Motion by Arthur Theis, seconded by William Reiser to accept minutes of meeting of
October 19, 1976, as presented.
Motion carried unanimously
1. CANVASSING BOARD
The Council met as a Canvassing Board to accept the results of the Municipal Election.
Following are the results of the voting for Mayor:

Motion by Arthur Theis, seconded by William Reiser to declare Waynne Neddermeyer the winner
of the Mayor race in Medina.

Motion by Robert Franklin, seconded by Arthur Theis to certify the results of the Council
race to indicate Thomas Crosby and Nancy Laurent as winners of the 4 year terms and William
Reiser as winner of a 2 year term.
Motion carried unanimously
Motion by Wayne Neddermeyer, seconded by Arthur Theis to declare the 5 unaccountable ball°•
as missing; 3 not included in the absentee voting envelopes, 1 a Long Lake ballot and
1 missing.
Motion carried unanimaisly
2. FOX TRAPPING PETITION
Mrs. Lucy Bruntjen stated that she,the Mike Hofkins, and George Cleavlands had originated a
petition regarding an ordinance to ban fox trapping in the area surrounded by Co. Rd. 24,
Tamarack Dr.,Hunter Dr., and Co. Rd. 6.
She presented statistics regarding accidents that have occured in the area; dogs becoming
entrapped, and concerns about safety of children and pets.
Petitions signed by 46 of 51 property owners, in the area, were presented, some of these
being Orono residents;
Richard Schieffer stated that language could be written into the nuisance ordinance to include
this situation.
Julia Porter and Art Peabody reported incidents and problems on their property which is north
of Co. Rd. 24 and asked that their properties be included in tre restricted area.
Motion by Robert Franklin, seconded by Arthur Theis to accept the petition, as presented.
Motion carried unanimously
Discussion of proper posting of the areas affected by the ordinance. Owners would do the
posting, under the supervision of the Chief of Police.
Motion by Robert Franklin, seconded by William Reiser to adopt Ordinance No. 164, regarding
banning of steel -jawed leg -hold traps.
Motion carried unanimously
Motion by Robert Franklin, seconded by Arthur Theis to adopt Res. No. 76-43, regarding
restrictions under Ordinance No. 164.
Motion carried unanimously
3. T. ARTH[TR' S, PUBLIC HL+;ARING, 8:50 P.M.
Letters from R. Meyers and Mark Miller, residents, favoring change -over from game room Tie
operation to licensing for set-ups and non intoxicating malt liquor, at T. Arthur's, were
read.
Recommendation from Chief of Police Hoover in opposition was read.
Tom and Dorothy Anderson reported various incidents of tresspassing on their property.
Mrs. Jesse Theis reported having to erect a fence on their property to keep out the foot,
traffic, traveling to T. Arthur's.
Art Huar reported signs on his property being taken down and a number of beer cans and
smokers discovered in the area.
Wayne Neddermeyer stated that owners cannot be deemed responsible for how people go to. and
from an establishment.
Robert Franklin read the Mound police reports regarding Mr. Green's operation in Spring Park.
Richard Schieffer explained to Council that they may not use said police report as a basis
of rejection as no convictions had been obtained.
Chief of Police Hoover recommended that licenses not be issued to T. Arthur's.
Tom Green, owner, .stated that the complaints should be a justification for changing the type
of operation.
Motion by. Robert Franklin, seconded by Arthur Theis to close the public hearing.
Motion carried unanimously. Hearing closed at 9:10 P.M.
Motion by Robert Franklin, seconded by William Reiser to deny issuance of a set-up and non
intoxicating malt liquor license to T. Arthur's, because of close proximity of several other
eating and drinking establishments, issuance does not have endorsement of Medina's Chief of
Police, and because of complaints received from residents concerning theft, tresspassing
and vandalism.

