AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE,
FLORIDA, PROVIDING FOR AMENDMENT OF THE
VILLAGE CHARTER BY AMENDING SECTION 5.01
"ELECTIONS"; BY PROVIDING FOR THE
ESTABLISHMENT OF PRIMARY ELECTION SYSTEM AND
PROCEDURES PERTINENT THERETO; PROVIDING FOR
REVISION OF MAYORAL AND COUNCIL ELECTION
DATE, COMMENCING WITH 2006 ELECTION, TO
PROVIDE FOR PRIMARY ELECTIONS FOR MAYOR AND
COUNCIL TO BE IN OCTOBER OF EACH EVEN
NUMBERED YEAR AND FOR REGULAR ELECTIONS FOR
MAYOR AND COUNCIL TO BE IN NOVEMBER OF EACH
EVEN NUMBERED YEAR, AND ELIMINATING RUNOFF
ELECTION SYSTEM WHICH CURRENTLY PROVIDES FOR
RUNOFF ELECTIONS TO BE HELD TWO WEEKS
FOLLOWING REGULAR ELECTION; AND ALLOWING
ELECTION DATES TO BE FURTHER ADJUSTED BY
ORDINANCE OF THE VILLAGE COUNCIL; CALLING AN
ELECTION ON THE PROPOSED AMENDMENTS TO THE
VILLAGE CHARTER TO BE HELD ON TUESDAY,
NOVEMBER 2, 2004; PROVIDING FOR SUBMISSION TO
THE ELECTORS FOR APPROVAL OR DISAPPROVAL THE
CHARTER AMENDMENTS SET FORTH HEREIN;
PROVIDING FOR REQUISITE BALLOT LANGUAGE;
PROVIDING FOR PROCEDURE FOR BALLOTTING;
PROVIDING FOR NOTICE OF ELECTION; PROVIDING
FOR INCLUSION IN THE CHARTER; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Section 6.02(a)(i) of the Charter of the Village of Key Biscayne provides that
the Council may, by Ordinance, propose amendments to the Charter, subject to approval by the
electorate at the next general election or at a special election called for such purpose; and
WHEREAS, the Council has determined to submit proposed Charter Amendments for
approval or disapproval by the electors, as provided in this Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:'
Section 1. Recitals Adopted. That each ofthe above stated recitals is hereby adopted
and confirmed.
Section 2. Charter Amended.
That Section 5.01 "Elections" of the Village Charter, is amended by revising that Section to
read, as follows:
Section 5.01. Elections.
(a) Electors. Any person who is a resident of the Village, has qualified as an
elector of the State and registers to vote in the manner prescribed by law shall
be an elector of the Village.
(b) Nonpartisan elections. All elections for the offices of Councilmember and
Mayor shall be conducted on a nonpartisan basis.
(c) Election date. An A primary election shall be held in each even -numbered
year on the first Tuesday following the first Monday of October. A regular
election shall be held in November of each even -numbered year, on the same
day U.S. congressional elections are held, or if none are held in any year, on
the first Tuesday following the first Monday of November of that year.
Notwithstanding any contrary provisions of this section, the Village Council
may. by ordinance enacted pursuant to Section 100.3605(2), Florida Statutes,
or independent of such statutory basis by virtue of the enabling authority
provided in this subsection (c), from time to time, change the dates for
conducting primary, regular and special elections for the election of the
Mayor and/or Village Council and provide for the orderly transition of office
resulting from such date changes.
(d) Primary Election. There shall be no primary election for Mayor if no more
than two candidates qualify to run for the office of Mayor. There shall be no
primary election for Council if no more than twelve candidates qualify to run
for the six Council positions. In the event that a primary election is not
necessary, as described above, the qualified candidates' names shall be placed

on the regular election ballot, unless otherwise specified by paragraph (h)
below. The ballot for the primary election shall contain the names of all
qualified candidates for Mayor and for each of the six (6) Council positions,
and shall instruct electors to cast one (1) vote for Mayor and no more than six
(6) votes for Council, with a maximum of one (1) vote per candidate. If ally

greater than fifty percent (50%) of the ballots cast for Mayor, the two (2)
candidates -for Mayor who -received -the -greatest -number of ballots -east -shaft

