Town initiated request to amend the Future Land Use Element and
Future Land Use Map in the Comprehensive Plan.
A. Include as a supplement to the text of the element:
1. an identification of properties in the Town owned by the
Florida Inland Navigation Districy (FIND) and a general
description of their proposed use as Materials Management
Areas;
2. a revision to the Public "P" Future Land Use Category to
include Materials Management Areas as a permitted use;
3. the incorporation of the Gulf Stream Design Manual and the
generalized findings and goals of the 1994 community
character survey and Gulf Stream Design Manual.
B. Amend the Future Land Use Map to assign the Public "P" Future
Land Use Category to certain properties owned by FIND.
C. Completely revise the Goals, Objectives and Policies section
of the element to reflect the items addressed in the supplement
and to provide a general update of the section.
Town Manager Harrington explained that an amendment to the Comprehensive
Plan adds legal standing to the regulations in the zoning code even though
he felt the code was most likely to be able to stand alone to a legal
challenge. He noted that the language in the amendment to the Comprehensive
Plan that is proposed is more general than that in the code as the Plan is
intended to be a blueprint for what the Town will be in the future. He
further noted that there are no provisions to permit the granting of
variances to any of the provisions in the Comprehensive Plan so it is
important to be sure that what goes into the Plan is what the Town wants.
He pointed out that there are provisions in the Zoning Code that are more
restrictive than what is in the Comprehensive Plan and added that this is
an acceptable difference. However, the provisions in the Zoning Code shall
not be less restrictive than the provisions in the Comprehensive Plan, he
said. Commissioner Armour wanted to be certain that no variances could
be granted for a smaller minimum lot size and /or a larger floor area
ratio than what is permitted in the Comprehensive Plan. He was assured
that no variances could be granted for these things.

Joan Orthwein, Chairman of the Architectural Review and Planning Board,
reported that the ARPB, at their public hearing held on January 25, 1995,
recommended the proposed amendments to the Comprehensive Plan be
adopted as presented.
Mayor Koch asked that it be made a part of the record that FIND had
voluntarily agreed to the annexation of their property and that the
action being taken is pursuant to the provisions of the agreement that
was entered into by the Town and FIND several months previously.
Commissioner True moved and Commissioner Wallace seconded that the Local
Planning Agency recommend to the Town Commission that the proposed amendment
to the Comprehensive Plan as presented,be adopted. Roll Call: Comm.

Mayor Koch adjourned the Public Hearing at 5:10 P.M. on a motion to
do so made by Commissioner Wallace that was seconded by Commissioner True

NOTICE OF LEGISLATION
TO WHOM IT MAY CONCERN:
Notice is hereby given of intent to apply to the Florida
Legislature for passage of a bill relating to the portion of
State Highway AlA located in the Town of Gulf Stream which was
C designated as a state historic and scenic highway pursuant to
Chapter 92 -152, Section 165, Florida Statutes; providing for
partial exemption for this section of AIA from the provisisons
of Florida Statute 369.251, and the Rules of the Department of
Natural Resources relating to said section, which prohibits the
planting of the species Casuarina equisetifolla; providing
authority for the Department of Environmental Protection to grant
permits for the purpose of allowing the possession, cultivation
and planting of the species Casuarina equisetifolla within the
AlA historic and scenic highway; providing an effective date.

MINUTES OF THE PUBLIC HEARING BEING HELD BY THE TOWN COMMISSION OF THE
TOWN OF GULF STREAM ON MONDAY, JANUARY 30, 1995, IMMEDIATELY FOLLOWING THE
MEETING OF THE LOCAL PLANNING AGENCY THAT WAS SCHEDULED FOR 5:01 P.M., IN
THE COMMISSION CHAMBERS IN THE TOWN HALL, 100 SEA ROAD, GULF STREAM, FLORIDA.
I. Call to Order. Mayor Koch called the meeting to order at 5:10 P.M.

III. Zoning Code and Map Amendments.
A. Design Manual
Town Manager Harrington advised that a change has been made as was directed
by the Commission at the Public Hearing of January 13, 1995 on page III -2
under C. PROHIBITED USES. He pointed out that all non - residential uses
are prohibited but the last sentence provides "These prohibitions shall
not extend to the conduct of personal business or to telephonic transactions
and communications." During discussion it was determined that "to the
conduct of personal business or" should be removed from the last sentence
in paragraph C. Attorney Randolph pointed out that the paragraph as
proposed would enable, as an example, someone to conduct the business
of selling insurance from his home. The Commissioners had no objection
to this as long as there are no employees connected with the business
and there are no deliveries or customers calling in person at the home.
Town Manager Harrington then advised that a new plant list has been
prepared and given to each Commissioner which would amend pages V -21 and
V -22, and add a new page V -23.
The last amendment proposed by Mr. Harrington for the Design Manual is
found on page VII -4. This amendment would indicate that "Pan Tile"
would neither be preferred or discouraged as opposed to being discouraged.
Commissioner Wallace called attention to the picture at the top of page
II -5 that replaced a previous picture. She pointed out that this replace -
ment is really not a good example of Mediterrean Revival architecture and
was in fact someone's gate house. Mr. Harrington advised that this would
be replaced with something more appropriate.
Commissioner Wallace then noted that on page III -3 item 6. permits
awnings with leg supports as accessory structures. She was concerned that
this would be permitting carports. Mr..Harrington advised that carports
are specifically prohibited in the code.
Rob Dittman, a Gulf Stream resident, was recognized and expressed concern
that that 5' high fences are required to enclosed swimming pools. He
stated that he had no fence and has an existing swimming pool. He further
advised that in order to obtain insurance for his property, the insurance
companies mandated that there be a 4' high fence around his pool. Mr.

