COUNCIL MINUTES
OCTOBER 17, 1972
INITIATION:
1. Mayor Briggs called the regular meeting of the City Council to
order at 7:32 p.m. on Tuesday, October 17, 1972, in the Council
Chambers of the City Hall.
2. The invocation was given by the Reverend Father Eamon O'Gorman,
Assistant Pastor, St. Luke's Catholic Church, Broadway at Cloverly.
The Pledge of Allegiance to the Flag was led by Mayor Briggs.
ROLL CALL:
Present: Councilmen - Dennis, Gilbertson, Merritt„ Tyrell, Briggs
Absent: Councilmen -None
Also Present: City Manager Koski, City Attorney Martin, Civil
Engineering Assistant Linares, Recreation Director Kobett.
. APPROVAL OF MINUTES:
Councilman Merritt noted that Item 12A in the minutes of regular
meeting of Tuesday, October 3, 1972, should include "Councilman
Dennis seconded the motion which carried unanimously." Council-
man Gilbertson moved to approve the minutes as corrected, seconded
by Councilman Dennis and unanimously carried.
Prior to consideration of agenda items, Council concurred in the appoint-
ment of Darryl 0. Bender to the‘ Traffic Commission fora: term, ;of:ofEie.e<p.ir-
ing!June 30, 1974, with the appointee then being sworn in by the City Clerk.
IUNFINISHED BUSINESS:
6. ORDINANCE No. 72 -361 : 2nd read. Re. Repeal of, Morator i a'
Imposed by Ordinance Nos. 71 -340 and 72 -344.
City Attorney Martin presented Ordinance No. 72 -361 entitled
AN ORDINANCE OF THE CITY OF TEMPLE CITY REPEALING THE MORATORIA
IMPOSED BY ORDINANCE NOS. 71 -340 AND 72 -344, Councilman Gilbertson
moved to waive further reading and adopt, seconded by Councilman
Tyrell and unanimously carried.
7. AGREEMENT: RISSMAN REALTY & CITY OF TEMPLE CITY - Re. Installation
of Traffic Signal, Lower Azusa Road at Halifax.
City Attorney Martin presented agreement between the City of Temple
City and Rissman Realty, wherein the City agrees to install a traffic
signal at Halifax Road and Lower Azusa Road,in cooperation with the
City of El Monte and the County of Los Angeles, wherein Rissman
Realty will participate in 25% of installation charges (but not
to exceed $4,000), which proposed agreement had been reviewed by
Rissman Realty and acceptable to therm. Councilman Merritt moved
to approve the agreement and to authorize the Mayor and City Clerk
to sign, seconded by Councilman Dennis and unanimously carried.
II NEW BUSINESS:
8. RECOMMENDATION FROM TRAFFIC COMMISSION: Meeting of October 4, 1972
LEMON AVENUE, South Side, West of Temple City Boulevard: Replace-
ment of Existing Regulatory Signs.
City 'Manager Koski presented background information, advising that
present signs do not permit stopping to; let rtif_f students cdmVng rto