1.0 Regular Election. The ballot for the regular election shall contain the names
of the two candidates for Mayor who received the most votes in the primary
election. The ballot for the regular election shall also contain the names of
the twelve candidates for Council who received the most votes in the primary
election. The ballot shall instruct electors to cast one vote for Mayor and to
cast a number of votes for the Council not greater than the number of the six
(6) contested Council positions, with a maximum of one vote per candidate.
The candidate for Mayor receiving the most votes shall be the duly elected
Mayor. The six (6) candidates for Council receiving the most votes shall be
duly elected to the six (6) positions on the Council.

Council at such times and in such manner as shall be consistent with this
Charter.

Tie Votes. If the primary election results in two or more candidates receiving
a tie vote such that the number of candidates to be placed on the ballot for the
regular election would exceed the limitations in subsection (e), all candidates
receiving a tie vote shall be listed on the ballot for the general election and
the limitations in subsection (e) shall not apply. If a tie vote occurs in the
regular election between two or more candidates for either the office of
Mayor or Councilmember, the tie vote shall be decided by lot under the
direction of the Village Clerk.
(g)(l) Single candidates. In the event that the number of persons who qualify as
candidates for the Council Member positions to be filled at an election is
equal to or less than the number of positions to be filled at such election,
those positions shall not be listed on the primary or regular election ballot. No
election for Mayor shall be required in any election if there is only one duly
qualified candidate for Mayor. The duly qualified candidates shall be deemed
elected.
Absentee votes. Absentee voting will be permitted as provided by the laws of
the State and under such conditions as may be prescribed by ordinance from
time to time; provided, however, that no ordinance shall limit the right to vote
by absentee ballot available under State law.

Commencement of terms. The term of office of any elected official will
commence seven (7) days following the day of the regular election, runoff,
or special election at which s/he is elected.
Section 3. Form of Ballot.
The form of ballot for the Charter Amendment provided for in Section 2 of this Ordinance
shall be, as follows:

A Charter Amendment is proposed to eliminate runoffs, establish a primary
election system, and provide for a primary election in October with a regular
election in November for Mayor and Council positions, and to allow election dates
to be further adjusted by Ordinance.

Section 4. Election Called; Ballot; Notice, etc.
a. In conjunction with the Presidential Election, an election is hereby called for
Tuesday, the 2nd day of November, 2004 to present to the electors of the Village the Charter
Amendment ballot question provided in Section 3 above.
b. The balloting shall be conducted between the hours of 7:00 a.m. and 7:00 p.m.
at the regular polling places for Village elections or as otherwise provided by law. All qualified
electors residing within the Village who are timely registered shall be entitled to vote.
c. Notice of said election shall be published in accordance with Section 100.342,
Florida Statutes, in a newspaper of general circulation within the Village at least thirty (30) days
prior to said election, the first publication to be in the fifth week prior to the election, and the second
publication to be in the third week prior to the election, and shall be in substantially the following
form:
"NOTICE OF ELECTION.
PUBLIC NOTICE IS HEREBY GIVEN THAT PURSUANT TO AN ENABLING
ORDINANCE DULY ADOPTED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, (THE "VILLAGE"), AN ELECTION
HAS BEEN CALLED AND ORDERED TO BE HELD WITHIN THE VILLAGE
ON TUESDAY, THE 2ND DAY OF NOVEMBER, 2004, BETWEEN THE
HOURS OF 7:00 A.M. AND 7:00 P.M., AT WHICH TIME THE FOLLOWING
CHARTER AMENDMENT PROPOSITION SHALL BE SUBMITTED TO THE
QUALIFIED ELECTORS OF THE VILLAGE.
Procedure for Election of Mayor and Village Council Members.
The Village Charter currently provides for the election of Mayor and Council
Members in November of each even numbered year, and includes runoff elections.
A Charter Amendment is proposed to eliminate runoffs, establish a primary election

November for Mayor and Council positions, and to allow election dates to be further
adjusted by Ordinance.

