Call to Order and Introduction of Members, Ex-Officio Members and Staff Chairman Hake called the meeting to order at 7:30 a.m. and introduced Board members and asked staff to introduce themselves. A quorum was present to hear the items on the agenda. The following members were designated to vote: Hake, Lacy, Crabtree, Seaver and Cartwright. Those wishing to speak to the Board were sworn in. 2. Procedures Explained Chairman Hake explained the procedures of the meeting. Ms. Bliss entered the following documents as exhibits for all items under consideration at the meeting: 1. The City Code of the City of Jefferson, as amended 2. The Comprehensive Plan and Land Use Map 3. Copies of applications under consideration 4. Minutes/Jefferson City Board of Adjustment Page 2 February 8, 2022 6. New Business — Public Hearing Case No. B22002 — 639 Airport Road; Variance from Flood Plain Regulations. Request filed by Curtis Manes Schulte, applicant, for property leased by SNK Real Property Holdings, Inc and owned by the City of Jefferson, for a variance to floodplain regulations. The purpose of the request is to permit construction of a 100.26 x 75 feet airport hangar building addition as a wet-fl ood proofed structure to an existing 12,842 square foot hangar. The property is described as part of the Northeast Quarter of Section 16. Township 44 North. Range 11 West, Jefferson City, Callaway County, Missouri. Ms. Bliss explained this proposal for a variance to floodplain regulations would permit wet floodproofing by allowing the use of engineered flood vents that allow for the automatic entry and exit of floodwater to be incorporated into the construction of a 100.26-foot by 75-foot addition to an existing airplane hangar, similar to other existing hangars at the Jefferson City Memorial Airport. The Flood Code allows wet floodproofing of accessory structures up to 400 square feet. The proposed hangar exceeds the allowable square footage, and the building would not be considered an accessory structure, which is why a variance is requested. Mr. Fontana said code allows for floodproofing structures up to 400 square ft. There would need to be an appropriate number of flood vents and have the airport evacuation plan to be updated to include this hanger. Brian McMillian 2500 East McCarty with Central Missouri Professional Services, presented the case. He stated they drew up the plans and are happy to get an evacuation plan drawn up. Mr. Barron stated that this is treated as a variance and a list of required finding must be met. Those findings are listed in the packet. Mr. Crabtree moved and Mr. Seaver seconded to approve of the requested Variance from Floodplain Regulations, with the following condition: Submittal and approval of Flood Vent calculations, and submittal and approval of a Flood Evacuation Plan. The motion passed 5-0 with the following votes: Aye: Hake, Lacy, Crabtree, Seaver and Cartwright Nay: None. 7. Miscellaneous Reports None 8. Other Business Mr. Hake mentioned there has been discussion about moving the meeting time to an evening time slot and asked the Board members to think about the potential of moving the meeting time. 9. STAFF REPORT BOARD OF ADJUSTMENT — CITY OF JEFFERSON, MISSOURI April 12, 2022 Case No. B22003 — 2436 Missouri Boulevard, Conditional Use Permit. Request filed by Eragon properties LLC., property owner, on behalf of Cross Development, applicant, for a Conditional Use Permit for a motor vehicle body shop in a C-2 General Commercial Zoning District. The property is located at the northwest corner of the intersection of St. Mary's Boulevard and Missouri Boulevard and is described as part of East Half of the Northwest Quarter of Section 11, Township 44 North, Range 12 West, In the City of Jefferson, Missouri (Oxford Architecture, Consultant). PUBLIC NOTICE By publication in the newspaper, letter to adjacent and affected property owners within 185 feet, and by property sign posting. NATURE OF REQUEST A request was filed for a conditional use permit for an existing building for a vehicle body shop on a 1.85 acre lot located within a C-2 General Commercial zoning district. Vehicle body shops are a conditional use and therefore, not a use by right. A conditional use permit is necessary pursuant to specifications held within the City Code. Such sections include but are not limited to Section 35-73, A, which details administrative approval of development permits, and Section 35-28, which deems such automobile oriented shop as a conditional use within the C-2 zoning designation. Zoning and Surrounding Land Us The subject property is zoned C-2 General Commercial Surrounding Zoning Surrounding Uses North C-2 & RS-1 Commercial/Single Family Residential South C-2 Commercial/Retail/Gas Station East C-2 Commercial/Storage West C-2 Commercial/Retail STAFF ANALYSIS NOTABLE SITE CONFIGURATION / IMPACT MITIGATION Within the site plan and application materials are notable details regarding site operations as a vehicle body shop with outdoor storage. Wrecked vehicles will be stored in the rear portion of the site. The wrecked vehicles sit in this rear parking lot until they are brought into the shop for repair. Once fixed - up, the cars are parked in the west lot. Notes on the site plan indicate galvanized (2" mesh) fabric fencing and the fence will be 6' in height. The fencing fabric will have tan privacy slats as specified on supporting documentation such as the site plan. Dumpsters will be enclosed. A fire hydrant may need to be added to the north/rear portion of the site as deemed appropriate by the City of Jefferson Fire Department. FINDINGS REQUIRED The applicant has provided responses to the required findings. In reviewing this case, the Board may wish to consider the following questions: 1. Are there any practical difficulties unique to this property which under strict and literal adherence to the provisions of the zoning regulations would cause the applicant an unnecessary hardship? 