HomeMy Public PortalAboutResolution 92-31601 RESOLUTION NO. 92 -3160 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY TO AFFIRM THE PLANNING COMMISSION'S DECISION APPROVING A REQUEST BY BENHUR RIVERA FOR CONDITIONAL USE PERMIT 92- 1130 TO ALLOW A RESTAURANT USE IN THE GENERAL COMMERCIAL (C -2) ZONE. (RIVERA) THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE: SECTION 1. Based upon testimony received at a noticed public hearings before the City Council on June 16, 1992 and July 21, 1992; and upon the facts contained in the staff report and testimony received at a noticed public hearings before the Planning Commission on April 28, 1992 and July 14, 1992, and findings enumerated in the Planning Commission Resolution, the City Council upholds the Planning Commission decision of July 14, 1992 to approve the request for Conditional Use Permit 92 -1130 per the Planning Commission Resolution No. 92- 1462PC. SECTION 2. The City Council deleted conditions numbered 5 and 12 from Planning Commission Resolution No. 92- 1462PC and appoved Conditional Use Permit 92 -1130 subject to the following conditions: 1. The proposed development shall be in substantial compliance with the submitted development plans dated stamped July 9, 1992, except as modified herein. Seating shall be limited to no more than 24, as shown on the submitted floor plans. 2. Hours of operation for the restaurant shall be limited to between the hours of 6 a.m. to midnight everyday of the week. 3. All exiting vehicle traffic shall be required to make a right turn only onto Rosemead Boulevard. A "right turn only" sign shall be provided at the driveway exit onto Rosemead Boulevard. The size and placement of said sign shall be subject to the approval of the Traffic Engineer and the Community Development Department. 4. The proposed parking lot be paved with macadam or asphaltic pavement at a minimum depth of 3 -1/2 inches. Such surfacing shall be designed, constructed and maintained so as to dispose of all surface water. In no case shall such drainage be allowed to drain across the public sidewalk. 5. A detailed landscape and irrigation plan shall be submitted prior to issuance of building permits. All landscaping shall have automatic sprinklers. 6. The restaurant shall be equipped with a grease trap or grease interceptor with a minimum capacity to be determined by the Los Angeles County Department of Public works, Industrial Waste Division and the Community Development Department. Resolution No. 92 -3160 Page 2 7. Floor drains shall be maintained in all food preparation areas in accordance with all applicable Health, Industrial Waste and Building Codes. No food preparation, storage, or the washing of utensils or equipment shall be permitted outdoors. 8. A detailed signage program shall be submitted for review and approval by the Community Development Department prior to issuance of building permits. 9. A detailed color scheme and material sample board for all exterior improvements shall be submitted prior to issuance of building permits and shall be subject to the review and approval by the Community Development Department. PUBLIC WORKS 10. Curbs, gutters, sidewalks: Maintain existing curb, gutter and sidewalk. Remove and replace old drive approach with a new drive approach per CalTrans standards. 11. Surface Drainage: Provide all facilities necessary to accommodate contributory runoff and all surface drainage from the subject property and conduct it into appropriate storm drain facilities. No runoff shall be allowed to drain over a sidewalk. 12. Sewers: Provide per Code requirements. 13. Underground Utilities: All utilities shall be provided underground from primary service point in public right -of -way or on rear property line to service panels or facilities on building, subject to the satisfaction of the Public Services Department and Community Development Department. Prior to issuance of building permits, provide the Public Services Department with a detailed utility plan for review and approval showing all utility pipes, wires and conduits and their respective points of connection. 14. Dedications: None 15. Permits: Show on plot plan all right -of -way improvements from centerline of street to property line. Permits shall be obtained prior to commencement of any work in the public right -of -way. All work in the public right -of -way shall meet CalTrans standards. 16. Disposal of Construction Waste: No construction activity waste material of any kind, including plaster, cement, paint, mud, or any other type of debris or liquid shall be allowed to be disposed of in the street or gutter or storm drain or sewer RJD /F: \DOCS \SAR \RES0\537.1 1 1 1 system. Failure to comply with this condition will result in charges being filed with the District Attorney. (TCMC 3400- 3411) SECTION 3. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions. PASSED, APPROVED AND ADOPTED ON JULY 21, 1992.
