RESOLUTION NO. 92 -3129
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TEMPLE CITY DENYING ZONE VARIANCE 91 -1114,
A REQUEST BY WILLIAM EMICK AND KATHY LIN, TO
ALLOW A DENTAL OFFICE WITHOUT PROVIDING TWO
OF THE REQUIRED PARKING SPACES ON A LOT WITH
A LEGAL NON- CONFORMING DUPLEX LOCATED AT
5954 -58 TEMPLE CITY BOULEVARD IN THE GENERAL
COMMERCIAL (C -2) ZONE. (EMICK /LIN)
The City Council of the City of Temple City does hereby
resolve:
SECTION 1. Based upon testimony received at a noticed
public hearing and upon the facts contained in the staff report,
the City Council finds:
1. That there are no exceptional and extraordinary circum-
stances or conditions applicable to the property which do
not generally apply to other properties in the same zone in
that the subject lot is 50 feet wide by 175 feet deep and
could provide additional parking by eliminating the legal
non- conforming duplex; and
2. That such variance is not necessary for the preservation
and enjoyment of a substantial property right possessed by
other property similarly situated but which is denied to
the property in question in that the subject property may
be used for a variety of general retail and office uses
which would not require application of more stringent
parking requirements; and
3. That the granting of the variance will be materially detri-
mental to the public welfare or injurious to adjacent
property in that the parking situation would have an ad-
verse effect on surrounding properties; and
4. That there are no special circumstances as provided in
Section 65906 of the California Government Code in that the
subject lot is rectangular in shape and generally level in
grade and does not possess any unique features relative to
size, shape, or topography.
SECTION 2. Accordingly, Zone Variance 91 -1114 is hereby
denied.
SECTION 3. That the City Clerk shall certify to the passage
and adoption of this resolution and enter it into the book of
original resolutions.
