes and lack sufficient resources or interest in investigating them. Stop AAPI Hate, a grass‐roots groups based in  California, reported 6,603 hate incidents against Asians from March 2020 — the start of the coronavirus pandemic in the  United States — through March of this year. Of that data, which was collected through self‐reporting portals online and  was not thoroughly vetted, about 65 percent consisted of verbal harassment, such as name calling, and 12.6 percent  involved physical assault. In May, Congress approved the Covid‐19 Hate Crimes Act, which requires the Justice  Department to appoint an official to expedite investigations into hate crimes reported to federal authorities. The bill also  seeks to improve reporting of hate crimes among localities by bolstering online reporting channels and offering  resources in more languages to help immigrants. This is a developing story. It will be updated.  2 Kang, Danielle From:Sabine Won <sabinedwon@yahoo.com> Sent:Monday, August 30, 2021 11:02 AM To:Council, City Subject:YES on Safe Storage Ordinance Follow Up Flag:Follow up Flag Status:Completed CAUTION: This email originated from outside of the organization. Thank you! ************ Dear City Council members, As a mother of three children, educator and member of Moms Demand Action, I urge you to pass the Safe Storage Ordinance which would require any firearm in a home to be securely stored in a locked container or disabled with a trigger lock. As an educator working in the public school system, I am witness to the fear of another school shooting happening at any time. We must avoid the tragic consequences of unsecured firearms falling into the wrong hands. Nearly every day in this country, a child unintentionally kills themself or someone else after finding an unsecured firearm in their home. Every day on average, two teens commit suicide using an unsecured gun. Firearms are also easily stolen in home robberies where they eventually become weapons for criminals. Finally, 80% of school shootings are done by a student or former student using an unsecured gun obtained from their home or a relative’s home. The facts are clear: less access to guns means less gun violence! Most cities in San Mateo County have already passed safe storage ordinances. Please vote YES on this commonsense gun legislation. Be cautious of opening attachments and clicking on links.  I support requiring households with children to require safe gun storage and imposing a financial penalty for failing to do so. However, locking up parents, or adults without kids in jail for violating this seems unreasonable as the city is proposing. Should a household without kids really receive jail time for leaving a firearm unattended to answer the door (e.g. if the police knock on it), answering the phone or take boiling water off the stove as you are currently considering? You would instead require the person to answer the door with a gun on them if the police knock or induce a long delay while they went and locked in up. In addition, the highly restrictive language Palo Also uses criminalizes safe firearm usage. Palo Alto uses the highly restrictive language that a firearm must be "on your person" when not locked up, unlike the Santa Clara County ordinance “Close proximity and control”. This overly restrictive language leads to unsafe behavior by gun owners and possibly even liability for the city. For example, the following are not allowed under this ordinance.  Putting the gun on the floor of your home at the request of a police officer  Cleaning a firearm  Putting the gun down next to you to go to the bathroom or change your pants  Putting a gun down next to you when taking it out of a safe I request the council pull this item from consent so the language can be improved to promote safe gun handling, not require a gun be carried by a resident in the presence of an officer and to not create liability for the city. The election is live now, and you should have received your ballot in the mail already as all California voters are receiving a mail-in ballot. Remember to vote by September 14. Few elections will be held that will have as much impact as this one on California’s future. If there was ever a time for us to get out the vote, it’s now. Our Voter Services Team, led by Kathy Miller and Liz Jensen, is getting out the message with flyers and personal chats with voters, and you can help too by spreading the information to all your friends and relatives who vote. In particular let’s not forget the 18-year-olds who start voting this year as well. GI 9   Remember, the League is neutral on candidates, but we can advocate to vote with great enthusiasm. The League was present at the August 9th City Council meeting advocating for the city to investigate whether a Supportive Interim Housing program for the unhoused, proposed by LifeMoves and similar to the one in Mountain View, should be approved in Palo Alto. Our thanks to Lisa Ratner who spoke on behalf of the League, and League’s Housing and Transportation Committee, who composed the letters from the board on August 5th and August 6th advocating to the City Council on League’s position on homelessness. We are also pleased to announce the work from our Responsible Gun Ownership Committee, led by Hilary Glann and Stacey Ashlund, on successfully urging the Council to enact a safe storage of firearms ordinance, which requires Palo Alto gun owners to store firearms in a locked safe or with a trigger lock. The staff featured their advocacy work in the report to the Council. Additionally, their committee has identified funds to help gun owners purchase the right equipment if needed. In Palo Alto, the ability to run for City Council appears to be determined by access to wealth: the winners of the November 2020 Council race each spent over $100,000 on their campaigns, funded mostly by large donations over $500. Large donations can also create the appearance of undue influence. In neighboring Mountain View, with a greater population, council candidates spent no more than $27,500. Our Local Election Finance Task Force has been investigating what other cities have done to stop the arms race in campaign spending, such as individual donation limits coupled with voluntary expenditure caps, and increased disclosure of independent expenditures beyond what’s required by state law. The Task