SUMMARY STATEMENT:
Idaho State Statute (67-6523) states that, “If a governing board finds that an imminent peril to the public health, safety, or welfare requires adoption
of ordinances as required or authorized under this (Local Land Use Planning) chapter, or adoption of a moratorium upon the issuance of selected classes of permits, or both, it shall
state in writing its reasons for that finding. The governing body may then proceed without recommendation of a commission, upon any abbreviated notice of hearing that it finds practical,
to adopt the ordinance or moratorium.”
The accelerating pace of growth within the City of McCall and its Impact Area have made it increasingly difficult for the City to respond to development
applications while at the same time proactively addressing wastewater capacity constraints and zoning and subdivision ordinance inadequacies.
The proposed emergency ordinance declares
a 182 day moratorium on all zoning, subdivision, planned unit development and/or scenic route applications within the City. This moratorium does NOT apply to records of survey, maintenance
and repair of existing buildings, building permits for new construction on existing lots with in the City, conditional use permits and variances. The ordinance is only in effective within
the city limits of McCall.
RECOMMENDED ACTION:
Suspend the rules and read Ordinance No. 809 by title only, one time only; and
Adopt Ordinance No. 809.
Request that the Valley County
Board of County Commissioners approve a similar ordinance for the City of McCall Impact Area.