Polling place information and the full text of the enabling Ordinance are available at the Office of
the Village Clerk.
VILLAGE CLERK"
The Council may by Resolution revise the Ballot question and corresponding Notice of Election
which are set forth above. Notices of Election for any other Charter amendments may be combined
with this Notice of Election by the Village Clerk.
d. The registration books shall remain open at the Office of the Miami -Dade County
Supervisor of Elections until Monday, October 4, 2004, at which date the registration books shall
close in accordance with the provisions of the general election laws.
e. The Village Clerk, with necessary assistance from the Miami -Dade County
Supervisor of Elections, is hereby authorized to take all appropriate actions necessary to carry into
effect and accomplish the electoral provisions of this Ordinance. The Village Clerk is authorized
to arrange for early voting as authorized by law.
f. This election shall be canvassed by the Village Clerk in accordance with the
provisions of Section 2-102 of the Village Code and any applicable provisions of the general election
laws or by the County Canvassing Board at the request of the Village Clerk.

g.
Copies of this Ordinance are available for public inspection during regular business
hours at the Office of the Village Clerk.
Section 5. Effectiveness of Charter Amendment. The Village Charter Amendment
described in Section 2 above, shall only be effective if a majority of the qualified electors of the
Village voting at the Charter Amendment election held for such purpose, pursuant to Sections 3 and
4 hereof, vote for its adoption, and shall be considered adopted and effective upon certification of
the election results as provided herein.
Section 6. Severability. The provisions of this Ordinance are declared to be severable
and if any section, sentence, clause or phrase of this Ordinance shall be held to be invalid or
unconstitutional, such decision shall not affect the validity of the remaining sections, sentences,
clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent
that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 7. Inclusion in the Charter. It is the intention of the Village Council, and it is
hereby ordained that the provisions of Section 2 of this Ordinance shall become and be made a part
of the Charter of the Village of Key Biscayne, Florida, as to any Charter Amendment measure
approved by a majority of voters voting on such measure in such election; that the sections of this
Ordinance may be renumbered or relettered to accomplish such intentions; that the word "Ordinance"
shall be changed to "Section" or other appropriate word.
Section 8. Effective date. This Ordinance shall be effective upon adoption on second
reading. Any Charter Amendment measure provided herein shall be effective only upon approval
of a majority of electors voting on the measure, effective upon certification of the election results,
and shall be applicable to elections conducted commencing in 2006.

