Mayor Briggs called the regular meeting of the City Council to order at 7 :35 p.m. on Tuesday, October 3, 1972, in the Council Chambers of the City Hall. 2. The invocation was given by the Reverend Kenneth Grant, Pastor, Westminister Presbyterian Church, 9642 E. Live Oak, Temple City. 3. The Pledge of Allegiance to the Flag was led by Mayor Briggs. 4. ROLL CALL: Present: Councilmen - Dennis, Gilbertson, Merritt, Tyrell, Briggs Absent: Councilmen -None Also Present: City Manager Koski, City Attorney Martin, Planning Director Dragicevich. APPROVAL OF MINUTES: Councilman Merritt noted that the 3rd paragraph of Item 9, Page 2, of the minutes of the Regular Meeting of September 19, 1972, should indicate Councilman Merritt seconded the motion. There being no further corrections, Councilman Merritt moved to accept the minutes as corrected, seconded by Councilman Gilbertson and unanimously carried. The Temple City Business and Professional Women's Club, Mrs. Willietta Kunz, President, was given recognition by Mayor Briggs who presented a special certificate to the president and members present, in recognition of the community effort put forth by that organization. Mayor Briggs also proclaimed the week of October 15 -22, 1972 as National Business Women's Week. Mrs. Kunz de- scribed the aims and goals of the organization and introduced her members. UNFINISHED BUSINESS: 6. ORDINANCE No. 72 -361: 1st read. Re. Repeal of Moratoria Imposed by Ordinance Nos. 71-340 and 72 -344. City Manager Koski advised that pursuant to Ordinance Nos. 71 -340 and 72-344, extended by Ordinance Nos. 72 -343 and 72 -347, the moratoria on building and occupancy permits in the Rosemead Boulevard Development Area will expire on February 15, 1973. He further advised that the Community Redevelopment Agency would still retain control over the issuance of building permits in the Project Area upon removal of the moratoria for which the City Attorney had been instructed to prepare an ordinance. City Attorney Martin presented Ordinance No 72-361 en- titled AN ORDINANCE OF THE CITY OF TEMPLE CITY REPEALING THE MORATORIA IMPOSED BY ORDINANCE NOS. 71 -340 and 72 -344, Councilman Tyrell moved to waive further reading, seconded by Councilman Dennis and unanimously carried. Council Minutes, October 3, 1972 - Page 2 NEW BUSINESS: 7, EMPLOYMENT OF PERSONNEL: A. RESOLUTION No. 72 -1235 - Crossing Guards. Councilman Gilbertson moved to adopt Resolution No. 72 -1235 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY`OF TEMPLE CITY'APPOINTING CROSSING GUARDS, seconded by Councilman Tyrell and unanimously carried. B. RESOLUTION No. 72 -1236 - Recreation Personnel. Councilman Merritt moved to adopt'Resolution No. 72 -1236 entitled A. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING TEMPORARY PERSONNEL, seconded by - Councilman Gilbertson and unanimously carried. RESOLUTION'No. 72 -1237: WARRANTS & DEMANDS, Demand Nos. 6642 through 6716 in the amount of $46,352.68. Councilman Merritt moved to adopt Resolution No. 72 -1237 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM 'OF $46,352.68, DEMAND NOS. 6642 THROUGH .6716, seconded by Councilman Gilbertson and unanimously carried. 9. COMMUNICATIONS: A. Request to waive additional requirement - CUP No, 72 -375, Re. Service Station, Las Tunas and Oak. City Manager Koski presented a communication from the law offices of Lawler, Felix and Hall in behalf of Standard Oil, dated September 27, requesting the City Council to waive that certain condition which would require Standard Oil to maintain a lease on the present site as nonfunctional for a period of 7 months before technical abandonment, as a requirement of Conditional Use Permit No. 72-375, granted by the Planning Commission. on August 22, 1972, for service station to be located at the nw corner of Oak and Las Tunas. Councilman Gilbertson moved to waive the requirement, seconded by Councilman Merritt and unanimously carried. City 'Attorney Martin advised that technically the request by the Council could not be imposed as a condition. B. Damage Claim - Mrs. Russell D. Teresa City Manager Koski presented a claim for property damage from Mrs. Russell D. Teresa, .5741 Primrose Avenue, for damage to a camper purported to have been caused by a parkway tree, which accident had occurred on July 31, 1972. Four estimates of damage were enclosed. Councilman Tyrell moved to deny the claim and to refer the matter to the City's insuring agency, seconded by Councilman Gilbertson and unanimously carried. 10. TIME FOR THOSE IN AUDIENCE WHO WISH TO SPEAK: Boyce O'Bannon, 10316 E. Olive, Temple City, spoke to the matter that any Revenue Sharing Federal Funds which may be received by the City be used for street lighting improvement projects. .Council Minutes, October 3, 1972 - Page 3 . At 7:59 p.m., Council recessed .to meet as .the Community :Redevel - opment Agency. 