HomeMy Public PortalAboutORD16211BILL NO. 2021-087 SPONSORED BY Councilmember Lester / ORDINANCE NO. ! 0tit AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY REZONING 5.27 ACRES LOCATED IN THE 2400 BLOCK OF INDUSTRIAL DRIVE FROM M-2 GENERAL INDUSTRIAL TO C-2 GENERAL COMMERCIAL. WHEREAS, BAM Holdings, LLC, owner of real estate hereinafter described, having submitted to the City Council a proposal for rezoning of said real estate consisting of 5.27 acres and being located in Jefferson City, Cole County, Missouri, and described as: Part of the Southwest Quarter of Fractional Section 2, Township 44 North, Range 12 West, in the City of Jefferson, Cole County, Missouri; and WHEREAS, the zoning ordinance requires consistency between the comprehensive plan and the zoning map. The proposed zoning change of said real estate would comply with the adopted Comprehensive Plan Future Land Use Plan Map; and WHEREAS, it appears that the procedures set forth by the City Code and the Planning and Zoning Commission for the City of Jefferson relating to zoning have been complied with in all matters and respects. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The following described real estate is rezoned from M-2 General Industrial to C-2 General Commercial: Part of the Southwest Quarter of Fractional Section 2, Township 44 North, Range 12 West, in the City of Jefferson, Cole County, Missouri, more particularly described as follows: From the northeast corner of Lot 11 of Hatting Place, as per plat of record in Plat Book 12, page 372, Cole County Recorder's Office, being a point on the southerly line of a tract described by deed of record in Book 696, page 950, Cole County Recorder's Office; thence S87°13'10"E, along the southerly line of said tract described in Book 696, page 950, 9.83 feet to the southeasterly corner thereof; thence N1°55'20"E, along the easterly line of said tract described in Book 696, page 950, 850.22 feet to the northeasterly corner thereof, being a point on the southerly line of the first described tract by deed of record in Book 731, page 331, Cole County Recorder's Office and the POINT OF BEGINNING for this description; thence N88°08'14"W, along the northerly line of said tract described in Book 696, page 950, and the southerly line of the first described tract by deed of record in Book 731, page 331, and the extension thereof, 245.00 feet; thence N56°22'41 "W, along the northerly line of said tract described in Book 696, page 950, 539.42 feet; thence N32°45'56"E, 174.98 feet; thence N61 °07'32"W, 184.19 feet to a point on the easterly line of a tract described by deed of record in Book 660, page 94, Cole County Recorder's Office; thence N28°44'52"E, along the easterly line of said tract described by deed of record in Book 660, page 94, 136.55 feet to the northeasterly corner thereof, being a point on the southerly right-of-way line of Industrial Drive; thence S56°56'35"E, along the southerly right-of-way line of Industrial Drive, 849.29 feet to the northeasterly corner of said first described tract by deed of record in Book 731, page 331, being the northwesterly corner of a tract described by Parcel 1 of the deed of record in Book 660, page 923, Cole County Recorder's Office; thence S02°15'49"W, along the easterly line of said first described tract by deed of record in Book 731, page 331, and along the westerly boundary of said Parcel 1 of the deed of record in Book 660, page 923, 199.64 feet to the southeasterly corner of said first described tract by deed of record in Book 731, page 331; thence N88°08'14"W, along the southerly line of said first described tract by deed of record in Book 731, page 331, and the westerly boundary of said Parcel 1 of the deed of record in Book 660, page 923, 8.97 feet to the POINT OF BEGINNING. Containing 5.27 acres Section 2. This ordinance shall be in full force and effect from and after its passage and approval.
