Present: Mayor, Thomas Anderson; Councilmembers, Anne Heideman, Wilfred Scherer, William Reiser; Clerk -Treasurer, Donna Roehl; Planning and Zoning Administrator, Jo Ellen Hurr; Public Works Supervisor, James Dillman; Police Chief, Michael Sankey; Attorney, Richard Schieffer; Engineers Glen Cook and Paul Pearson. Absent: Councilmember, Thomas Crosby 1. ADDITIONAL AGENDA ITEMS Council agreed to discuss the following additional items: City Newsletter Salaries Frank Davis Drainage problem Willegalla Retaining Wall Medina Motor Inn 2. MINUTES OF OCTOBER 18, 1983 Motion by Heideman, seconded by Scherer to accept minutes of October 18, 1983, as presented. Motion declared carried 3. POLICE DEPARTMENT Police Officer Michael Sankey recommended that Medina hire Jill McCreas as a Police Officer pending satis- factory completion of physical and psychological examinations. He stated that she lived 15 minutes from Medina. Motion by Reiser, Seconded by Scherer to hire Jill McCrea as a police officer according to recommendation of Police Chief at Step 1 of the Union Contract, pending satisfactory com- pletion of testing. Motion declared carried 4. PUBLIC WORKS DEPARTMENT Northwestern Bell Telephone Co. Motion by Reiser, seconded by Scherer to adopt Resolution 83-49, allowing Northwestern Bell Telephone Co. to bury cable at Hamel Rd. and Tower Dr. Motion declared carried Motion by Reiser, seconded by Scherer to adopt Resolution 83-50 allowing Northwestern Bell Telephone Co to bury cable on Hunter Dr. south of Co. Rd. 24. Motion declared carried Hamel Sewer Line Repair Glen Cook presented the following quotes for replacement of sanitary sewer lines between Manholes 24 and 37 north of Hwy. 55: Hennen Construction Co., $9,990; RoSo Contracting, $12,241.30; Nodland Associates, $16,766. Thomas Anderson asked if the work could be delayed until 1984. Glen Cook stated that the city would learn something if this project were completed but it could be delayed because the TRA street would not be completed until 1984. Motion by Scherer, seconded by Heideman to award the sewer line construction work to the Hennen Construction Co. for $9,990. according torecommendation of Engineer Glen Cook. Motion declared carried Medina Morningside Sewer, Willegalla Retaining Wall Paul Pearson explained that he had met with Art Jackson of Nodland and Associates, Jim Dillman, Wilfred Scherer and John willegalla regarding the Willegalla request for a correction of the construction of a retaining wall along the drainage ditch on his prop- erty at 1295 Elsinore Circle. Wilfred Scherer reported that he had suggested that Medina and Nodland each pay one half of the $1300 quote that had been gotten from Sutherland Nursery. Paul Pearson stated that Mr. Jackson had gotten authorization from Al Guenther of Nodlands and he had agreed to the arrangement. Wilfred Scherer explained that the city would then get the signed easements from the 283 Willegalla's. Council discussed how the work should be done. Motion by Scherer, seconded by Heideman to have Nodland pay Medina $650 with Medina to pay the Willegalla's $1300 upon signed easement and that Mr. Willegalla could supervise the project. Motion declared carried 5. HENNEPIN COUNTY LIBRARY David Smith, Assistant Director of the Hennepin County Libraries and Anne Eccles, Director of the Maple Plain, Medina and Long Lake Libraries appeared to discuss future plans for a centralized library facility somewhere in the vicinity of Hwy. 12 and Willow Dr. with the phasing out of the three smaller libraries. Both explained the difficulties and expenses involved in maintaining individual facilities. Council and staff commented on the advantages of the individual smaller libraries and discussed a prior suggestion for location of the larger library on City Hall property. Mr. Smith stated that the location was not satisfactory in that it should be located on a major highway. He also stated that he would keep the city informed of future planning. Motion by Heideman, seconded by Scherer to ask the City Clerk to contact the Hennepin Co. Library Board asking them to consider the Medina site if they indeed believe that it is necessary to close the three smaller libraries. Motion declared carried 6. LYNN WEIFENBACH Lynn Weifenbach presented a petition signed by residents living near the Hamel sewer pond requesting that hunting not be allowed in that area. Motion by Reiser, seconded by Scherer to accept the petition. Motion declared carried She stated that Metro Waste Control would post their property and that the other portion of the property is owned by Denis Jordan. Council discussed the matter and asked Mrs. Weifenbach to contact Mr. Jordan and ask him to post his property and not issue any hunting permits. Mrs. Weifenbach stated that she would contact Mr. Jordan and report back to the Council. 7. PLANNING AND ZONING DEPARTMENT Eldon Eckert, Conditional Use Permit and Variance JoEllen Hurr explained that Mr. Eckert had purchased Lot 5, Block 2, Hunter Farms and wished to construct a 40' x 80' accessory building to store vehicles and equipment used in connect- ion with his cement construction business. She stated that the ordinance allows a 30' x 50' building but it is difficult to find a hardship for this size building. Thomas Anderson stated that a fence could be built to screen items not stored in a smaller building. Richard Schieffer explained that the home occupation category does not allow for conduction of business in an unattached building. Resident of Hunter Farms, Tom Driggers, stated that the neighborhood would take issue with the matter if the Council grants a permit. Richard Scheffer stated that the City has a right to restrict use of a property. Motion by Heideman, seconded by Scherer to allow construction of a 30' x 50' accessory building at 3130 Carriage Dr. not to be used for business related activities; to deny the variance to construct a 40' x 80' building, as no hardhip could be found and to deny the Conditional Use Permit as the business is not one that can be conducted out of a home as allowed in the ordinance. Motion declared carried Hicks Concrete, Variance JOEllen Hurr explained that Hicks Concrete had installed a concrete slab on the west side of their building in the setback area, which is being used for material storage. She stated that the original permit does not allow outside storage nor construction in the set- back area and that the reason for the variance is the fact that it is impossible for a truck to make the turn to unload inside the building. 