M. Present: Mayor, Thomas Anderson; Councilmembers, Thomas Crosby, Sarah Lutz, William Reiser, Wilfred Scherer; Clerk -Treasurer, Donna Roehl; Planning and Zoning Administrator, JoEllen Hurr; Public Works Director, James Dillman, Police Chief, Michael Sankey; Attorney, Michael Nash; Engineer, Glen Cook 1. ADDITIONAL AGENDA ITEMS Council agreed to discuss the following additional agenda items: Holy Name Church entrance Park Reserve District Conditional Use Permit Medina Journal Hwy. 55 and Co. Rd. 116 Signals Police Chief's Seminar 2. MINUTES OF October 19, 1982 JoEllen Hurr asked that Item 4, Page 126, Holy Name Church, be amended to include the fact that City Council is the final authority on conditions included in a Conditional Use Permit and Hennepin County Transportation has policies developed for entrances and exits from County roads which cities use or may adopt more strict guidelines. She also asked that Item 4, Page 126, Debbie Kemp Stables, be amended to include the fact that all of the application materials were not submitted. Motion by Crosby, seconded by Lutz to accept minutes of October 19, 1982, as amended. Motion declared carried 3. PUBLIC WORKS DEPARTMENT Arrowhead Dr. Jim Dillman presented plans to upgrade Arrowhead Dr., beginning in 1983 with grading and drainage work, followed by a three year graveling program. Costs involved would be culverts, installed by city employees, with city equipment and application of from $3,000-$5,000 in gravel each year for three years. Glen Cook stated that the city does have adequate right-of-way in the Faue Registered Land Survey. Rayburn Roy stated that if the road is to be continued it should be constructed on the property line as as not to divide his property. Motion by Crosby, seconded by Scherer to approve the Public Works Department proposal to upgrade Arrowhead Dr. and direct Wilfred Scherer to work with property owners to secure the proper right-of-way. Motion declared carried 4. MEDINA MORNINGSIDE EPA GRANT Thomas Anderson reported that the city had been offered an increase of $18,375 in its grant amount or 75% of the costs listed in Amendment No. 2 of the Medina Morningside Improvement Grant. Motion by Crosby, seconded by Lutz to authorize the Mayor to sign the grant amendment for $18,375. Motion declared carried 5. POLICE DEPARTMENT Police Chief's Seminar Motion by Reiser, seconded by Scherer to approve the Chief of Police attendance at a Civil Liability course on November 22nd, for a fee of $65.00. Motion declared carried 6. HENNEPIN COUNTY PARK RESERVE DISTRICT William Barbeau, Chairman of the Hennepin County Park Reserve District Board of Comm- issioners, appeared to discuss the districts proposed 5 year park plans. He also reported on the make-up of the 1983 Board and attempts which have been made to put the park system under the direction of the Hennepin County Board of Commissioners. 13 Thomas Crosby asked if acquisition of property had been completed. Mr. Barbeau stated that 95% of the property had been acquired. Marty Jessen of the Park Reserve District stated that the Park District boundaries have not been expanded. William Reiser asked how many homes have yet to be taken in Medina. Mr. Jessen stated that he would call the city office with that number. Donna Roehl asked about the plans that had been drawn to realign Co. Rd. 19, which the Board of Park Commissioners had apparently turned down. Mr. Barbeau stated that he would look into the situation. Sarah Lutz asked about landfills in county parks. Mr. Barbeau explained that one county commissioner is in favor of landfills in county parks and that the Park Reserve District would need to take the matter to court. 7. ROLLING GREEN COUNTRY CLUB Daryl Uphoff representing Rolling Green explained that no date had been set for the appeal in District Court, which the bank has made for liquidation of the club. Donna Roehl stated that Rolling Green and other On -Sale licensees would now be billed for the second half of the liquor license fee. Motion by Scherer, seconded by Lutz to table the Rolling Green matter until December 7th. Motion declared carried 8. HOLY NAME CHURCH ENTRANCE A representative of the Green Tree West homeowners association appeared to explain that the Ways and Means Committee of the Hennepin County Board of Commissioners had taken the posistion that the proposed parking lot for Holy Name Church could exit onto Co. Rd. 24. He stated that Dale Ackmann of Hennepin County Transportation had stated that they had no objection to allowing the exit. JoEllen Hurr explained that the city had issued a Conditional Use Permit using Brockton Lane as an exit. Thomas Anderson stated that the City Council had given the residents a time period in which to submit engineering studies supporting their posistion and nothing had been sub- mitted. JoEllen Hurr stated that the city would be taking engineering studies to the County Board for their review. Thomas Anderson explained that it is the church that must request any change in the terms of the Conditional Use Permit and that the City Council has the final decision in the matter. Homeowners representative asked that city records of meetings be checked for information regarding city acting under direction of Hennepin County. Thomas Anderson asked why they had waited three months before asking for a change. Mr. stated that they had not known untin recently that there was a chance the en- trance could be relocated. Thomas Crosby advised that they ask the church if they wish to submit an application for change and it would be at that time that the County's posistion would be considered. 