Force will continue to investigate and advocate the steps our city can take in election financing reform. Our Responsible Gun Ownership Committee achieved one of its major goals this month: successfully urging the Council to enact a safe storage of firearms ordinance, which requires a firearm in the home, when not carried by an authorized person, to be stored either in a locked safe or with a trigger lock. Suicide and accidental death rates (especially of children and teenagers) have dropped where these common-sense reforms have been enacted. Our Housing and Transportation Committee composed two letters from the board to the City Council urging the adoption of the Community Plan to End Homelessness for Santa Clara County and supporting the investigation of LifeMove’s proposal to build modular Supportive Interim Housing in Palo Alto. Palo Alto’s most recent point-in-time homeless count was over 300 individuals, so it is critical that action be taken on behalf of our unhoused residents. National LWVUS board president Dr. Deborah Ann Turner delivered remarks at the White House, demanding the Biden administration take swift action to ensure passage of voting rights legislation. Redistricting is the process where voting district lines are redrawn within a state, typically once a decade following the Census. The California Citizens Redistricting Commission, made up of 14 California citizens, draws the new lines. Specifically, this bill incorporates additional measures used to establish a peace officer’s “Duty to Intercede,” and provides certain outcomes for failure to intercede. In Palo Alto we have implemented this into our Police Policy manual, and we support the formalization of these type of measures. This bill specifies that a peace officer’s “Duty to Intercede” shall include, but is not limited to, physically stopping the excessive use of force, recording the excessive force, and reporting the incident in real time to dispatch or the watch commander on duty in order to establish that the officer has attempted to intercede. The bill prohibits an officer from training other officers for a three-year period if an abuse of force complaint is substantiated. Finally, AB 26 prohibits retaliation against an officer that reports a suspected violation of a law or regulation of another officer to a supervisor or other person of the law enforcement agency who has the authority to investigate the violation. The records of this assault may only become public if a law enforcement agency investigates and reaches a “sustained finding.” However, if an officer is fired or resigns before an investigation can begin or is completed a “sustained finding” is not reached. In 2019, Palo Alto reduced GHG emissions an estimated 38.2 percent from the 1990 baseline, despite a population increase of 23.6 percent during that same time period. Palo Alto continues to seek opportunities to increase police transparency and accountability. This bill aligns with the City’s efforts related to race and equity and social justice. In 2018, SB 1421 gave Californians, for the first time in 40 years, access to a limited set of records related to an officer’s use of force, sexual misconduct, or on-the-job dishonesty. However, under current law, Californians have no right to know about officers who use excessive, but non-deadly, force or have a history of engaging in biased actions. Enhanced public access to officer conduct information is essential to build trust between law enforcement and the communities they serve. While SB 1421 was an important breakthrough, it was just a first step. As the nation and the world saw last year in the horrific murder of George Floyd, tracking previous uses of force is critical to ensuring that officers like Derek Chauvin are held accountable for repeated excessive force. One way of doing that is to have the records of past use of force complaints available to the public even if the complaints are not classified as “causing great bodily injury” or “deadly.” SB 16 remedies this by opening access to additional records, bringing California much closer to states like New York, Florida, Georgia, Kentucky, Ohio, and Washington. Opening access to additional categories of officer conduct provides communities with the tools to identify officers with a history of misconduct and hold local police agencies accountable. Without that opportunity, seniors are missing opportunities to access social and health benefits and services. Transition age youth are a vulnerable population in our state. There are over 60,000 youth in the foster care system that are waiting to find a family and a home. Each year around 3,500 transition-age youth exit foster care without having found a permanent home, causing emotional and cognitive dysfunction due to the lack of housing, food, and safety. Unfortunately, foster youth are the fastest growing homeless population in California, which puts them at risk of poverty and incarceration. While wipes are often marketed as flushable, they are usually composed of synthetic, plastic materials that are not compatible with the sewer systems and infrastructure. When wipes travel through the sewer system they do not break down. Instead, they accumulate with fats, oils and grease and become large obstructions in pipes that ultimately clog pumps, collection systems, and burn out motors. This causes sewer backups and treatment equipment failures. If the wipes manage to make it to the treatment facilities, the products are broken down into smaller microfibers and microplastics that are inadvertently released back into the environment, which in our region is the San Francisco Bay. Your legislation would address this problem using a straightforward and reasonable approach, by establishing “Do Not Flush” labeling requirements for non-flushable wet wipes product packaging. This labeling requirement would discourage the erroneous assumption that flushing wipes down toilets is an acceptable disposal method. Would this law force those who own a gun into purchasing a lock or a safe if they  don’t already? Or would such a lock be provided by the city upon request?  