school, and that the Traffic Commission recommended that
"No Stopping" regulations be changed to 9 a.m. to permit
stopping in the morning hours, but to control the parking
throughout the school day. Councilman Tyrell moved to
approve the replacement of existing with signs reading
"No Stopping 9 AM to 2:30 PM - School Days Only," seconded
by Councilman Merritt and unanimously carried.
RECOMMENDATION FROM PARKS & RECREATION COMMISSION - Meeting
of October 11, 1972.
RECOSPONSORSHIP OF TEMPLE CITY SOCCER CLUB - 1972 -73 Season
City Manager Koski advised that the Temple City Soccer Club
was originally cosponsored by the City in 1962, and that
yearly requests for renewal had been granted by the City for
this serf- governing, and self- sustaining group, and that the
Commission again recommended renewal of reeosponsorship.
Councilman Tyrell moved to approve as recommended, seconded by
Councilman Dennis and unanimously carried.
10. RESOLUTION No. 72 -1239: Employment of Temporary Personnel -
Recreation.
Councilman Tyrell moved to adopt Resolution No. 72 -1239
entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TEMPLE CITY APPOINTING TEMPORARY PERSONNEL, seconded by
Councilman Gilbertson and unanimously carried.
11. RESOLUTION No. 72 -1240: WARRANTS & DEMANDS, Demand Nos.
6717 thru 6782, in the amount of $27,709.32.
Councilman Merritt moved to adopt Resolution No. 72 -1240
entitled A RESOLUTION OF THE. CITY COUNCIL OF THE CITY OF
TEMPLE CITY ALLOWING CLAIMS AND-DEMANDS IN THE_SUM OF
$27,709.32, seconded by Councilman Tyrell : and 'unani.rimous!1y,
carried.
12. COMMUNICATIONS:
A. ALSAC - St. Jude Children's Research - Hospital - Request
to Conduct Teen March, Nov. 10 -12, 1972.
City Manager Koski presented request from St. Jude Children's
Research Hospital for permit for National Door -to -Door Teen
March, Nov. 10 -12, 1972, daylight hours only. Councilman
Tyrell moved to approve, seconded by Councilman Gilbertson
and unanimously carried.
B. Peter D. Hogan - Letter urging sign for deaf child
playing in area.
City Manager Koski presented communication from Mr. and Mrs.
Peter D. Hogan, requesting a sign in the 6300 block of Sultana
indicating that a deaf child was playing in the area to alert
motorists to the special problem of their son. Following
discussion, the Mayor directed the matter to the Traffic
Commission for consideration at their next regular meeting.
Jim Campbell, 9102 Woolley Street, present in the audience
stated that there was a child with muscular dystrophy who
also played in this area and that there was a'problem of
speeding.
C. Jim Campbell, 9102 Woolley, - Request to Conduct Arts
and Crafts Exhibit with movable carts.
A request from Jim Campbell to use movable carts for arts
and crafts exhibit was held in abeyance pending the applicant's
contact with the Merchants' Committee and the Chamber of
Commerce regarding their patronage of the exhibit, number and
size of carts that would be involved and locations involved.

D. Temple City Unified School District - Request for Fireworks
Display at Football Game at Half -Time, October 20, 1972

It was, moved:;byf Councilman Merritt, seconded by Councilman
Gilbertson and unanimously carried to approve the request of
the Temple City Unified School District to provide fireworks
display at half-time activities for homecoming game on Friday,
October 20, 1972, subject to permit from Fire Department and
valid insurance naming the City of Temple City additionally
insured.
E. Temple City Performing Arts Boosters - Appreciation to
Community for City Picnic participation.
A letter from Performing Arts Boosters, Dick Oren, President
expressing appreciation to the City Council and Recreation
Department for the:ii°i:a §sistance and the community in general
for fine turnout at City Picnic held on September 23, 1972,
at which their organization provided a food concess ion as a
fund raising effort to purchase new uniforms for the Rams Band, .
was received by the Council.
13. TIME FOR THOSE IN AUDIENCE WHO WISH TO SPEAK:
There were none.
14. MATTERS FROM CITY OFFICIALS:
A. Council concurred in setting a joint study session with
the Planning Commission, to be for November 20, 1972,
at 7 :30 p.m.
B. City Manager Koski advised that California Contract Cities
Association' Annual Legislative Conference will be held in
Sacramento January 17 -18, 1973.
C. Council set tentative :date for City Seminar for the weekend
of January 27 -28, 1973.
D. Report on Impound Fees.
A staff report on impound fees as they relate to animal control
forthe San Gabriel Valley Humane Society serving the City of
Temple City and other cities, as well as the Los Angeles County
Pound Department, dated October 13, 1972, was reviewed by the
Council. Councilman Tyrell moved to approve staff recommendation
No. 2 (a) as set forth in the report, in an effort to penalize
continuing violators, setting an escalating fee schedule of $5
for first violation, $10 for second and $15 for third violations,
and to authorize the City Manager to sign a letter to the San
Gabriel Valley Humane Society amending these figures. The
motion was seconded by Councilman Gilbertson and unanimously
carried.
E. Sidewalk Construction, Various Locations - M & S Concrete,
Inc.
City Manager Koski advised that M & S Concrete, Inc. had completed
remainder of sidewalk work on Alessandro Avenue and had been
inspected and found acceptable. Councilman Tyrell moved to accept::
the work and approve payment, with 10% to be retained for 35 -day
lien period, seconded by Councilman Dennis and unanimously carried.
F. As a matter of information, City Manager Koski reported that
in accordance with Traffic Commission recommendation of October 4,
1972, a modification of the traffic island at the intersection of
Temple City Boulevard and Ellis Lane, will be accomplished by
painting the configuration of the modified island, extending the