11. COMMUNITY REDEVELOPMENT AGENCY:ACTION: Council convened as the Community Redevelopment Agency, all members being present; approved the minutes of regular meet- ing . of June 2.Q, L972; ., requested the City Council, to appro- priate an additional-amount-of $495 ;2.5 to meet current obligations and. to approve payment of $69.1,.25 for legal services; extended agreement with Eltinge, Graziadio and Sampson, developers, to December 15, 1972; and authorized the preparation of report on possible modification of boundaries for the Rosemead Boulevard Redevelopment Project area; adjourning at 8:05 p.m. The minutes of the CRA are set forth in full in the records of the Agency. Council reconvened at 8:05 p.m. 12. MATTERS FROM CITY OFFICIALS: A. City Manager Koski presented request from the Community Redevelopment Agency to appropriate an amount of $495;25 to . meet current obligations of the Agency. Councilman Gilbertson moved to appropriate $495.25 from the general fund as requested by the CRA, and to amend the adopted budget accordingly, B. RESOLUTION No. 72-1238 - Transfer of Petty Cash Fund to Jane Hill. Councilman Tyrell moved to adopt Resolution No. 72 -1238 en- titled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY TRANSFERRING CUSTODIAN. OF PETTY CASH FUND, seconded by Councilman.Merritt and unanimously carried. C. Purchase of Property - Live Oak Park Addition: 5603 Gracewood Avenue City Manager Koski advised that negotiations had been com- pleted to purchase property at 5603 Gracewood Avenue for Live Oak Park addition, in the amount of $35,500., which purchase was now ready to enter escrow. Councilman Tyrell moved to approve the purchase of the subject property in the amount of $35,500., and to authorize the Mayor and City Clerk to sign the escrow instructions. The motion was seconded by Council- man Gilbertson and unanimously carried. Council instructed the City, Manager to continue to negotiate for the adjacent parcel of property at 5601 Gracewood. D. Signing, Striping and Pavement Marking Services Study. City Manager Koski reported on study that had been reviewed by the Council at Study Session held on October 2, 1972, outlining staff recommendations to be considered as policy in regard to signing, striping and pavement marking services, as set forth in report dated September 19, 1972. Councilman Tyrell moved to accept the staff report and approve as policy, seconded by Councilman Merritt and unanimously carried. E. Councilman Dennis advised that he had received a call from 'a resident relative to speeding . problems on Encinita. Council inquired if there has ever been a Traffic Commission Study on speed problems on Encinita, and discussed possible additional enforcement and additional speed limit signing that may be needed. The matter was referred to the Traffic Commission for study and report back to the Council. 1 1 1 Council Minutes, October 3, 1972 - Page 4 F. Councilman Gilbertson suggested that copies of the letter written by Mayor Briggs to Governor Reagan requesting the appointment of City Attorney Martin to a Task Force Committee to study the matter of Local Government to make recommendations for improving efficiency and accountability to the public, be forwarded to the other cities for which Mr. Martin or Mr. Flandrick serve as City Attorney. G. Environmental Impact Reports - Building Permits. City Attorney Martin advised that a mass of material has been forwarded to the City Council dealing with environ- mental impact reports, and stated that it is his inter- pretation that the requirement set forth in the Environmental Quality Act was never intended to stop day today activity of the City and the issuance of administrative permits by the building officials of the City. He stated that this City will proceed to issue building permits and will continue to issue such permits unless this City Council determines otherwise, although many other agencies have interpreted the Act to the contrary and have stopped all permits. He stated that the time element involved for submission of environmental impact report before the Planning Commission with due process hearing held before that body involving notice, and another notice and hearing before the City Council during which time no building permit could be issued, may be as much as 6 months, and that it was his opinion that day to day business must be continued and people must be en- titled to building permits in the interim There being no Council instruction to the contrary, City Attorney Martin advised that this City will continue to issue administrative day to day permits. 13 ADJOURNMENT There being no further business, the meeting was adjourned at 8:10 p.m. by, Mayor Briggs.