Please see California Penal Code Section 23635, requiring all firearms sold or  transferred in California to be accompanied by a firearm safety device listed on the  California Department of Justice’s roster of approved firearm safety devices. A  safety device would not be provided by the City.  2. You wrote in your report that, “The United States Bureau of Alcohol, Tobacco,  Firearms, and Explosives (ATF) estimates that about 10‐15% of stolen guns are  used in subsequent crimes” (42) But the article cited says, “There are a number of  sources that allow guns to fall into the wrong hands, with gun thefts at the  bottom of the list” With this relative lack of importance, why is gun theft the  element being addressed?  The State of California regulates other sources that cause firearms to fall into the  wrong hands by regulating the licensing, sale, and transfer of firearms. This     O Cound1 Question Response 78 Ordinance allows the City of Palo Alto to do its part by preventing firearms kept in  Palo Alto homes from being misappropriated.  3. The poster included threats of retribution directed at anyone supporting BLM. While religious leaders are not all of the same mind on how to approach issues of racial injustice, we are all deeply angered and saddened by these events and stand in solidarity with our Black siblings in Palo Alto. Many of us are strong supporters of Black Lives Matter. Unfortunately, this attack was not an isolated incident, but one of a series of recent hate crimes, building on a long-standing pattern of racial hate and exclusion directed at people of color in Palo Alto. We unequivocally condemn all acts of emotional, institutional, or physical violence directed at any member of the African American or Asian American communities in Palo Alto. We reject false narratives about the dangers of BLM and all attempts to pit people of color against one another in our ongoing commitment to antiracism. Earlier in April, the Israeli Peoples Committee (IPC), a civilian body made of leading Israeli health experts, published its report into the Pfizer vaccine’s side effects indicating damage to almost every system in the human body. That was what the people in Guangdong Province called the faraway land where the native population had red hair and blue eyes, and it was rumored that gold nuggets could be plucked from the ground. According to an account in the San Francisco Chronicle, a merchant visiting from Canton, the provincial capital—likely soon after the discovery of gold at Sutter Creek, in 1848— wrote to a friend back home about the riches that he had found in the mountains of California. The friend told others and set off across the Pacific Ocean himself. Whether from the merchant’s letter, or from ships arriving in Hong Kong, news of California’s gold rush swept through southern China. Men began scraping together funds, often using their family’s land as collateral for loans, and crowding aboard vessels that took as long as three months to reach America. They eventually arrived in the thousands. Some came in search of gold; others were attracted by the lucrative wages that they could earn working for the railroad companies laying down tracks to join the Eastern and Western halves of the United States; still others worked in factories making cigars, slippers, and woollens, or found other opportunities in the American West. Be cautious of opening attachments and clicking on links.  Dear Palo Alto City Council,     Two summers ago, when I visited Europe, I was struck by how pleasant the downtowns were. In Paris, cafes had seating  out on the sidewalk where people would sit and comfortably drink their coffee. In Zurich, the downtown areas were  closed to all vehicles except for trams and small delivery vans, letting people comfortably walk around. In Venice,  restaurants had tables under tents and umbrellas to enjoy the warm day with a cold drink.    For all of the convenience of cars to get around longer distances, pedestrian streets in downtown areas make cities  more livable. Between the pleasant outdoor dining and the better experience of being on University and Cal Aves  without cars, it seems to me that Palo Alto's experiment with pedestrian streets has been a huge success.  I think that  it's time to make the changes permanent, bringing our city closer to the ideal place to live.    It's always been a frustrating reality that University is one of the only streets that crosses from El Camino to 101, but  even before the pandemic it was a slow and frustrating way to cross. To be forced to take Lytton between Middlefield  and Alma seems to speed up the drive compared to stopping at the lights on University. And Cal Ave was already not a  through street; having to park around it and walk in changes the convenience not at all.    Palo Alto City Council, please permanently transform University Ave and California Ave into pedestrian streets.    Sincerely,  Ben Garber  126 Kang, Danielle From:Christian Riblet <c_riblet@yahoo.com> Sent:Tuesday, August 24, 2021 8:09 PM To:Council, City Subject:Let's keep our car(e)free space! I was driven to speak out about this in light of the racial hate incident at Fuki Sushi. I believe that the harassment that targeted councilmember Lydia Kou was also racially motivated and appalled at the light sentence her harasser received. Over countless incidences throughout the country, it is obvious that perpetrators of these types of crimes pick on the those perceived to be vulnerable and less willing to speak up. Thank you Lydia and Lumi for speaking up. For such a progressive and diverse city as Palo Alto, I am surprised and disappointed that these perpetrators are held accountable for their actions. Even now I see that some members of the community still make excuses and say, "he must have had a really bad day". We know from Atlanta shootings, that is not an acceptable excuse. This should never be tolerated... Not here, not anywhere. I hope you will take the advice of Mary Sylvester and implement anti-hate training of your officers, reach out to other cities to see how they deal with these hate crimes and set up reporting sites, investigate each hate incident thoroughly and sentence the perpetrators to the fullest extent. They should NOT be allowed to hide behind the cloak of the First Amendment. They are a clear and present danger to us all and the community needs to know who they are. Kimberley Wong Dear Mayor, Vice Mayor and City Council Members A man at Hanahaus a few years ago asked me “Why do you think anyone here would be interested in this Chinese artwork”? as I put up