SUMMARY STATEMENT:
Judge Winmill ruled on the post trail
motions in the J-Ditch phase-2 litigation. That ruling begins the 30 day period in which to file a notice of appeal, which ends on April 30, 2005. Counsel is analyzing appeal options
and preparing a legal analysis.
Due to the Council travel schedules and the short timeline, staff recommends that the City Manager be given the authority to authorize the filing of
the notice of appeal.
RECOMMENDED ACTION:
Authorize the City Manager to authorize the filing of the notice of appeal in the J-Ditch Phase 2 Litigation.
