The Commission found that the application meets the requirements of MCC 3-31-030(A) and recommended the approval of the application by the City Council without a second hearing. The Commission conditioned the approval on the City and the Mill Park Village Property Owners’ Association coming to agreement on the dock location or agreeing to disagree by July 1, 2005. The City and the Association have reached an agreement and the agreement is attached for Council approval. Per the agreement, the Association will pay the costs associated with moving the docks, to a maximum of $4,000. Upon advice of the City Attorney, this item has been placed on the agenda as a public hearing to provide additional opportunity for public input. RECOMMENDED ACTION: Adopt the draft Findings & Conclusions for CUP-05-3 and authorize the Mayor to sign. Adopt Resolution 05-13 approving the contract with The Mill Park Property Owners’ Association and authorize the Mayor to sign all necessary documents.