POR CUANTO, la Seccion 6.02 (a)(i) de la Carta Constitucional del Municipio de Key
Biscayne dispone que el Consejo, por ordenanza, puede proponer enmiendas a la Carta
Constitucional, que estaran supeditadas a la aprobacion del electorado en la siguiente eleccion
general o en una eleccion extraordinaria convocada al respecto; y
POR CUANTO, el Consejo ha decidido someter las enmiendas propuestas para la Carta
Constitucional a la aprobacion o rechazo del electorado, conforme a lo dispuesto en esta
ordenanza.
AHORA, POR LO TANTO, RESUELVASE POR EL CONSEJO MUNICIPAL
DEL MUNICIPIO DE KEY BISCAYNE, FLORIDA, LO SIGUIENTE:
Seccion 1. Considerandos aprobados. Que por este medio se aprueban y confirman
los dos considerandos anteriores.
Seccion 2. Carta Constitucional enmendada.
Que la Seccion 5.01 ("Elecciones") de la Carta Constitucional del Municipio, se
enmienda mediante la modificacion de esa Seccion de modo que rece de la manera siguiente:
Seccion 5.01. Elecciones.
(a) Los electores. Se considera elector del Municipio a toda persona que sea
residente del Municipio, este cualificada como electora del Estado y se
inscriba para votar del modo prescrito por la ley.
(b) Las elecciones no partidistas. Todas las elecciones para los cargos del
Consejo y para el del Alcalde se celebraran de manera no partidista.
(c) La fecha de la eleccion. Una La eleccion primaria se celebrara en todo ano
par el primer martes despues del primer lunes del mes de octubre. Se
celebrara una eleccion ordinaria en el mes de noviembre de todo ano par,
el mismo dia en que se celebren las elecciones congresuales de los Estados
Unidos y, si no se celebrara ninguna en algun ano, el primer martes
despues del primer lunes del mes de noviembre de dicho ano. A pesar de
las disposiciones contrarias de esta seccion que pueda haber, el Consejo
Municipal, por ordenanza, puede autorizar con arreglo a la Seccion
100.3605(2) de los Estatutos de la Florida o independientemente de la
susodicha base estatutaria en virtud de la autoridad autorizante dispuesta
en este inciso (c), ocasionalmente, cambios en las fechas para celebrar
elecciones primarias, ordinarias y extraordinarias para elegir al Alcalde
y/o al Consejo Municipal y disponer la transicion ordenada de los cargos
resultante de dichos cambios de fechas.
(d) La eleccion primaria. No habra eleccion primaria para el Alcalde si no
mas de dos candidatos cualifican para postularse para el cargo de Alcalde.
No habra eleccion primaria para el Consejo si no mas de doce candidatos
cualifican para postularse para los seis escanos del Consejo. En caso de
que no sea necesaria una eleccion primaria, conforme a lo descrito
anteriormente, el nombre de los candidatos cualificados se colocara en la

boleta de la eleccion ordinaria, a no ser que se especifique de manera
diferente en el parrafo (h) a continuacion. La boleta de la eleccion
primaria contendra los nombres de todos los candidatos cualificados para
Alcalde y para cada uno de los seis (6) escanos del Consejo, e instruira a
los electores que emitan un (1) voto para el Alcalde y no mas de seis (6)
votos para el Consejo, con un maximo de un (1) voto por candidato. 84

La eleccion ordinaria. La boleta para la eleccion ordinaria contendra el
nombre de los dos candidatos para Alcalde que hayan recibido el mayor
numero de votos en la eleccion primaria. La boleta para la eleccion
ordinaria tambien contendra en nombre de los doce candidatos para el
Consejo que hayan recibido el mayor numero de votos en la eleccion
primaria. La boleta instruira a los electores para que emitan un voto por el
Alcalde y un numero de votos por el Consejo que no se mayor que el
numero de los seis (6) escanos del Consejo en contienda, con un maximo
de un voto por candidato. El candidato para Alcalde que reciba el mayor
numero de votos sera elegido Alcalde debidamente. Los seis (6)
candidatos para el Consejo que reciban el mayor numero de votos seran
elegidos debidamente para los seis (6) escanos del Consejo.
(OLD Las elecciones extraordinarias. Las elecciones extraordinarias, cuando
sean necesarias, las programara el Consejo en las fechas, horarios y
manera que sean congruentes con esta Carta Constitucional.

Las votaciones empatadas. Si la eleccion primaria resulta en que dos
candidatos o mas reciben una votacion empatada de modo tal que el
numero de candidatos para colocarse en la boleta de la eleccion ordinaria
excederia las limitaciones del inciso (e), todos los candidatos que reciban
una votacion empatada seran enumerados en la boleta de la eleccion
general y no se aplicaran las limitaciones del inciso (e). Si ocurre una
votacion empatada en la eleccion ordinaria entre dos candidatos o mas
para el cargo de Alcalde o para el de Miembro del Consejo, se decidira la
votacion empatada echando suertes bajo la direccion de la Secretaria
Municipal.