2 4 Thomas Anderson asked if the slab could be relocated and the parking area revised. Anne Heideman stated that if this business is made to comply then others in the city should also comply. She named two other businessess that have excessive outside storage. Motion by Reiser,seconded by Scherer to deny the variance application of Hicks Concrete to allow concrete slab to remain where constructed at 805 Hamel Rd. and to ask the Zoning Administrator to try to work out some other arrangement for location of the slab which must be removed within 30 days. Motion declared carried Motion by Heideman, seconded by Reiser to authorize the Zoning Administrator and staff to proceed to have the North Star Waterworks and Angel Perez cleaned up. Motion declared carried Morrisson Road Attorney, Betsy Baker, representing Truxton Morrison, appeared to discuss renegotiating the private roadway agreement to allow the road to remain private and not be blacktopped when the fifth building permit is issued. She stated that an easement would be given the city for emergency vehicles over that portion that intersects Hunter Dr. Motion by Heideman, seconded by Reiser to authorize staff to work with the applicant to develop a revised roadway agreement for the Morrison property. Motion declared carried Resource Recovery Site Council discussed the locations in Medina that have been sited for either garbage transfer stated or refuse derived fuel plants. Thomas Anderson stated that he would attend the meeting in Golden Valley on November 9th and will explain that the city will not oppose a site along Hwy. 55 in the Industrial Zone although he did not believe that it is where one is most needed but that the Baker Park area should not be considered for the same reasons that a landfill should not be located on the•property. Medina Motor Inn William Reiser conducted this portion of the meeting in the absence of Mayor Anderson. Attorney, Jim Tiller, appeared to discuss the possibility of the city allowing the Medina Motor Inn to access the property through an easement across the Medina Ballroom property. He stated that the bonding attorney has verbally agreed to the concept but that some assur- ance from the city was needed. He also discussed the possibility of the city constructing the street and storm sewer and assessing the benefiting property owners. He explained that they did have a year and a half to complete the work which they had originally intended to do immediately until extensive soil problems were discovered and road construction costs tripled. He stated that road construction costs were not covered under the bonding. Thomas Anderson stated that the TRA Corporation would like the storm sewer and road to be constructed and assessed against benefiting properties. JoEllen Hurr explained that the cities ordinance does not allow a building to be built unless it abuts a public road. Anne Heideman stated that she had some concern regarding an easement across private prop- erty, in that it might not be sufficient for emergency and pedestrian traffic. Richard Schieffer stated that the city has an easement across the Medina Ballroom property for the Hamel well and something similar could be discussed. Anne Heideman asked if they were looking for flexibility in terms of requirements being met before occupancy of the motel. Mr. Schieffer advised that the Council not commit to constructing storm sewer and street, at this time, and that they could call a special meeting at any time, if necessary. Conco Inc. Council discussed Peter Johnson's variance application to construct a house on Lot 1, Block 1, Leuer's Addition. JoEllen Hurr explained that the variance was necessary due to the size of the lot and the need for a side yard setback less than that required for an alternate septic system site. Council discussed Planning Commissions recommendation not to grant the variance because 2 the property cannot support a conventional septic system and that abutting property owners have had septic problems and have water wells located very near the lot lines. Mr. Johnson stated that he had intended to have his engineer at the meeting but he had been called elsewhere. He did explain that mound septic systems are no longer considered expir- emental. Motion by Heideman, seconded by Scherer to table action on the Conco Inc. Variance application until November 15th, at which time Mr. Johnson's engineer will appear. Motion declared carried Building Inspector, Loren Kohnen, stated that mound septic systems do work and that Medina has a number of them, one being monitored for about five years. He also explained how such a system is installed. 8. SALARIES Anne Heideman stated that Sylvia Rudolph had discussed 1984 salaries with her and had questioned why some employees were receiving more of a percentage raise than others. Council discussed her duties as relating to operating of the computer. Thomas Anderson stated that salaries would be set in January and the matter could be taken care of at that time. 9. FRANK DAVIS Donna Roehl reported that Frank Davis had been requesting that something be done about the drainage problem on his property at 305 Comanche Tr. Glen Cook explained that a drainage easement needs to be cleared out along the south prop- erty lines abutting the Leslie Roy property and that he had called Mrs. Roy and explained how the work should be done so as to allow the wate to run off to Hunter Dr. Mrs. Roehl stated that unless something was done soon Mr. Davis would be at a meeting tell- ing Council he could not get any help from any staff member. Motion by Heideman, seconded by Anderson to have the City Clerk inform Leslie Roy that the work must be done according to the directions of the City Engineer within 10 days or the city would need to do the work and assess her for it. Motion declared carried 10. WAYZATA COMMUNITY EDUCATION Anne Heideman reported that the Wayzata Community Education system is very well organized and has provided a number of classes and programs. She stated that Edris Guest is a Medina representative to the Commission and that another member from Medina is also needed. Council asked that Anne Heideman find another representative. 11. MEDINA JOURNAL Anne Heideman reported that funds had not been budgeted for a city newspaper in 1983 nor 1984. Council discussed the best way in which to proceed if a newsletter is needed. Anne Heideman stated that she would discuss the matter with Sandra Vrooman. 12. BILLS Motion by Heideman, seconded by Scherer to pay the bills; Order Checks # 2453 - 2508 in the amount of $ 36,161.20 and Payroll Checks # 7379 - 7401 in the amount of $11,247.04.