posters of my teacher’s exhibitionat the Pacific Art League downtown. Why don’t you go back to your country to show it? This very brief encounter left me shaken. Then it made me angry to be seen as a foreigner when my family’s roots date back to 1900 when my grandfather first came to Palo Alto. He was a co-owner of the first licensed Chinese owned restaurant on University and 3 generations of my family went through K-12 in Palo Alto schools. What gives one race the right to claim another race DOES NOT BELONG HERE? This memory came back to me as I read about racial-hate tirade that happened a few weeks ago where the ranting man told the owner to “Go back to your country”! I was shaken at my encounter, and I could see how distraught Lumi Gardner of Fuki Sushi was at Sunday’s rally at being screamed at and threatened with a call afterwards. It took her quite some time to regain her composure before speaking to us. And for me to read in the paper that no charges were filed because this hate speech is “protected by the first amendment” totally incensed me! This was verbal harassment and deliberate intimidation of a longstanding and respected member of our community. Palo Alto for the most part is a racially diverse and welcoming community. Those with the power to do so should do everything they can to protect their citizens from unwarranted, disparaging and discriminatory attacks. So I am asking to what the City Council can do to STOP any type of racial assault regardless of whether it is verbal or physical. My grandfather was thrown into Lake Lagunita which caused him to developed asthma later, just because he was Chinese. Covenants in deeds against non-Whites to purchase some homes in certain part of Palo Alto also created a racially divided community. Many believe that is past history as my family and I have many non-Asian friends in the community. Sad to say, though, that racial bias still exists to this day. I understand that the City Council adopted a resolution denouncing Anti-Asian Racism back in March, 2020 but I am wondering what can it do to stop these racially motivated attacks from happening? dAnd what more can be done? Although Palo Alto has been shielded from the brutal physical racial attacks and killing of Asians that are happening across the country, the recent incident of this racist ranter in Fuki sushi reminds us that racism still exists here in Palo Alto. I am especially disheartened when I learned from the paper that after the police was able to identify this racist ranter, they determined that no charge will be filed because hate speech is protected under the First Amendment and that even the identity of the racist ranter will not be disclosed to the public. I am frustrated and disappointed by this. The message is being conveyed to our community is that there is no consequence to these racists’ actions. This could be one of the reasons to fuel the drama increase of Anti Asian attacks across our country. In July, Illinois became the first state to require a unit of Asian American history. Oregon requires ethnic studies for students K-12. Other states lag behind. GI 147 Some states have even gone in the opposite direction. They have restricted teachings on race and other topics, with the claim of preventing discomfort in classrooms. According to Edweek, 26 states have introduced bills restricting the teaching of critical race theory, and 12 have enacted these bans. “Those fearful of critical race theory have difficulty articulating what it is and have mistakenly cast it as a hateful, divisive ideology when it is just the opposite,” said Umemoto. “In order to dismantle racism, we need to understand how race was constructed to begin with. Critical race theory helps us to do this and to become more aware of the ways in which racism and racial bias has become embedded in our thinking and our institutions so we can undo that and create a more just and equitable society.” Asian American history is filled with violence, imperialism, xenophobia, and discrimination. Although the truth may be uncomfortable and it may be ugly, it is still the truth, Kwoh maintains. “Its important to tell the truth. Because if you don’t tell the truth, then when people find out about what really happened, there’s more disillusionment with the system that didn’t tell them the truth.” WHY NOW? All three people we interviewed agree the importance of teaching AAPI history in schools is unquantifiable. Asian Americans have long contributed to the cultural, technological, and political advancements in American history. Nothing is more American than a beautifully diverse, innovative, and resilient group of people. “Yet so much of Asian America is excluded and even erased from American history. Asian American history is American history – full stop. Our stories need to be told, our history needs to be learned, and our contributions need to be celebrated,” said Nguyen. Umemoto believes the erasure of Asian American contributions to American society is now culminating in the violence and anti-Asian hate we continue to see. “Ignorance about who we are has been fatal, as we’ve seen with the rise in anti- Asian hatred and violence during the pandemic,” she said. “If we don’t even have a basic understanding of one another, how can we create an inclusive, democratic society where we can all belong and work together?” 148 “For American to better know the history of this country, they must know the history of Asian and Pacific Islanders in America,” Nguyen added. Kwoh sees a connection between the lack of Asian American history in our schools and the stereotypes that persist about the community. “When there is no history, there’s apt to be stereotypes. So when bad things happen, people believe bad stereotypes.” “The stereotyping that Asians often confront are the perpetual foreigner: we’re always the foreigners, so we’re not real Americans and we can be treated in different ways.” For example, Kwoh describes how although Japanese Americans were forced into internment camps, none were convicted of espionage, unlike some European Americans. “We were treated as the foreigner.” Similarly, “Vincent Chin was seen as the foreigner building cars and taking jobs away from people in Detroit.” “And then the model minority myth is another myth that is often thrown at us. Why teach Asian American ethnic studies? You guys are the model minority you don’t have a very big problem. Other groups have big problems. That’s a myth that slows down our ability to teach the truth.” HOPE Kwoh describes an inspiring story in Inglewood, a town neighboring Los Angeles. When meeting a Black school board member there, “the first thing she said to me was: do you know we have less than 1% of Asian students in our school system?” “But then she said because the anti-Asian violence, it doesn’t matter, I think we should bring your resources into the schools. Reckdahl, Keith; Larry Klein Subject:Comment on Item 6 / Charleston Grade Separation further study CAUTION: This email originated from outside of the organization. Be cautious of opening attachments and clicking on  links.  ________________________________    I will offer additional comments tonight but I did want to provide a few recommendations on the studies that staff has  asked the council to consider.    While more studies are clearly required, the city should be very thoughtful about the timing of each of the  recommendations.    1) Certain studies about existing site conditions should be done now.  While it may be traditional to wait to do detailed work regarding utilities, geotechnical issues and groundwater/creek  analysis, it is a known cause of cost overruns and delays because plans must be revised and revised again. In addition,  decisions  made on the basis of preliminary information may not be the same ones that would be made if all key  information had been available. At that point, sometimes it is too late to change course.    2) Studies regarding costs for construction methods are important but should be done in conjunction with Caltrain and  other cities who are looking at similar designs. For example, both Mountain View and Sunnyvale are currently planning  to do underpasses ‐ any new technologies that could speed up construction and limit impacts to Central Expressway/  Alma could be used by all three cities. The next step would be to coordinate discussions with Caltrain and the other  cities AFTER key work on the relevant geotechnical / storm drain/ groundwater work has been done. It may even make  sense for a delegation to go on a site visit to see the Long Island project, where many different undercrossings were  done as part of the same effort.    3) I would recommend that the city come up with a plan for refining bike / ped facilities that first tries to define city  requirements in terms of "needs", "wants" and "nice to haves" and then work with a consultant that specializes in bike  design. The current consultants are more focused on automobile facility design and this project is as much about finding  ways to integrate new bike facilities into the existing network, as well as thinking forward about future improvements.    4) I would advise against traffic studies for now.  First, the entire paradigm around designing for future traffic is changing  to one where you design the network for the traffic you want. In this case, we may be able to utilize in‐house staff and  limited consulting time to ask questions like how many cars could be handled by a one lane roundabout.    Second, there are real limitations around the predictions from the types of traffic models we use today. These are from  limitations in the computation, as well as the many things that are impossible to forecast. A better approach is to use  current forecasts and do a sensitivity analysis that looks at a number of different scenarios.  Relying on point estimates from a particular day to design an entire system is not a great idea anyway and it would be  better to adopt an approach that uses current traffic to construct reasonable scenarios.    Thank you for your consideration of my comments.    Regards,  Elizabeth Alexis  154 Kang, Danielle From:Michael Price <mikeprice.1285@gmail.com> Sent:Monday, August 23, 2021 5:56 PM To:Council, City Subject:Regarding the City Council meeting of 8/23/2021 CAUTION: This email originated from outside of the organization. Be cautious of opening attachments and clicking on  links.  ________________________________    Greetings,    I am glad to see that the Council will be considering whether to allocate funds to better understand the costs and  schedule impact of using a jacked‐box technique for constructing railway underpasses.    I suggest that a more expansive look at alternative construction techniques is also warranted. For example, it is possible  to construct a railway bridge in situ, without disrupting rail traffic more than a few days. One example can be found at:  http://artengineering.ca/GSS/    This technique might have many advantages over the construction methods currently being explored for the 3 crossings  in Palo Alto. It could eliminate the need for shoofly tracks and reduce construction time and cost.    I imagine that a more in‐depth search will find other alternatives worry of investigation. Perhaps this can be helped  along with resources from the community, which have been previously volunteered.    I urge the Council to gather as much information as possible to inform its decisions about the crossings. Those who will  live with the results for the next 100 years deserve that.    Sincerely,  Michael Price  Southgate    155 Kang, Danielle From:Cybele LoVuolo-Bhushan <cybele88lb@gmail.com> Sent:Monday, August 23, 2021 4:26 PM To:Council, City; HANSON This high-speed rail system noise assessment is in two parts: (a) a noise assessment procedure for the environmental impact anal- ysis of high-speed rail systems and (b) a discussion of the noise characteristics of high-speed trains, including conventional steel wheel and steel rail trains and magnetically levitated (maglev) trains. Aerodynamic noise dominates the wayside noise levels at speeds above 150 mph. The result is that maglev and conventional tracked trains can have similar noise levels at high speeds. A procedure for estimating noise impact corridors for high-speed rail is used in an example. The general environmental assessment procedure for new transportation projects and some of the noise information from high-speed rail systems that can be used for impact assessment purposes are described. The noise assessment pro- cedure for high-speed rail (HSR), or any other rail project, has not been specified by any agency. UMTA is currently developing noise and vibration