F.S.S. 286.0105 MINUTES OF THE REGULAR MEETING HELD BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM ON FRIDAY, MAY 10, 1996 AT 9:00 A.M., IN THE COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD, GULF STREAM, FLORIDA. I. Call to Order. Mayor Koch called the meeting to order at 9:00 A.M. Ii. Pledge of Allegiance. Vice Mayor Armour led the Pledge of Allegiance. III. Roll Call. G Present and William F. Minutes of the Regular Meeting held April 19, 1996. Commissioner True moved and Commissioner Cross seconded that the minutes be approv- ed as circulated and all voted AYE. V. Additions, withdrawals, deferrals, arrangement of agenda items. Town Manager Harrington requested to add Item VIII.C., Resolution No. 96 -5. There were no objections. VI. Announcements. A. Meeting Dates 1. Regular Meeting /Public Hearing -June 7, 1996 at 9 A.M. 2. Regular Meeting /Public Hearing -July 19, 1996 at 9 A.M. 3. Regular Meeting /Public Hearing- August 7, 1996 at 9 A.M. These announcements were made by Mayor Koch. Commissioner Armour and Commissioner True advised that they would not be available for the meeting scheduled for June 7, 1996. VII. Reports. A. Town Manager 1. Bi- monthly water consumption Town Manager Harrington reported that while water consumption is a little above that of last year at this time, last year was a very large reduction from previous years. 2. Update on property maintenance at 800 Tangerine Way Mr. Harrington advised that quotations ranging from $985.00 to $1,500.00 to cover the cost of mowing and pruning the growth at this locations had been received. He further advised that he will be speaking to the contractor submitting the $985.00 proposal within the next few days to make certain this quotation covers all work that is being requested. He expected to have this work done very soon. Mr. Harrington stated that Mrs. Bordeman has shown an interest in meeting with Commissioner Armour and others with regard to her financial position now and in the future. Mr. Harrington advised that he is looking into some possible alternatives to planting a hedge in front of this property, pointing out that it will be very expensive to plant and will be a constant expense to maintain in the future. REGULAR MEETING -TOWN COMMISSION May 10, 1996 page 2 B. Town Attorney There was no report from the Town Attorney. C. Architectural Review and Planning Board 1. Future Meeting Dates a. May 22, 1996 at 8:30 A.M. b. June 17, 1996 at 8:30 A.M. C. July 8, 1996 at 8:30 A.M. d. September 25, 1996 at 8:30 A.M. �) e. October 30, 1996 at 8:30 A.M. These announcements were made by Town Manager Harrington. D. Finance Director 1. Financial Report for April, 1996 William Gwynn, Finance Director, reported that while the amount of ad valoren tax collected for the month of Anril was only $1,378.17, a check in the amount of $32,000 had been received on May 2, 1996. When taking this into consideration, 93.8% of this yearb ad valorem proceeds has been received. Mr. Gwynn pointed out that collected revenues are $6,000 over what was anticipated and expenditures are $36,500 under what had been anticipated for this portion of the fiscal year. With regard to the water fund, he reported that net revenues are $8,600 ahead of what was anticipated. Commis- sioner Armour moved and Commissioner Orthwein seconded that the report be approved as presented. Roll Call: Comm. Orthwein; AYE, Comm. Cross; AYE, Comm. Armour; AYE, Comm. Town Manager Harrington reported that this would be the last meeting that Mr. Gwynn would be attending even though he would still be participating in maintaining the financial records of the Town for another two months, at which time William Thrasher will assume the duties of Finance Director. Mr. Harrington thanked Mr. Gwynn for his many years of service to the Town in several positions. Mayor Koch and.the members of the Commission joined in expressing their appreciation as well. Mr. Harrington then introduced Mr. Thrasher to the Commission and the public. E. Police Chief 1. Report of activity for April, 1996 Police Chief Robert Schultz presented the activity report for April, 1996. Chief'Schul:t:z advised that he had attended a Local Emergency Management Network meeting at the Palm Beach County Emergency Operations Center which had focused on hurricane season,Also., Officer Sindone had attended a