Members present: Mayor, Wayne Neddermeyer; Clerk, Donna Roehl; Councilmembers, Thomas Crosby, Arthur Theis, William Reiser, Nancy Laurent; Planning and Zoning Administrator, Jeanne Mabusth; Attorney, Richard Schieffer Minutes of October 18, 1977: Page 180, Item 10, Driveway agreements: Wayne Neddermeyer suggested that the Public Works Dept. install culverts onto private driveways because of faulty culvert installation in some areas. Ron Duran will look into the cost. Page 178, Item 1: Nancy Laurent asked that sentence regarding picking up assessments on tax forfeit lots, be stricken, as that idea was not her quotation. Page 179, Item 4: Nancy Laurent asked that an item be added to the motion for approval: "Developer to pay cost of administrative, legal and engineering fees." Motion by Thomas Crosby, seconded by William Reiser to approve the minutes of October 18, 1977 as corrected. Motion carried unanimously 1. HACKAMORE ROAD REPAIR Ron Duran discussed cost sharing with Corcoran to repair a 60-80 ft. length of Ha.ckamore Rd. it would mean digging to a depth of 3-4 feet, refilling and graveling. Motion by Thomas Crosby, seconded by William Reiser to spend up to $500, in cooperation with Corcoran, to repair 60-80 ft. of Hackamore Rd. The $500 to be not more than one-half of the total expenses. Motion carried unanimously 2. NORTHWESTERN BELL TELEPHONE Motion by Nancy Laurent, seconded by Arthur Theis to adopt Resolution 77-41 allowing North- western Bell to bury cable along Haokamore Rd. Motion carried unanimously 3. MINNESOTA GAS COMPANY Motion by Nancy Laurent, seconded by William Reiser to adopt Resolution 77-42 allowing Minnesota Gas Co. to install gas line on Hickory Dr, in Medina Creekside Addition. Motion carried unanimously 4. TANDEM TRUCK REPAIR Ron Duran explained transmission problem and information received regarding repair. He stated that it could be driven, as is, recondition or install a new transmission. A new transmission would not be available until April of '78. Thomas Crosby felt that truck should be driven, as is. 5. DAYID GATES, MEDINA CREEKSIDE Ron Duran stated that gravel has passed site inspection. Nancy Laurent stated that Mr. Gates knows what he has to do and that is the blacktopping. 6. POLICE CAR Chief Hoover stated that the bids for police cars have been tabulated by Hennepin County and that they are purchasing Plymouth Fury's at $5416 but that he had contacted Malkerson Pontiac and we could buy the pontiac at the bid price of $5734.57. Motion by Thomas Crosby, seconded by Nancy Laurent to purchase a Pontiac Catalina at $ 5734.57 in cooperation with Hennepin County Purchasing. Motion carried unanimously 7. HEALTH CENTRAL Sylvan Bauer of Health Central explained their Life Support System that is located at Loretto. He explained that they have one full time person on duty at all times and are staffed by volunteers from the area who must be from 3 - 4 minutes driving time, away from the station. He explained the difference between advanced and basic systems is the staff and the fact that advanced can administer drags. Thomas Crosby asked that the Police Chief notify the Hennepin County dispatcher to make them aware of the service that is available in the area. 185 8. HUNTING REGULATIONS Thomas Crosby stated that Officer Rouillard had discussed with him the possibility of having a hunting permit system, whereby permits for hunting would be issued at city hall. He asked the Police Chief to make recommendations regarding hunting regulations. 9. TRA CORPORATION, MEDINA MOTOR INN Lyle Swanson stated that Council must decide whether or not to allow connection of a 100 unit motel to the Hamel Sewer. He presented the following statistics:(a.) Plant is at 80% capacity (b.) 40-50 single family homes could connect to the sewer before capacity Could be reached (c.) the motel would be equivelant to 20-30 homes. e also advised talking with Plymouth and Metropolitan Sewer regarding an interceptor to Bonnect to the Medina sewer. ancy Laurent asked if it could wait until the Comprehensive plan is approved by Metro. Wayne Neddermeyer stated that we should have a letter on file with Metro stating that this is part of Iledina's Comprehensive plan. Discussion of whether or not property owners in the Hamel area should be notified. Motion by Thomas Crosby, seconded by Arthur Theis to schedule a public hearing for November 15, 1978 at 8:00 P.M. to discuss the issuance of a sewer and water permit to serve a 100 unit motel in Hamel. Motion carried unanimously Consensus of the council was to agree with the project unless something unseen develops. 