impact procedures to be applied to urban transit projects. A similar approach is proposed to be applied to HSR. Included in this paper are data on noise generated by operation of high-speed trains; the surprising result is that noise from maglev systems seems to be the same as that from conventional rail systems at high speeds. PROJECT PHASE The noise analysis is done in stages as a major project devel- ops. At an early stage when alternatives are being analyzed, a more general treatment of the noise impacts is appropriate. Corridor screening can be used to identify potential problem areas and to contribute to a comparison of alternatives on an equal basis, with the use of simple screening distances and land use maps. Later, after alternatives have been defined, the noise analysis will focus on site-specific impacts. General assessment, the next refinement, is performed using the level of detail associated with preliminary engineering and the draft environmental impact statement (DEIS). At this intermediate stage, problem areas are identified before the final opera- tional details are known. Detailed calculations are needed in the final design and for the final environmental impact state- ment (FEIS), when complete operational details and site details are known. This paper provides general information that could be used directly in the first step, corridor screening, and as background information in the more detailed stages. After reviewing the available noise criteria established by the various agencies, UMT A is considering a combination of absolute criteria and relative criteria based on Ldn, the day-night sound level (1). Shown in Figure 1 are I proposed noise criteria for HSR based on the proposed UMT A criteria. The lower curve in Figure 1 represents the onset of noise impact. For conditions below this curve, noise impact is minimal and noise mitigation would not need to be considered. For conditions that fall in the area between the two curves in Figure 1, noise impact is identified. Under these conditions, mitigation would need to be inves- tigated, but not necessarily provided ( except for land use where serenity and quiet are of extraordinary significance or where mitigation costs are reasonable). Finally, the upper curve in Figure 1 represents the onset of severe noise impact. For conditions above this curve, noise mitigation would be necessary wherever it is feasible , according to the require- ments of the applicable environmental enforcement authority. HSR NOISE CHARACTERISTICS Noise from tracked vehicles comes from a variety of sources, including the propulsion system, the wheel-rail interaction, the aerodynamics, and the guideway. The propulsion system tends to dominate noise at low speeds, with elect.ric traction considerably quieter than diesel-or turbine-powered trains. Wheel-rail interaction becomes the dominant noise source for speeds higher than 50 mph for conventional electric trains, with an approximate noise versus (normalized) speed depend- ency according to the following relationship (2): Wheel-rail noi~e is proportional to 30 log speed. Until recently, aerodynamic noise sources have been asso- ciated with aircraft and ignored in ground transportation vehi- cles. Airflow over vehicles generates noise for all vehicles, however. Furthermore, with the advent of HSR, this source comes into the picture very strongly as speed increases because of the following relationship (J): Aerodynamic noise is pro- portional to 60 log speed. These relationships are shown in Figure 2 for typical trains. Both curves apply to conventional steel wheel and steel rail trains where wheel-rail sources dominate up to speeds of 150 mph, above which the aerodynamic noise becomes domi"nant. A magnetically levitated (maglev) train is subject to the same aerodynamic conditions as other trains, with the same noise generation characteristics. The interesting conclusion is that at high speed, the noise characteristics of either type could be the same, depending on the shape and aerodynamic smoothness of the train. Aerodynamic noise is related to the smoothness and shape of the train, as measured by the coefficient of drag. The noise is generated by rapidly fluctuating pressures in the turbulent air on or near the exterior surface. Contributions to the overall noise are made by turbulent boundary layer noise and flow separation noise. Some of the sources of aerodynamic noise are vortex shedding from wheel cut-outs and parts of the wheelset and truck frame that protrude into the airstream, the pantograph, and roughness elements on the surface, such as windshield wipers, lhal t:an lrigger boundary layer sepa- ration. Much of the basic research on the sources of aero- dynamically generated sound from trains was performed in Germany (3). HSR NOISE DATA Noise levels from representative HSR systems are shown in Figure 3. The data are plotted as measured at an international standard distance of 25 m, corresponding to 82 ft. The curves illustrate the combination of noise sources found in HSR systems, including propulsion noise, wheel-rail noise, and aerodynamic noise. The lowest noise levels are represented by the measured and predicted noise levels from the German TransRapid mag- netically levitated demonstration vehicles, designated TR06 and TR07. The predicted curve is obtained using theory for aerodynamic noise, which includes assumptions about the size and shape of the body (3). Actual measured data show the predictions to be conservative by nearly 5 dB at the higher speeds, although the slopes of the curves are in essential agreement (W. Dickhart, TransRapid International, unpub- lished data). The curve labeled ICE represents data measured on the new German Intercity Express, which has been operated at speeds over 250 mph. These data are representative of all high-speed steel wheel and steel rail systems, including those in operation in France ( 4). The curve of noise versus speed for this train illustrates the combination of wheel-rail noise and aerodynamic noise (5). At lower speeds, below 100 mph, the slope of the curve follows the 30 log speed relationship. As speed approaches 150 mph, the slope gradually changes to correspond to a sum of wheel-rail and aerodynamic noise, and at speeds greater than 180 mph, the slope approaches the 60 log speed relationship of aerodynamic noise. Contributions