county- wide intelligence meeting held at the Palm Beach County Sheriffs Office for the purpose of exchanging information regarding criminal activity and street gang activity in the county. F. Construction in Progress in April, 1996 The report reflected there to be $5,853,865 worth of construction in progress in April, 1996 in Gulf Stream. C' VIII. Items for Commission Action. A. Authorization to paint white lines on pavement at corners Town Manager reported that he had contacted the contractor who currently holds the contract for such work with Palm Beach County and had been advised that there is a $900 minimum charge which would cover approximately 1,700 feet. He advised that, with the agreement of the Commission, he will be obtaining other quotations and making a final determination as to the number of feet that would be involved in this project. There were no objections to this. B. Items by Commissioners 1. Development of vacant property along the Intracoastal Waterway in Delray Beach -Mayor Koch REGULAR MEETING -TOWN COMMISSION May 10, 1996 page 3 Mayor Koch reminded that William Lynch, President of the Place Au Soleil Homeowners Association had reported at the last meeting that he had attended a meeting in Delray Beach at which the rezoning of property south of Place Au Soleil had been considered. He further advised that the developer was requesting a large increase in density. Mr. Harrington then noted that this property is across the waterway from the south end of the golf course and the subdivisions in the south end of Gulf Stream and development of the property on the west side of the waterway will have an impact on C} these properties. Town Manager Harrington advised that he had spoken to the Planning Director in Delray Beach and made her aware of Gulf Stream's concerns. He went on to advise that there is no final text of the proposed Delray Plan Amendments for review as yet,so it is not possible for Gulf Stream to take a position on this at this time. He called attention to a letter from Mayor Koch that is proposed to be sent to the Mayor and Commission in Delray that expresses some general concerns regarding development of this parcel. He also called attention to a proposed letter he has written to the Palm Beach County Issues Forum with regard to the proposed Delray Beach Plan Amendment in which he reqeuests that the processes offered by IPARC remain available to Gulf Stream, and that the deadlines for issuing a Notice of Intent to Object or an Objection be extended to provide Gulf Stream sufficient time to review the documents when they are available. Commissioner Armour moved and Commissioner Orthwein seconded that both of the letters be sent. Roll Call: Comm. Orthwein; AYE, Comm. Cross; AYE; Comm. Armour; AYE, Comm. Resolution No. 96 -5; A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, FLORIDA, REQUESTING GOVERNOR LAWTON CHILES TO LET HB 1799/SB 3032 BECOME LAW AND PERMIT THE TOWN OF GULF STREAM TO RESTORE THE SCENIC AND HISTORIC CHARACTER OF STATE ROAD AlA IN THE TOWN OF GULF STREAM; AND PROVIDING AN EFFECTIVE DATE. The resolution was read by the Town Clerk. Town Manager Harrington advised that if this is adopted, he would like to send a transmittal letter and copies of the study that had been done which justifies the restoration of the historic character of AlA. Commissioner Armour moved for the adoption of Resolution No. 96 -5 and Commissioner Orthwein seconded the motion. Roll Call: Comm. Orthwein; AYE, Comm. Cross; AYE, Comm. Armour; AYE, Comm. True; AYE, and Mayor Koch; AYE. Mr. Harrington then called attention to the recent news articles regarding the legislative action that was taken on House Bill 1799 and Senate Bill 3032. He pointed out that the articles were for the most part very negative C and a great many of the facts contained therein were erroneous. He stated that he had written some proposed letters to send to the press for the Commissions consideration. Discussion was held with regard to the proposed letters and it was determined that no further communication with the press would be necessary at this time. IX. Public. There was no comment from the public. X. Adjournment. Commissioner Armour moved to adjourn and the motion was seconded by Commissioner Cross. Mayor Koch adjourned the meeting at 9:50 A.M. following a unanimous vote to do so. Rita L.
