COMMISSION WITH RESPECT TO ANY MATTER CONSIDERED AT THIS MEETING, SAID
PARTY WILL NEED A RECORD OF THE PROCEEDINGS, AND FOR SUCH PURPOSE, MAY
NEED TO INSURE THAT A VERBATIM RECORD OF THE PROCEEDINGS IS MADE, WHICH

MINUTES OF THE CERTIFICATION OF ELECTION RETURNS MEETING HELD BY THE
TOWN COMMISSION OF THE TOWN OF GULF STREAM ON FRIDAY, MARCH 13, 1998 AT
NOON, IN THE COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD, GULF
STREAM, FLORIDA.
I. Call to Order. Mayor Koch called the meeting to order at 12:05
P.M.

Participating: Joan K. Orthwein Vice Mayor
Fred B. Devitt III Commissioner
Robert W. Hopkins II Commissioner
William A. Lynch Commissioner
Also Present and Kristin K. Garrison Town Manager
Participating: John Randolph Town Attorney
Rita Taylor Town Clerk
William Thrasher Finance Director
Robert Schultz Police Chief
III. Certification of Election Results. The Town Clerk reported that
there were two positions for Town Commissioner open, and only two
candidates filed, Mr. Devitt and Mr. Lynch. Inasmuch as they were
unopposed, the State Statutes provide it is not necessary to hold an
election as each candidate is assumed to have voted for himself, and
thus be elected. She reminded that the Commission had voted that an
election would not be held if the candidates were unopposed. The Clerk
officially declared Fred B. Devitt III and William A. Lynch elected as
Town Commissioners for a one year term.
Commissioner Orthwein moved that the election results as reported by the
Town Clerk be certified and the motion was seconded by Commissioner
Hopkins. Roll Call: Comm. Orthwein; AYE, Comm. Devitt; AYE, Comm.
Lynch; AYE, Comm. Hopkins; AYE, and Mayor Koch; AYE
IV. Seating of 2 Commissioners. Commissioner Orthwein moved that
Fred B. Devitt III and William A. Lynch be seated on the
Commission. Roll Call: Comm. Orthwein; AYE, Comm. Devitt; AYE, Comm.
Lynch; AYE, Comm. Hopkins; AYE, and Mayor Koch; AYE.
V. Swearing in of the Commissioners. The Town Clerk administered
the Oath of Office to Mr. Devitt and Mr. Lynch.

VI. Adjournment. Mayor Koch adjourned the meeting at 12:10 P.M.
following a motion to do so made by Commissioner Orthwein and
seconded by Commissioner Lynch with all voting in the affirmative.

NOTICE OF APPLICATION FOR DEVELOPMENT APPROVAL
NOTICE IS HEREBY GIVEN that the Architectural Review and Planning Board
of the Town of Gulf Stream will hold a Public Hearing on April 22, 1998, at
8:30 A.M., and the Town Commission will hold a Public Hearing on May 15,
1998, at 9:00 A.M., both in the Commission Chambers of the Town Hall, 100
Sea Road, Gulf Stream, Florida, at which the following will be considered:
OAn application submitted by Charles E. Toth, Architect, as agent for W.
Grant Williams, the owner of the property located at 3145 Polo Dr.,
Gulf Stream, Florida, which is legally described as Lot 7, Gulf Stream
Properties for; 1) A Level 3 Architectural /Site Plan Review to permit
two one -story additions totaling 624 square feet, connected to the rear
(east side) of the home, placed on either side of the existing patio
that will expand the master bedroom and add a family room, and; 2) A
Special Exception to permit the extension of an existing non - conforming
wall on the south side that fails to meet the combined side setback
requirements.
The Architectural Review and Planning Board shall make a recommendation to
the Town Commission, and the Town Commission shall make a final decision
regarding the subject application at their respective meetings noticed
above. These meetings may be adjourned from time to time and place to place
as may be necessary to hear all parties and evidence.
The complete application materials are on file in the Office of the Town
Clerk located at 100 Sea Road, Gulf Stream, Florida 33483, and may be
reviewed during regular business hours, which generally include non - holiday
weekdays from 9:00 A.M. to 4:00 P.M.
ALL PARTIES INTERESTED IN THESE MATTERS may appear before the
Architectural Review and Planning Board and the Town Commission of the Town
of Gulf Stream at the times and place aforesaid and be heard.

Stream, Florida, at a public hearing to be held on Tuesday, April 14,
1998, at 9:00 A.M., in the Commission Chambers of the Town Hall, 100 Sea
Road, Gulf Stream, Florida, will have on the agenda the adoption of the
following:
1. ORDINANCE NO. 98/1; AN ORDINANCE OF THE TOWN
OF GULF STREAM, PALM BEACH COUNTY, FLORIDA
AMENDING CHAPTER 42 OF THE TOWN CODE OF ORDINANCES
RELATING TO BUILDING AND BUILDING REGULATIONS,
ARTICLE II, SECTION 42 -26, ADOPTING THE PALM BEACH
COUNTY MINIMUM HOUSING CODE, AND SECTION 42 -27,
CHANGING THE NATURE OF BUILDING PERMIT FEE COL-
LECTION; PROVIDING FOR SEVERABILITY; PROVIDING FOR
REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR
CODIFICATION; PROVIDING AN EFFECTIVE DATE.
2. ORDINANCE NO. 98/2; AN ORDINANCE OF THE TOWN
COMMISSION OF THE TOWN OF GULF STREAM, PALM
BEACH COUNTY, FLORIDA, AMENDING CHAPTER 30
RELATING TO TRAFFIC AND VEHICLES BY INCLUDING
A NEW SECTION 30 -2 PROVIDING THAT THE MAXIMUM
SPEED ON CERTAIN RESIDENTIAL STREETS WITHIN
THE TOWN SHALL BE TWENTY MILES PER HOUR;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
REPEAL OF ORDINANCES IN CONFLICT; PROVIDING
FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE.
The proposed ordinances noticed here are available to the public at
the Town Hall, 100 Sea Road, Gulf Stream, Florida.