Dittman stated that other municipalities were requiring only the 4'
fences which would conform to the requirements of the insurance companies.
He believed that a 4' fence would be less offensive than a 5' fence.
Mr. Harrington advised that this matter had been brought before the
Commission on two previous occasions and the Commission had decided on the
5' height since that is required in the Palm Beach County Code and Palm
Beach County acts as the building department for Gulf Stream. He also
reminded that another Gulf Stream resident had appeared with a small
child urging that the Commission adopt a mandatory 5' fence height and
further urging that it be made retroactive.
Commissioner Armour moved and Commissioner Cross seconded that the required
fence height to enclose swimming pools be lowered to 41. Roll Call: Comm.
Wallace; NAY, explaining that the code requires that fences be screened
with landscape material and property owners would most likely have a hedge
that would be much higher than 5' just for privacy. Comm. Cross; AYE,
Comm. Armour; AYE, Comm. True; NAY, and Mayor Koch; AYE.
Town Manager Harrington presented the color boards that had been presented
at the public hearing on January 13, 1995 and there were no comments.
Commissioner Wallace noted that on page V -16 of the Design Manual under
the title of "Prohibited ",the second sentence prohibits primary red (except
for doors). She believed that the word "primary" should be deleted. Comm.
Wallace then moved and Comm. Cross seconded that the word "primary" be
removed from where ever it appears in relation to prohibiting primary red.

Commissioner Wallace then moved that the Design Manual as amended herein
be adopted. The motion was seconded by Commissioner True. Roll Call:

B. Amendments to the Offical Zoning Map to reflect the new Single
Family Zoning Districts as described in the Design Manual
Commissioner Wallace moved and Commissioner True seconded that the amendments
to the Official Zoning Map be approved as presented. Roll Call: Comm.

C. Amending powers and duties of the Town Commission, Local Plan-
ning Agency, Board of Adjustment, Architectural Review and

powers and duties for those detailed above be approved as presented, which
includes term limits for the ARPB not to exceed 3 consecutive three -year

The staff was directed to contact the members of the ARPB to ascertain
how many are willing to serve an additional term.

E. Recodification of Variance Standards & Procedures.
Commissioner Wallace moved and Commissioner Armour seconded that the

It was made a matter of record that the Local Planning Agency, as well
as the Architectural Review and Planning Board, recommended approval of

PROCESSING APPLICATIONS, MISREPRESENTATION, ETC.; BY AMENDING
ARTICLE VI DISTRICT REGULATIONS AT DIVISION 2, RS SINGLE - FAMILY
RESIDENTIAL DISTRICT, BY RESCINDING SAID DIVISION IN ITS ENTIRETY
AND CREATING A NEW DIVISION 2, BY ADOPTING THE GULF STREAM DESIGN
MANUAL WHICH ESTABLISHES FIVE SINGLE - FAMILY DISTRICTS, ALL REGULATIONS
RELATING TO SAID DISTRICTS BEING ENCOMPASSED IN FULL WITHIN THE
DESIGN MANUAL, HEREBY ADOPTING ARTICLES I THROUGH IX THEREOF NOT
TO INCLUDE THE APPENDICES; PROVIDING FOR SEVERABILITY; PROVIDING
FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR CODIFICATION;
PROVIDING AN EFFECTIVE DATE. (2nd reading & adoption)
Commissioner Cross moved that Ordinance No. 95/1 be adopted as amended
and the motion was seconded by Commissioner Armour. Roll Call: Comm.

VI. Interlocal Agreement for dispatching service from the City of Delray
Beach.
Mr. Harrington reviewed the document and specifically pointed out that
performance standards have been added to provide for a one minute
dispatch to the police department when an alarm call is received. He addeed
that there is also a provision for Delray to furnish a monthly report
showing the times calls are received, dispatched and cleared which will
assist in assuring that performance standards are met. Mr. Harrington
closed by advising that the current annual fee of $20,000 will be pro-
rated for the period of January 15, 1995 through September 30, 1995 in
order to align with the fiscal year of both communities. For the year
commencing October 1, 1995 and ending September 30, 1996, the payment
shall be $23,956 and in each subsequent year shall be adjusted annually
based on the "All Urban Consumers - United States" April Consumer Price
Index (CPI).

Commissioner Armour moved and Commissioner Cross seconded that the
Interlocal Agreement for Dispatching Service with the City of Delray Beach
be approved and that the Mayor and Town Clerk be authorized to execute
