HomeMy Public PortalAbout11 Title 15 Establish a Permit Extension I I I TOWN OF TRUCKEE California ORDINANCE 2008-11 AN ORDINANCE AMMENDING TITLE 15, TO ESTABLISH A PERMIT EXTENSION '. The. Town Council of the Town of Truckee Does Ordain as Follows: Section 1. Enactment. Title 15, of the Truckee Municipal Code is hereby amended as follows: Add the following section to the Town Municipal Code: 15.03.015 Permit Application Extension The following new section shall be added to the California Building Code Appendix Chapter 1, Section 105.3: 105.3.3 Permit Application Extension. A one time 180-day extension is available for building permits initially applied for between the dates of July 1, 2007 and March 31,2008 that will extend the application not beyond June 30, 2009 upon written request bY,the applicant alld payment of fees therefore. This extension is in addition to the initial' 180 day application and 180 day extension already granted by the code. The fee therefore is the difference between the building plan check and building permit fees at the time of application and those fees that are effective on Novemb~r 1, 2008. \ , . Whereas, Section 107.4 of the 2001 edition of the California Buildirig Code p'rqvid~~ that permits must be obtained within 180 days of the initial date of application; and, the code allows the building official to approve a one time extension of up to 180 days; and ' Whereas, the construction industry is experiencing economic challenges, specifically obtaining permanent and construction financing is presently difficult to impossible; the following . extension will enable permit applicants additional time within which financing should become available; and Whereas, the Health and Safety Code Sections 18941.5 and 17958 permit the Town to make su'ch changes or modifications to the Codes as are reasonable necessary because of local conditions; and . VVhereas, the Health Code Sections 18941.5, 17958.5 and 17958.7 make express findings that such changes or modifications are needed due to climatic, geographic or topographic conditions; and Whereas, the Town Building Official has recommended that a change is made to the code that is reasonably necessary due to local conditions in the Town of Truckee and is of a procedural nature; and Whereas, the Town Council of the Town of Truckee makes the express finding that said change to the Code is necessary for administrative purposes. Ordinance 2008-11 Page 2 Section 2. This Ordinance will take effect thirty days following its second reading. Section 3. Summary Publication. This ordinance or a summary thereof shall be published in a newspaper of general circulation according to State requirements. . ***** The foregoing Ordinance was introduced at a regular meeting of the Truckee Town Council held on the 16th day of October 2008, and adopted at a regular meeting of the Truckee Town Council, on the 6th day of November; Vice Mayor Brown moved for the adoption, the motion was seconded by Council Member Susman and was carried by the following vote: AYES: Vice Mayor Brown, Council Member Susman, Council Member Anderson, Council Member Dee, and Mayor Green.