of the various sources of noise from the ICE have been mea- sured with linear microphone arrays (5). The results confirm the expected behavior. Noise from the high-speed trains in Japan has been reported in the documentation of the efforts by the Japanese National Railway to meet environmental constraints (6). The data shown here indicate a 20 log speed relationship as opposed to the more usual 30 log speed behavior found for tracked systems, although there is a hint of a change in slope at the highest speed reported. No explanation has been given for the anom- alous behavior. It may be caused by a greater contribution of propulsion noise than expected to the low-speed data points. Hanson The Amtrak data shown in Figure 3 are taken from a series of tests run on the then newly introduced electric locomotive from Sweden, the ASEA RC-4, on a long, straight section of track near Princeton, N.J., in 1978 (7). The train consist was five cars besides the new locomotive. The data followed approximately a 30 log speed relationship, except when the locomotive was accelerating under power, in which case the relationship was more like the Shinkansen result of 20 log speed. A single data point represents a passby of an ANF Tur- boliner (RTG-2) measured by Harris, Miller, Miller, & Han- son, Inc., during a demonstration run on Amtrak's Northeast Corridor (C. E. Hanson, unpublished data). Here, unlike electrically powered trains, the wheel-rail noise and the aero- dynamic noise components contributed less than the propul- sion noise. EXAMPLE OF NOISE IMPACT CORRIDOR FROM HSR In view of public concern over noise from HSR, it is important to make a preliminary estimation of the noise impact corridor from various alternative y tem . Expected community reac- tion is related to the noise criteria ba, ed on the L<111 metric. In order to estimate the Ldn caused by the introduction of high-speed trains, the operational schedule, speed profile, and train consists are required in addition to the Lmax data. The following conditions are used as an example of the procedure for estimating a noise impact corridor: Site: average suburban residential community, existing Ldn = 55 dBA; Train: conventional HSR (e.g., the ICE), 780 ft long; Guideway: ballast and tie, at-grade; Schedule: one train every hour from 7 a.m. to 12 p.m.; Speed: 180 mph. From Figure 3, Lmax = 91 dBA at 82 ft for this train. Con- version of the Lmax of a single train pass by to hourly equivalent sound level is done by assuming that the train acts like a dipole sound source and using an equation suggested by Peters (8). Calculation of the Ldn proceeds by summing the hourly noise exposure over the hours of operation, with a 10-dB penalty applied to hours between 10 p.m. and 7 a.m. For this scenario, there are 15 daytime hours and 12 nighttime hours. The proj- ect noise calculation yields Ldn = 62 dB at 82 ft. For assessment of noise impact, the project noise level of 62 dB for this hypothetical example is plotted on Figure 1 together with the assumed existing ambient noise level of 55 121 dB. The point falls into the severe impact zone, which is understandable for a site just 82 ft from the tracks of a high- speed train. Referring again to Figure 1, the project noise level needs to decrease to 55 dB to fall on the threshold of impact, at the point where ambient noise level is 55 dB. Assuming a truncated line source and propagation over ground covered with vegetation, the project noise level would be 55 dB at a distance of 240 ft from the tracks. Consequently, the noise impact corridor for this scenario would have a total width of 480 ft. The corridor would be even wider for resi- dential areas with lower ambient noise levels or for track sections with more train traffic. Typically, the noise impact corridor ranges between 200 ft and 1,000 ft, depending on existing ambient noise conditions, train schedule, operating conditions, and guideway configuration. This scenario is the unmitigated condition; the noise impact corridor can be nar- rowed considerably with the use of wayside noise barriers. CONCLUSION High-speed trains can cause severe environmental noise impact in residential areas; this needs to be considered thoroughly during the preliminary engineering and final design phases of a new system. Aerodynamic noise is the dominant source at speeds greater than 150 mph, and applies to trains whether or not they run on rails. Noise impacts may extend out to distances of 500 ft on either side of the tracks in otherwise quiet residential areas. REFERENCES l. There is a lot of anticipation to break ground and start the process of bringing the Palo Alto Museum and all that it offers in terms of education, economic benefit to the City, and cultural experiences to the community in the historic Roth Building. As discussions continue between the City’s designated attorney and the Museum (PAM) pro bono attorneys at Wilson Sonsini, we offer the following as you go into closed session this evening. Premises and Agreed Use: The wording below is taken from the most recent communication from the City’s attorney to our legal team last Friday afternoon. We are not clear on what is intended in terms of determining applicability of designated impact fees. We are not aware of a “cost to provide” or a square footage comparison as a basis for determination with other similarly situated projects if that is what is intended or what formula would be used. Again, we are not clear what is meant by the wording below: “Premises: … subject to use requirements/restrictions necessary for use of designated impact fees.” “Agreed Use: …. but we anticipate a need for some terms to establish the level and type of operations necessary to maintain eligibility for the various funding sources that are to be used.” Construction: Tim Stitt of Vance Brown met with Brad Eggleston on July 6, 2021. At that meeting, Mr. Eggleston reviewed the latest budget, and it was agreed that a new AIA Contract in lieu of writing a change order to the 2016 contract. The new contract will be available for my signature this week. The new contract will have updated construction costs and will specify scope of work and applicable state law. Due to some value engineering the construction cost is consistent with prior cost estimates. VB performed some value engineering, and the construction cost is