RESOLUTION NO. 92 -3123
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TEMPLE CITY APPROVING CONDITIONAL USE
PERMIT 91 -1108, A REQUEST BY CHARLES DOEPPEL,
EDDIE HSU AND DAVID MI AND PARTNERS TO ALLOW
THE REMODELING AND REDIVISION OF AN EXISTING
COMMERCIAL BUILDING INTO FOUR INDEPENDENTLY
ACCESSIBLE UNITS TO BE OCCUPIED BY FOUR
RELATED BUSINESS OEPRATIONS OF A SINGLE
BUSINESS ENTERPRISE AND MAINTAINING THE LEGAL
NON- CONFORMING PARKING LOCATED AT 9119 LAS
TUNAS DRIVE IN THE GENERAL COMMERCIAL (C -2)
ZONE. (DOEPPEL/ HSU /MI)
The City Council of the City of Temple City does hereby
resolve:
SECTION 1. Based upon a public hearing for the above Condi-
tional Use Permit before the City Council and based testimony
received at the public hearing before the Planning Commission,
the City Council makes the following findings:
CONDITIONAL USE PERMIT
1. That the site for the proposed use is adequate in size,
shape, topography and circumstances in that the site has a
width of 108 feet and a length of 125 feet for a total land
area of approximately 13,580 square feet of which 8,165
square feet is covered with a commercial building for a lot
coverage factor of 60 %; the subject proposal would result in
a positive upgrading of the interior element and exterior
frontages along Las Tunas Drive; and
2. That the site has sufficient access to streets and high-
ways, adequate in width and pavement type to carry the
quantity and quality of traffic generated by the proposed
use in that the proposed use of the property is permitted by
the Zoning Code and is compatible with other uses in the
immediate area and is served by Las Tunas Drive a primary
street with a right of way width of 100 feet; and
3. That the proposed use will have no adverse effect upon the
use, enjoyment or valuation of adjacent property or upon the
public welfare in that the four proposed independently
accessible units will be operated by a single business
enterprise and the proposed real estate related uses are
compatible with other uses in the immediate area and is
consistent with the uses permitted in the C -2 Zone. Although
the proposed change in use is likely to result in additional
demand for parking, the property is legal non - conforming and
is similar to other properties in the C -2 Zone with less
than the minimum required amount of on -site parking.

SECTION 2. This project is categorically exempt from envi-
ronmental review in accordance with the State CEQA Guidelines.
SECTION 3. Accordingly, Conditional Use Permit 91 -1108 is
approved, subject to the following conditions:
1. Construction shall be completed in substantial compliance
with the submitted development plans, except as modified
herein.
2. Final building plans shall be subject to review by the
Community Development Department.
3. All existing exposed gas lines along the west elevation
shall be relocated or camouflaged to the satisfaction of the
Building Inspector, Public Works Coordinator and Community
Development Director.
4. The existing projecting roof signage shall be removed. New
signage shall be limited to the designated wall sign areas
as delineated on the submitted building elevation plans. A
comprehensive sign plan shall be submitted in conjunction
with the construction plans.
5. The site shall be maintained free from debris, weeds and
waste material before and during and after construction.
6. A detailed landscape plan shall be submitted and reviewed by
the Community Development Department prior to issuance of
building permits. The landscape plan shall incorporate
appropriate landscaping in all parking areas and incorporate
street trees as may be required by the Park Maintenance
Superintendent.
7. The parking area shall be reconstructed or resurfaced and
restriped to the satisfaction of the Building Inspector,
Public Works and Community Development Department. The
parking lot area shall be improved with no less than 10%
landscaping. Said landscaping shall provide a buffer along
the west property line and adjacent to the west building
wall. Said landscaping plans shall be subject to the review
and approval by the Community Development Department.
8. The specific location and size of the trash enclosure shall
be subject to the review and approval by the Community
Development Department.
9. The existing garage door in the west building wall shall be
replaced with a standard sized 16 foot wide roll -up type
garage door with an automatic garage door opener. This
garage door shall be of standard height and shall be inte-
grated into the architectural features of the building.

10. The overheight door in the rear wall of the building shall
be replaced with a two -car, roll -type garage door of stan-
dard height. The garage door height shall approximately
match the garage door height of the lower garage door in the
rear building wall. Reduction in the garage door height
shall have a uniform appearance with the architectural
features of the building.
11. The garage parking area shall be used solely for parking
purposes. Said garage parking shall be available at all
times for parking of operable vehicles and may not be util-
ized for any other purpose whatsoever.
12. The real estate training school may engage in correspondence
school activities; however, the real estate school classroom
shall be utilized only for purposes of serving the educa-
tional and training needs of employee /agents or perspective
employee /agents. The real estate school shall only operate
after 6 p.m. daily, including weekends.
13. Prior to issuance of building permits, plans shall be re-
viewed and approved by Public Works and the Community Devel-
opment Department.
PUBLIC WORKS
14. Curbs, gutters, sidewalks: Maintain existing curb and gutter
on Las Tunas Drive. Remove and replace broken or uneven
sidewalk areas.
15. Street Lights: No additional street lights required.
16. Street Trees: Coordinate all street tree issues with City
Park Maintenance Superintendent. Root barriers shall be
required.
17. Surface Drainage: Provide all facilities necessary to accom-
modate contributory runoff and all surface drainage from the
subject property and conduct it into appropriate storm drain
facilities or into the gutter. No runoff shall be allowed to
drain over a sidewalk.
18. Sewers: Provide per Code.
19. Underground Utilities: All utilities shall be provided un-
derground from primary service point in public right -of -way
or on rear property line to service panels or facilities on
building. Prior to issuance of building permits, provide to
Public Works Department a detailed utility plan for review
and approval showing all utility lines and conduits and
their respective points of connection.

20. Dedications: None required.
21. Permits: Show on plot plan all right -of -way improvements
from centerline of street to property line. Permits shall
be obtained prior to commencement of any work in the public
right -of -way. All work in the public right -of -way shall
meet L.A. County Public Works Dept. standards.
22. Disposal of Construction Waste: No construction activity
waste material of any kind, including plaster, cement,
paint, mud, or any other type of debris or liquid shall be
allowed to be disposed of in the street or gutter or storm
drain or sewer system. Failure to comply with this condition
will result in charges being filed with the District Attor-
ney. (TCMC 3400 -3411)
23. Solid Waste Management: Prior to issuance of Certificate of
Occupancy, provide a written report to Public Works De-
partment showing description and quantity by weight of all
construction and demolition debris and method and location
of disposal. Solid waste includes asphalt, concrete, brick,
sand, earth, wood, plaster, drywall, paper, cardboard, wire,
plastic, etc. Total quantities and general categories are
all that is currently required.
SECTION 4. That the City Clerk shall certify to the passage
and adoption of this resolution and enter it into the book of
original resolutions.
