SUMMARY STATEMENT: Staff found that the City Council approved, by motion, a process to fairly, consistently, and
objectively handle utility hardship requests at the regular meeting held on January 14, 1999. At the same meeting, Council also suggested that approved hardships be reviewed on an annual
basis. The approved definitions and processes for new hardships and renewals are outlined in the attached document.
As a result of discussions at recent Council meetings, staff contacted
Valley County to determine how they handle discussions of indigent cases. The County stated that the Commissioners do discuss indigent cases in closed session, but that the documents
they are given for review only include information on the applicant’s age, income, medical needs, etc. All names are redacted and identity is not discussed during the meetings.
Staff
also discussed this issue with the City Attorney, and it is our conclusion that the current hardship process includes objective financial based qualifications. We would advise against
revealing the identity of the applicant as it would make it difficult to show a fair and impartial method for evaluating the applicant.