10. JERRY GOBEL,BURGESS 7AKESHORE ESTATES Mr. Gobel appeared to explain that they are securing a bid for completion of road work in the Burgess akeshore Estates plat. The contractor will guarantee his bid price to be good next spring. He asked for the release of Mr. Burgess' original $10,000 bond and an extension of completion date to July 15, 1978. Wayne Neddermeyer felt that if a binding contract could be secured then the Burgess bond could be released. Motion by Thomas Crosby, seconded by Arthur Theis to release the Dennis Burgess bond when the city engineer is satisfied that the bid for road completion would leave the city with sufficient bonds in place to guarantee completion of the road in the Burgess Lakeshore plat, completion date to be July 15, 1978 and that item be placed on the November 15th agenda. Motion carried unanimously 11. PLANNER Motion by Nancy Laurent, seconded by Thomas Crosby to authorize the city attorney to spend time reading the contract as presented by Sovik, Mathre, Sathrum and Quanbeck and advise Council. Motion carried unaiaimously 12. PLANNING COMMISSION MEMBER Discussion of vacancy on the Planning Commission and the absence of some members at meetings Thomas Crosby suggested asking the Planning Commission to discuss attendence, committment to the appointment and their opinion as to the number of members they felt should be on the commission. 13. PIONEER CREEK AGREEMENT Richard Schieffer explained that the agreement is similar to the Elm Creek agreement but that some items are omitted so as not to create controversy. He listed several areas in which the organization would work, such as wetlands ordinances, flood control, trails and conservation. If organized they would become eligible for Federal funds. Eventually this will cost the member cities some money but for now the Hennepin County Conservation district is underwriting the organizational costs. Motion byThomas Crosby, seconded by Arthur Theis to authorize the Mayor and Clerk to enter into the Pioneer Creek agreement and forward to the City of Independence for their signatures. Motion carried unanimously 18 () 14. ROAD GRADER REPAIRS Discussion of repair check list completed by Ziegler and their recommendations as to basic repairs needed. Richard Schieffer stated that an itemized list of costs and a warranty should be secured. 15. LEO LEVER Discussion of Mr. Leuer's Workmen's Compensation claim. Thomas Crosby advised the att- orney to call Minnesota Claims Service to make a determination as to whether or not the city should become involved in the claim. 16. SThVb BENEDICT, TAX FORFEIT LOTS Donna Roehl explained Mr. Benedicts request to secure Lot 8, Block 21 in Independence Beach and combine with Lot 7 which has a sewer assessment and also to secure Lots 9 and 10, combine and be charged 1 assessment. Motion by William Reiser, seconded by Nancy Laurent to authorize the City attorney to request anappraisal by Hennepin County of Lots 8,9 and 10, Block 21, in Independence Beach. Motion carried unanimously 17. HENNEPIN COUNTY COURT FACILITIES Nancy T,Anrent explained resolution regarding maintaining court facilities at the various suburban sites rather than have all cases transferred to the Government center. Richard Schieffer as chairman of the Court Prosecutors Assn. explained their favoring the resolution. Motion by Thomas Crosby, seconded by Nancy Laurent to approve Resolution 77-43 regarding courts in Hennepin County. Motion carried unanimously 18. ENTERPRISE PROPERTIES Motion by Arthur Theis, seconded by Nancy Laurent to accept Enterprise Properties road as a city street on the recommendation and approval of the city engineer. Motion carried unanimously 19. JU.ERT DIVISION (BLACKFOOT TRAIL) Lyle Swanson stated that he has given the contractor a list of things to do before accept- ance of the road. Jeanne Mabusth stated that there are 2 houses being built and the road has not been accepted by the city. 20. HUNTER FARMS Discussion of letter regarding a request for an extension of time to allow completion of roads in the Hunter Farms plat because of delays encountered with road building. Engineer stated that they were having problems with road compaction and he would recommend granting an extension Motion by Thomas Crosby, seconded by William Reiser to approve request of Hunter Farms to extend expiration date of development contract to June 30, 1978. Motion carried unanimously 21. FINE LIMITS Richard Schieffer explained the possibility of raising fine limits to $500. Motion by Nancy Laurent, seconded by Arthur Theis to authorize the City attorney to prepare a model ordinance raising limitations on fines to $500. Motion carried unanimously 22. BUILDING INSPECTOR Discussion with meeting with personnel from Orono regarding their doing Medina's building inspecting. Their fees would be 100% of the plan renewal fee and $25.00 per inspection. Council was reminded that rono is accomodating Medina and this should not be considered a long range arrangement. 23. MINNEHAHA CREEK WATERSHED DISTRICT Clerk informed council that Minnehaha Creek Watershed has approved an expenditure of $1500 to clean ditchs on Deer Hi11 Rd. west of Willow Dr. Engineer is to supply them with a sketch of plans and Public Works Dept. will secure a contractor to do the work. 24. BILLS Motion by William Reiser, seconded by Arthur Theis to pay the bills; Order checks # 7015-7068 in the amount of $27,343.78 and Payroll checks #4677-4701 in the amount of $6134.78. Motion carried unanimously 18 25. MEDINA MORNINGSIDE LAND ACQUISITION Motion by Thomas Crosby, seconded by William Reiser to authorize the Mayor and Clerk to execute the application for conveyance of land described as Lot 12, Block 1, Medina Morningside.