Los candidatos individuales. En caso de que el numero de personas que
cualifiquen como candidatos para los escanos de Miembros del Consejo
para llenarse en una eleccion es igual o menor que el numero de escanos
que han de llenarse en dicha eleccion, no se enumeraran dichos escanos en
la boleta de la eleccion primaria u ordinaria. No sera necesaria ninguna
eleccion para Alcalde en una eleccion si hay solamente un candidato
debidamente cualificado para Alcalde. Se consideraran electos a los
candidatos debidamente cualificados.
Las votaciones con boletas para electores ausentes. La votacion con
boleta para elector ausente se permitira conforme a to dispuesto en las
leyes del Estado y segun los terminos prescritos por ordenanza
ocasionalmente; sin embargo, ninguna ordenanza limitary el derecho de
votar con boleta para elector ausente disponible segun las leyes del Estado.
El comienzo de los plazos. El plazo del cargo de todo funcionario electo
comenzara siete (7) dias despues del dia de la eleccion ordinaria, la
o la eleccion extraordinaria en la que resulte
electo.
Seccion 3. Forma de la boleta.
La forma de la boleta para la Enmienda a la Carta Constitucional dispuesta en la Seccion
2 de esta Ordenanza sera la siguiente:
"El procedimiento para la eleccion del Alcalde y de los Miembros del
Consejo Municipal.
La Carta Constitucional del Municipio actualmente dispone que la eleccion del
Alcalde y los Miembros del Consejo se celebre en el mes de noviembre de todo
afio par e incluya elecciones de segunda vuelta. Ha sido propuesta una Enmienda
a la Carta Constitucional para eliminar las elecciones de segunda vuelta,
establecer un sistema de elecciones primarias y disponer la celebracion de una
eleccion primaria en el mes de octubre con una eleccion ordinaria en el mes de
noviembre para el Alcalde y los escanos del Consejo, y para permitir que las
fechas de las elecciones sean ajustadas mas adelante por Ordenanza.

Seccion 4. La convocacion de elecciones; la boleta; el aviso, etc.
a. Conjuntamente con la eleccion presidencial, por el presente se convoca a
una eleccion para el martes 2 de noviembre del 2004, para presentar al electorado del Municipio
la propuesta que aparecera en la boleta de la Enmienda a la Carta Constitucional dispuesta en la
Seccion 3 anterior.
b. La votacion se celebrara durante el horario de siete a.m. a siete p.m. en los
centros ordinarios de votacion para las elecciones del Municipio o conforme a lo dispuesto de
otro modo por las leyes. Todos los electores cualificados que residan en el territorio del
Municipio que esten inscritos oportunamente tendran derecho a votar.
c. Se publicara un aviso de dicha eleccion conforme a la Seccion 100.342 de
los Estatutos de la Florida, en un periodico de tirada general en el Municipio al menos treinta
(30) dias antes de dicha eleccion, con la primera publicacion en la quinta semana anterior a la
eleccion y la segunda publicacion en la tercera semana anterior a la eleccion; dicho aviso
substancialmente tendra la forma siguiente:
"AVISO DE ELECCION
POR EL PRESENTE, SE AVISA PUBLICAMENTE QUE, CON ARREGLO A
UNA ORDENANZA AUTORIZANTE DEBIDAMENTE APROBADA POR EL
CONSEJO MUNICIPAL DEL MUNICIPIO DE KEY BISCAYNE, FLORIDA,
(EL "MUNICIPIO"), SE HA CONVOCADO A UNA ELECCION Y
ORDENADO QUE SE CELEBRE EN EL MUNICIPIO EL MARTES 2 DE
NOVIEMBRE DEL 2004 ENTRE LAS 7 A.M. Y LAS 7 P.M., PARA QUE LA
SIGUIENTE PROPUESTA DE ENMIENDA A LA CARTA
CONSTITUCIONAL SE SOMETA AL ELECTORADO CUALIFICADO
DEL MUNICIPIO.
Procedimiento para la eleccion del Alcalde y de los Miembros del Consejo
Municipal.
La Carta Constitucional del Municipio en la actualidad dispone la celebracion de
una eleccion para el Alcalde y los Miembros del Consejo en el mes de noviembre
de todo ano par e incluye elecciones de segunda vuelta. Ha sido propuesta una
Enmienda a la Carta Constitucional para eliminar las elecciones de segunda
vuelta, establecer un sistema de elecciones primarias y disponer la celebracion de
una eleccion primaria en el mes de octubre con una eleccion ordinaria en el mes
de noviembre para el cargo de Alcalde y los cargos del Consejo, y para permitir