9. PLANNING AND ZONING DEPARTMENT Hennepin County Park Reserve District Conditional Use Permit JoEllen Hurr reported that an application had been submitted by the Park Reserve District to construct a maintenance building east of Co. Rd. 19 and south of Co. Rd. 24. She stated that a Public Hearing had been held by the Planning Commission and listed conditions of approval the members had compiled. Mr. Marty Jessen explained that the maintenance facility would be located 450 ft. back from Co. Rd. 19 with the entrance directly across from the Baker Park entrance. He stated that the building would be 10,000 sq. ft. with 5,000 sq. ft. of heated space. He reported that bids had been favorable and that they would be blacktopping the parking lot and driveway but he asked if the city would consider waiving the landscaping bond be- cause they own their own nursery and have adequate manpower to do the plantings. Thomas Anderson stated that all applicants must be treated in the same manner. JoEllen Hurr stated that the city may want to consider waiving the requirement for another government entity. 34Thomas Crosby stated that the timing for planting would be a reason for holding a bond. Thomas Anderson suggested that they place funds in an escrow account. Mr. Jessen stated that the building is slated for completion within 18 months. Motion by Scherer, seconded by Crosby to direct staff to prepare a Development Contract for the November 16th meeting, approving a Conditional Use Permit for construction of a maintenance building on the Hennepin County Park Reserve Distriact property at Co. Rd. 19 and Co. Rd. 24. Motion declared carried Mr. Jessen stated that if the bids were awarded construction would begin within 10 days. Comprehensive Plan JoEllen Hurr stated that Metropolitan Council had approve the cities Comprehensive Plan and that she would be writing a summary of the Council's comments. Debbie Kemp Stables JoEllen Hurr stated that the purchaser of the Kemp property will be making a formal app- lication for a Conditional Use Permit to operate the stables and that the Planning Comm- ission would consider it at their December 14th meeting with the Council to hear the matter at the December 21st meeting. She explained that closing on the property is scheduled for late in December. 10. PERSONNEL POLICY Council discussed City Clerk's request that accumulated hours worked by continuously emp- loyed part time employees be taken into consideration for fringe benefit purposes. Council also discussed whether or not an employee should be given credit for years worked at another city, prior to Medina. Thomas Crosby stated that such decisions could be made when salaries are adjusted at the beginning of a year. Anne Heideman stated that she would work with the attorney to clarify some of the sections. 11. CIVIL DEFENSE ORDINANCE Motion by Scherer, seconded by Reiser to table the matter until December 7, 1982. Motion declared carried 12. ELM CREEK WATERSHED DISTRICT Motion by Scherer, seconded by Crosby to table action on the Elm Creek Watershed District Joint Powers Agreement changes until December 7, 1982. Motion declared carried 13. MEDINA/LONG LAKE/ORONO SEWER AGREEMENT Richard Schieffer explained that copies of an amendment had been submitted to Orono and Long Lake and that the resolution provides for a payment formula for the Burlington/North- ern annual fee of $750.00. Motion by Reiser, seconded by Crosby to adopt Resolution 82-27, amending the Sanitary Sew- er Agreement. Motion declared carried 14. MEDINA JOURNAL Discussion of publication of the Medina Journal and whether the city could pay for a portion of the costs because it does provide a means for the city to give notice to residents on various matters. Thomas Anderson stated that he would discuss expenses and income with Publisher, Sandra Vrooman. 16. BILLS Motion by Reiser, seconded by Scherer to pay the bills: Order Checks # 1598-1661 in the amount of $81,830.04 and Payroll Checks # 6879-6935 in the amount of $11,048.66. Motion declared carried 17. HIGHWAY 55 and CO. RD. 116 SIGNALS Donna Roehl presented a petition signed by 200 people who ask that a signal be placed at the intersection of Hwy. 55 and Co. Rd. 116. Council discussed responsed that had been received from the Department of Transportation regarding the need for islands to divide lanes of traffic. Motion by Reiser, seconded by Crosby to accept the petition. Motion declared carried Motion by Scherer, seconded by Reiser to hold a Public Hearing on December 7, 1982 at 8:00 P.M. to discuss the installation of signals at the highway intersection.
