AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE,
FLORIDA AMENDING THE BUDGET FOR THE FISCAL
YEAR 2004-2005 TO INCREASE REVENUES AND
APPROPRIATIONS FOR EXPENDITURES WITHIN THE
SOLID WASTE FUND IN ACCORDANCE WITH THE NEW
CONTRACT FOR SOLID WASTE SERVICES; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Village has recently entered into a new contract for solid waste services and
has revised the applicable fees for solid waste services; and
WHEREAS, it is necessary to amend the Municipal Budget for the current fiscal year in
order to increase revenues and appropriated expenditures for solid waste services in accordance with
the recently revised solid waste service fees and the solid waste service contract, as provided herein.
NOW THEREFORE IT IS HEREBY ORDAINED BY THE VILLAGE COUNCIL OF
THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. Recitals Adopted. That the each of the above stated recitals are hereby
adopted and confirmed.
Section 2. Budget Amended.
A. That the Municipal Budget for the Village for the fiscal year which commenced on
October 1, 2004 and ends on September 30, 2005 is hereby amended by revising the revenues and
expenditures for the solid waste fund, as set forth on Exhibit "A", a copy of which exhibit is attached
hereto and incorporated herein.
B. That the total revenues and expenditures for the Solid Waste Fund shall be Five
Hundred Forty Five Thousand One Hundred Sixty Two and No/100 ($545,162.00) Dollars.

Section 3. Severability. That the provisions of this Ordinance are declared to be
severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held
to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections,
sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 4. Effective Date. That this ordinance shall become effective immediately upon
adoption at second reading.