Por Resolucion, el Consejo podra modificar la propuesta de la Boleta y el correspondiente Aviso
de Eleccion que han sido establecidos arriba. La Secretaria Municipal podra combinar los avisos
de la eleccion para cualquier otra enmienda a la Carta Constitucional con este Aviso de Eleccion.
d. Los libros de inscripcion se mantendran abiertos en la Oficina de la Supervisora de
Elecciones del Condado de Miami -Dade hasta el lunes 4 de octubre del 2004, fecha en la cual se
cerraran los libros en conformidad con las disposiciones de las elecciones generales.
e. La Secretaria Municipal, con la asistencia necesaria por parte de la Supervisora de
Elecciones del Condado de Miami -Dade queda autorizada por este medio para tomar todas las
medidas apropiadas y necesarias para llevar a efecto y hacer cumplir las disposiciones electorales
de esta Ordenanza. La Secretaria Municipal por este medio queda autorizada para hacer los
arreglos necesarios para la votacion anticipada conforme a lo autorizado por ley.
f. La Secretaria Municipal realizara el escrutinio de esta eleccion en conformidad con
las disposiciones de la Seccion 2-102 del Codigo del Municipio y de las disposiciones
pertinentes de las leyes para las elecciones generales o por la Junta de Escrutinio del Condado a
peticion de la Secretaria Municipal.

Hay copias de esta Ordenanza disponibles para su inspeccion publica durante el
horario habil de la Oficina de la Secretaria Municipal.
Seccion 5. Entrada en vigor de la Enmienda a la Carta Constitucional. La
enmienda a la Carta Constitucional Municipal descrita en la Seccion 2 anterior, entrara en vigor
unicamente si la mayoria de los electores cualificados del Municipio que voten en relacion con la
eleccion sobre la enmienda a la Carta Constitucional celebrada para dicha finalidad y conforme a
las Secciones 3 y 4 de esta, vote a favor de su aprobacion, por lo que se considerara aprobada y
entrara en vigor tras la certificacion de los resultados electorales conforme a lo dispuesto aqui.
Seccion 6. Divisibilidad. Las disposiciones de esta Ordenanza se declaran divisibles
si alguna seccion, oracion, clausula o frase de esta Ordenanza se considera invalida o
inconstitucional, aunque dicha decision no afectara la validez de las restantes secciones,
oraciones, clausulas y frases de esta Ordenanza las que se mantendran en vigor, ya que la
intencion legislativa es que esta Ordenanza tenga vigencia a pesar de la invalidez de alguna de
sus partes.
Seccion 7. Inclusion en la Carta Constitucional. Es la intencion del Consejo
Municipal y se ordena por este medio que las disposiciones de la Seccion 2 de esta Ordenanza se
conviertan y formen parte de la Carta Constitucional del Municipio de Key Biscayne, Florida, en
lo referente a toda enmienda a la Carta Constitucional aprobada por la mayoria de los electores
que voten acerca de dicha medida en una eleccion susodicha; que las secciones de esta
Ordenanza puedan volverse a enumerar o que se les puede volver a asignar letras para hacer
cumplir dichas intenciones; y que la palabra "Ordenanza" se cambiara a "Seccion" u otra palabra
apropiada.
Seccion 8. Fecha de la vigencia. Esta Ordenanza entrara en vigor tras su aprobacion
en su segunda lectura. Toda Enmienda a la Carta Constitucional dispuesta aqui entrara en vigor
solamente tras la aprobacion de la mayoria de los electores que voten al respecto de la medida,
tras la certificacion efectiva de los resultados de la eleccion; y esta sera pertinente en cuanto a las
elecciones que se celebren a partir del 2006.