consistent with what has previously been presented in PAM presentations. Payment and Performance Bonds: Vance Brown’s (VB) experience working on Palo Alto-owned property consisted of working at Avenidas prior to the JMZ project. The Avenidas project did not require a payment and performance bond. During the Operating Agreement negotiations with JMZ, the City’s attorney argued that a Payment & Performance Bond was required for the JMZ project. Other projects VB has observed on Palo Alto property did not require Payment and Performance Bonds. The City paid for the Payment & Performance Bond for the JMZ. Prevailing wages: Vance Brown is signatory to the Carpenters and Laborer’s Union and hires union subcontractors. Union wage rates mirror prevailing wage rates. The latest PAM budget includes these rates. The only added cost is asking subcontractors to send VB certified payroll each month and having these subcontractors input their payroll for this specific project into an independent software program that archives the workers labor hours and labor rates. Since the City is asking VB to provide prevailing wage rates, then VB will need to collect certified payroll and use this independent software program. This will add $5K per 6 months and $5K at the end of the project. We need to add $15K to the budget to account for this software program. This was not required for Avenidas but was required as part of the Operating Agreement negotiations at the JMZ. PAM conducted a review of some other, similarly situated non-profits operating in City - owned buildings and provides below some examples of partnership arrangements with those organizations. The leases and City staff reports/budgets analyzed included Avenidas, Museum of American Heritage, Junior Museum and Zoo (JMZ), Environmental Volunteers (EV). Our ask is that PAM be considered similarly as a City partner. For instance: JMZ move to Cubberley: $406k City funded PAM Comment: At its own expense, PAM moved the City-owned Archives to Cubberley to accommodate other Library space needs at Rinconada Library. We ask the City to consider funding the move of the City-owned Archives from Cubberley to the Museum. JMZ permit fees of $278 – 400k were forgiven. EV permitting fees were forgiven. PAM Comment: PAM has paid $100k for City permits, fees. We ask the City to consider PAM in like fashion. JMZ exhibits funded by City @ $247k + $1.442m City funded JMZ’s FF&E @ $206k (50% of total cost) Avenidas pays 25% of Utility costs. PAM comment: The City will be responsible for its share of Utilities (and maintenance) for the public restroom at Heritage Park. We ask the City to consider a proportionate share of Roth Building Utilities at the Museum to account for the Archives space. Provision in EV lease to build a public restroom was forgiven/otherwise provided. PAM comment: Museum is providing a public restroom on the park side of the Roth Building. No other project we researched or are aware of provides such a public amenity. PAM would also like to comment on a statement appearing on City staff reports and continues in these discussions having to do with the verification of Park Impact Fees. It is unclear what is intended by those statements. PAM’s understanding is that park restroom are “valued at” $350k. They are often if not always a challenge to get buy-in from neighbors and so can drag on for years if they ever get built. PAM conducted all the neighborhood outreach, has developed plans, received permits, will oversee construction and build the park side restroom---except for plan review PAM has and will accomplish these milestones without expenditure of City staff time. We note that the Archives, a Library function, Impact Fees only partially cover a small portion of soft and construction costs. And lastly, time is of the essence. Hopefully we will have a rainy season this year. As we approach September, we need to start construction as soon as possible especially given the roof will be one of the first aspect of the rehabilitation. Additionally, the PAM permits re due to expire six months from July 1, 2021, and while a 6-month extension is available, we are anxious to get going and get the Museum open to the public. And lastly, the funding numbers presented by the City’s attorney are not consistent with the numbers previously presented by PAM or by the City in its Staff Reports. Be cautious of opening attachments and clicking on links.  Dear City Council members,     First of all, thank you for your decision earlier this month to move forward with the South Palo Alto Bikeways project.  This will bring some much needed safety improvements to South Palo Alto.    This week there is another important infrastructure project on the agenda, grade separation. If you decide to move  forward with the underpass design we urge you to also approve the "Design Refinement of Underpass Alternatives" for  pedestrians and bicyclists. The staff report mentions 90 degree angled turns, but some of these are actually 180 degrees,  and nearly impossible to navigate for less agile riders. This includes young riders, senior riders, and families like  ourselves (with a toddler in a cargo bike).    Thank you for your consideration.     Kind regards,    Nicole, Arnout, & Ava Zoeller Boelens  1/ Palo Alto Mayor Tom DuBois Palo Alto Mayor's Office 250 Hamilton A venue Palo Alto, California 94301 August 23, 2021 Dear Mayor Tom DuBois, I am writing to you regarding my continuing concern about the growing litter in the City of Palo Alto, and the lack of cleanup. In Palo Alto, there are no visible efforts to clean up litter. Perhaps you have seen the growing debris along our roads, highways, :freeways, :freeway on and off ramps, interstates, cities, neighborhoods, parks, and beaches. I am born and raised in California and remember when the State was a showcase and free of litter. It saddens me that garbage continues to pile up, and there does not seem to be any effort for any cleanup. I recognize that the pandemic exacerbates the homelessness, which adds to the problem. However, perhaps some of the Rescue Plan money for covid could be spent on cleaning Palo Alto litter. I remember prisoners cleaning up California. Could you please address the need for litter cleanup in Palo Alto. For brevity, I have enclosed only four ( 4) photos, with locations, as examples of the litter problem.