barrier line to include reflectorized markers so that
northbound lanes can merge at Ellis Lane, with a physical
island to be placed inside the painted island to discourage
illegal moves.
G. Also as a matter of information re. Traffic Commission
Recommendation of October 4, 1972, City Manager Koski advised
that the Commission recommended against a signal installation
at the intersection of Temple City Boulevard and Camino Real,
based upon engineering data.
H. Gidley Street - Proposed Improvement.
City Manager Koski advised that a recent staff survey found
the roadway on Gidley Street in need of reconstruction and
that improvements should include curb and gutters, driveway
approaches and sidewalks. He stated there was insufficient
right -of -way on a portion of Gidley Street which prohibits
the construction and improvements and that it would be necessary
to contact property owners and secure the necessary right -of-
way prior to proceeding with any street improvement plans
which would_be included in future budget considerations.
Council;,.concurred in staff request to contact property owners
on Gidley Street for the purpose of acquiring right -of -way
for street construction; to secure title reports; and to
proceed with the preparation of street improvement plans for
the construction of curb, gutters, driveway approaches, side-
walks, and asphalt concrete pavement.
I. Proposition 14 - Watson Initiative.
City Manager Koski presented information from the League of
California Cities relative to Proposition 14, which was
discussed by Council, but no stand taken.
J. Proposition 19 - Legalization of Marijuana.
Councilman Tyrell moved that this Council go on record as
opposition Proposition 19 dealing with the legalization of '
marijuana, stating there is no way to test whether anyone is
under its influence, yet a person under the influence can be
just as irrational or more so than the person under the
influence of liquor. Councilman Merritt concurred and
seconded the motion which carried unanimously.
K. Status of Social Security Withdrawal.
Councilman Gilbertson inquired as-to progress of review of
employee views regarding removal from Social Security. He
was advised that this review will be-accomplished as soon as
new formulas are in effect.
L. Councilman Gilbertson reported on the fine fiscal report
that had been prepared by Jim File and Associates, and the
soundness of the City's financial condition as of June 30, 1972.
M. Councilman Dennis reported on attendance at League of
California Cities Conference in Anaheim, advising that views
expressed at the Conference were not overly sympathetic to
Cities such as ours who were actually being penalized because
they had been fiscally responsible and levied no city tax.
N. Councilman Merritt sought.:Council direction for voting on
Resolutions that would be brought before the League Conference
the next day, when he would be in attendance as voting delegate.
Council concurred to vote Nno" regarding proposed dues increase,
and directed Councilman Merritt to carry out philosphies of
the past for the issues concerned.

0. Councilman Merritt called attention to the presence in the
audience of Al Nygaard, local manager for the Edison Company.
P. Councilman Tyrell called attention to a speeding problem on
Encinita ,. southbound, .approaching Eaton Wash and La Rosa. The
City Manager advised that this item has !Previously been brought
to the attention of the Traffic Engineer who is preparing a
report to be brought to the Traffic Commission at their regular
meeting to be held November 1, 1972.
Q. Mayor Briggs advised that he and the City Manager were
meeting with the Mayor and City Manager of San Gabriel at at
early date on City business; that they will also meet with
Supervisor Schabarum at 6 p.m. on October 30, 1972, in the
supervisor's office; and that a meeting will be up with the
Mayor and City Manager of Arcadia at an early date.
R. Mar Briggs reported on the success of Council /Commission
liaison meetings held to date, stating that they .appeared to be
most helpful and were well received.
15. ADJOURNMENT:
On motion of Councilman Tyrell, seconded by Councilman Gilbertson
and unanimously carried, the meeting adjourned at 8 :35 p.m.
Next regular meeting will be held on Tuesday, November 7, 1972,
at 7:30 p.m. in the Council Chambers of the City Hall.