4. ANNE DORWEITER
Enterprise Properties
Anne Dorweiler introduced Saul Segal, representing Enterprise Properties and presented survey
showing division of 26 acres into 5 acre tracts in Section 1, east of Co. Rd. 116.
Soil survey shows types of soil and recommendations by Soil Conseration service of use of
mound type sewage disposal systems.
Discussion of mound type systems, costs ranging from $1500 to $3000 for the two types of
systems and the fact that Medina does not presently permit such systems.
Motion by Robert Franklin, seconded by Arthur Theis to authorize the standard. driveway agree-
ment with provision that each lot be required to use the modified mound system or full mound
system, depending on soils, and inspection and approval to be done by the City engineer with
expenses to be borne by the property owner.
Motion carried unanimously
Richard Schieffer stated that the buyer must be protected. Agreement will need to state that
builder will need drainfield plans drawn by an engineer before -a building permit is issued.
J.L. LAWTON PROPERTY DIVISION
Plans were presented for approval of division of J. L. Lawton propterty in Section 11, South
of Co. Rd. 11. Survey indictes 40 acres divided into two 20 acre tracts. One purchaser
buying 20 acres and dividing it into two 10 acre tracts. The 10 acres in the back will be
landlocked and survey indicates a 33 ft. easement.
Motion by Robert Franklin, seconded by William Reiser to authorize the standard driveway
agreement of the J.L. Lawton property witha 30 ft. driveway easement on either side of
Tract A and B.
Motion carried unanimously
International Dairy Queen
Anne Dorweiler explained that changes have been made in site plans for Dairy Queen and per-
haps it should be referred back to the Planning Commission. She also indicated that Henn.
Co. Park should have copies of the plans as well as Minnehaha Creek Watershed District, so
that they may approve or comment. Mr. Karlberg, Mr. Lundeen and Mr. Odean of the•Dairy Queen
stated that they were anxious to move as quickly as possible on the project so they would take
plans to the Watershed District for comment. Anne Dorweiler stated she had sent plans to
Hennepin County Park District.
78 Office Furniture
Anne Dorweiler presented the following quotes on office furniture for her office:

Motion by Arthur Theis, seconded .by Robert Franklin to authorize Anne Dorweiler to purchase
items, as listed above, from Superior Products for approximately $183.00.

5. BILLS
Discussion of recommendation by Chief of Police that Medical emergency course should be taken
by Jerome LaFond at a cost of $92.00.. Robert Franklin recommended that Officer LaFond be
enrolled in the course.
Motion by Arthur Theis, seconded:by William Reiser to pay the bills; Order checks #6332-6384
in the amount of $21,397.27 and Pyroll #4247-4298 in the amount of $5857.52.
Motion carried unanimously
6. HENNEPIN COUNTY PARK RESERVE DISTRICT
Tim Marr and Mike Henry from Henn. Co. Park appeared to discuss method that Metro Waste Control
has used to determine amount of SAC charges to be assessed to.them and the fact that the build-
ing inspector cannot issue a building permit until the charges have been paid. Metro is using
July 4th as an absolute date for determing charges and have calculated 101 SAC units. Henn.
Co. has issued a letter of intent to .pay said charges but will be negotiating with Metro for
a lesser amount of units.
They would like to begin work on the project as soon as possible and would post bond if nec-
essary to guarantee payment.
Richard Schieffer stated that construction may not begin without a building permit if code is
followed and Medina would be liable for the charges within one month after the permit was
issued.
Wayne Neddermeyer stated that they would need to post bond, write out a check for the entire
amount or negotiate with Metro and return to building inspector or Council. -
7. TOM •LOUCKS CONTRACT
Discussion of contract presented by Mr. Loucks for work in connection with Medina's Comp.
Plan. Robert Franklin stated that the matter should be tabled until November 16th to allow
time to study the contract.
Motion by Arthur Theis, seconded by William Resier to release Mr. Louck's check for-$118.86.
Motion carried unnnimously
8. ORONO-LONG LAKE INTERCEPTOR .
Discussion of meeting to be held to discuss the Orono -Long Lake Interceptor and what action
Medina may want Metro .to take regarding the Medina Morningside area:. Steve Pflaum stated that
Orono should be consulted before any action is taken by Medina.
Motion by Robert Franklin, seconded by Arthur Theis to refer the matter to Wayne Neddermeyer
for conference With Orono's Mayor and to prepare a resolution for the Nov. 16th meeting.
Motion carried unanimously .
9. OATH OF Or r ICE
Clerk, Donna Roehl, administered the Oath of Office to Mayor elect, Wayne Ned ermeyer and
Councilmembers elect Thomas Crosby and Nancy Laurent.
10. GARDEN TRACTOR
Arthur Theis presented the following quotes on Lawn tractors:
International Harvestor--$2210; Ariens--$2200; Ford--82107. A11 are comparable size with
lawn mowers. Matter tabled until November 16th meeting.
11. RON DURAN
-Ron Duran asked.that Mr. Jim Lane be contacted again and be asked to remove the rocks on
road right-of-way on Willow Dr. near his property. He will aslo have tire quotes for
the November 16th meeting.
