The Commission found that the application meets the requirements of MCC 3-31-030(A) and recommended the approval of the application by the City Council. On July 14, 2005 the City Council held a properly posted and noticed public hearing. The Council found that the application meets the requirements of MCC 3-31-030(A) and adopted findings and conclusions approving the conditional use permit. A petition for judicial review was filed by the Mill Park Village Property Owners' Association on August 9, 2005. On June 3, 2006 the District Court remanded the matter to the McCall City Council for further proceedings because a plot plan drawn to scale and stamped by a Professional Surveyor was not in the original application. A staff report is attached, along with the Petition for Judicial Review, the Appellant's Opening Brief, the Respondents' Brief to the Petition, the Appellant's Reply Brief, the Memorandum Decision and Order on Petition for Judicial Review, and a letter from the Mill Park Village Property Owners' Association counsel in opposition to the conditional use permit. The complete application is extensive and is not attached to this agenda bill. The complete application is available for review in the Community Development Department. Draft Findings and Conclusions will be distributed on Monday, August 7, 2006. RECOMMENDED ACTION: Adopt the draft Findings & Conclusions for CUP-05-3 and authorize the Mayor to sign.