2. Would the appearance and value of surrounding properties be damaged if the variance is granted? Findings for Conditional Use Permit 1 tie toliowing tindings are associated with conditional use permits. (Section 35-73.A.4 Finding The proposed use is consistent with the goals, objectives, and policies of the Comprehensive Plan. The proposed use complies with all applicable provisions of the zoning district regulations and conforms to the general intent and purpose of the Zoning Ordinance The proposed use complies with all fire, health, building, plumbing, electrical and storm water drainage regulations of the City and regulations of County, state and federal agencies. The proposed conditional use is not materially detrimental to the public health, safety, convenience and welfare, or results in material damage or prejudice to other property in the vicinity. The proposed use is compatible with and preserves the character and integrity of adjacent development and includes improvements to mitigate adverse development -related impacts, such as traffic, noise, odors, visual nuisances, or other similar adverse effects to adjacent development and neighborhoods. The proposed use does not generate pedestrian and vehicular traffic which will be hazardous to the existing and anticipated traffic in the neighborhood. Adequate utilities exist to serve the proposed conditional use. Comments The property is zoned C-2 and designated as intended for commercial use on the development plan map of the comprehensive plan. Use of the property as vehicle body shop is an appropriate commercial use. The site development appears to comply with all applicable zoning district regulations and provisions to the general intent and purposes of the Zoning Ordinance. Based on the site plan provided, all applicable City, County, State, and Federal regulations appear to be met. This proposed development plan is subject to any comments of such listed entities as appropriately deemed necessary. With a storage facility and car dealer nearby in addition to being surrounded by a variety of commercial uses, this proposed use, a vehicle body shop, does not appear to be materially detrimental to the public health, safety, convenience and welfare, or results in material damage or prejudice to other property in the vicinity. The impact of adverse development -related impacts by factors such as the outdoor storage of wrecked vehicles is suggested within the application and site plan to be mitigated through a fenced -in storage area (using galvanized, screen fencing) in the rear of the property. There are also designated locations noted on request documentation as to where cars will be worked on and stored for pick up by car owners. The proposed use of a vehicle body shop would not generate a dangerous level of pedestrian and vehicular traffic. Adequate utilities exist in the area to serve the development. STAFF RECOMMENDATION The use of a screening fence and additional landscaping helps to mitigate the visual nuisance of outdoor storage. (Section 35-73.A.4) Property Address2436 Missouri Boulevard Applicant NameCross Development Provide responses to the following required findings. State all reasons for your answer and use additional pages to complete your answer if necessary. Findings of Fact: 1. Is the proposed use consistent with the goals, objectives and policies of the Comprehensive Plan? Yes, it is consistent with the comprehensive plan by enhancing Jefferson City's workforce opportunities, as well as, redesigning an existing buiding and refreshing the site. 2. Does the proposed use comply with all applicable provisions of the zoning district regulations and conform to the general intent and purpose of the Zoning Code? Yes, the paint booth is inside and only water based paint is used. The booth's performance exceeds all EPA regulated standards. The construction of the building reduces exterior noise levels and all work is completed indoors under a controlled enviornment. Service bay doors auto - close upon vehicle entry/exit to limit any noise on the exterior of the building. 3. Does the proposed use comply with all applicable fire, health, building, plumbing, electrical and stormwater drainage regulations? Yes ,the proposed use complies with all regulations mentioned above. 4. Is the proposed conditional use materially detrimental to the public health, safety, convenience and welfare or does it result in material damage or prejudice to other property in the vicinity? No it does not. The wrecked cars enter the North parking field in the back screened fenced in car storage area where they are examined and parts are ordered. The wrecked cars are not visible from the public and sit 1-3 days for parts to be delivered. Then they are taken into the shop and all repairs are completed. When the car is completed it will exit the building and be parked in the west lot for the owner to come pick up the car. There will be a screen fence around the back of the facility to house the cars before they are brought into the building for repairs. This process allows us to be a good neighbor to our surrounding businesses. 6.
