No. 05-339 Date of Adoption November 10, 2005 AUTHORIZING A PROFESSIONAL SERVICES CONTRACT FOR ENGINEERING SERVICES WITH CME ASSOCIATES WHEREAS, the Borough of Carteret is in need of specialized engineering services regarding the vertical delineation of arsenic contamination at the proposed Carteret Waterfront marina site; and WHEREAS, CME Associates, 3141 Bordentown Avenue, Parlin, New Jersey 08859, possesses the requisite experience and expertise to provide said services; and WHEREAS, CME Associates has submitted a proposal to provide said services at a total cost not to exceed $33,500.00; and WHEREAS, the Mayor and the Council have reviewed said proposal; and WHEREAS, the Chief Financial Officer has certified that funds are or will be available for said purpose. NOW, THEREFORE, BE IT RESOL VED by the Mayor and the Council of the Borough ofCarteret, County of Middlesex, State of New Jersey, as follows: I. The proposal from CME Associates for engineering services regarding the vertical delineation of arsenic contamination at the proposed Carteret Waterfront marina site at a total cost not to exceed $33,500.00 is hereby approved; 2. This action is approved as an award of a professional services contract pursuant to NJ.S.A 40A:Il-5(1)(a); 3. A copy of this Resolution be forwarded to the Borough's Purchasing Department and CME Associates. '- Re: Scope of Additional Services Vertical Delineation of Arsenic Contamination Carteret Waterfront Marina Site Our File: HCA00502.01 Dear Mayor Reiman: As you are aware, the Waterfront Deyelopment Permit for the proposed deyelopment of the marina was withdrawn on October 21,2005 pursuant to a letter dated October 14, 2005 from the NJDEP Office of Dredging and Sediment Technology. The NJDEP indicated that the application did not designate the upland disposal and/or beneficial reuse facility, as the presence of eleyated leyels of arsenic found in all four (4) composite samples exceeded the allowable amount in the State of New Jersey. We performed a preliminary round of sampling earlier this year, which showed consistent arsenic results approximately 30 to 40 ppm; howeyer, the full sampling program's composite samples revealed arsenic leyels in excess of 100 ppm. Considering that the preliminary surficial sampling had relatively low arsenic levels, it was believed that the composited sampling would have yielded lower results than were obtained. In our experience, and based upon our discussions with the NJDEP Office of Dredging and Sediment Technology, dredge spoils containing a concentration of arsenic over 100 ppm cannot be taken to a beneficial reuse facility. In addition, we have had an in-depth discussion with Valerie Montecalvo of Bayshore Recycling, and concluded that due to the elevated levels and nature of the arsenic contamination, Bayshore cannot treat the dredged materials by soil washing technology. However, Bayshore recommends that a pilot program could be initiated using its proprietary thermal treatment technology, and they would meet with representatives of the NJDEP at our direction. They believe a volume of approximately 3,000 to 5,000 CY of material could be initially dredged for the pilot program once a special permit is obtained from the NJDEP. Assuming the dredge material is approximately 1.6 CY per ton, it appears to landfill the +/- 40,000 - 60,000 CY of dredge material is approximately $9.6 million, assuming beneficial reuse is not feasible. As such, due to the limited disposal options, we belieye it is in the best interest of the project financially to perform another round of sampling. By performing discrete, non-composite sampling, we believe we can better approximate the extent of contamination, both horizontally and yertically, in an attempt to maximize the beneficial reuse quantity, and minimize the quantity that may require landfilling. As such, we are pleased to propose the following. Task 1 - Collection of Additional Sediment Samples and Testing Additional sediment samples will be collected from each of approximately 12 designated sampling locations to a maximum depth of 12 feet below the sediment surface or point- of-refusal. Three (3) samples from each location will be collected and analyzed for arsenic. A total of 36 samples will be tested for arsenic. Samples will be collected using an electric vibracorer fitted with a 4" aD barrel. Flexible, plastic liners will be used from which the samples will be extruded and containerized in new, 2 gallon buckets. At the end of each day samples will be transferred to laboratory for processing and storage. It is estimated that 2-day field effort would be necessary to complete this work. Sediment chemistry for arsenic will be performed on the sediment samples, In addition each indiyidual core and each strata within each core must have the physical analyses of grain size, % moisture and TOC's conducted. The results of the data will be evaluated, and findings and recommendations will be presented in a report. Depending on the availability of equipment, it is estimated that the work will be completed within 6 to 8 weeks from the acceptance date of the proposal. It is believed that since there were some much lower leyels in the initial sampling, delineating the higher from the lower concentrations could saye considerable costs for disposal. Exceptions: Any engineering services beyond the scope outlined above will be considered extra. Said fees will be based on the hourly rate or a fixed fee mutually agreed upon in writing. The fees on the hourly rate schedule are subject to change by January 1 of every year. CME Associates will not be responsible for and will not have control or charge of construction materials, methods, techniques, sequences or procedures, or for safety precautions and programs in connection with the work, and will not be responsible for the Contractor's failure to carry out the work in accordance with the contract documents. CME Associates also will not be responsible for or have control or charge oyer the acts or omissions of the Contractor, Subcontractors, or any of their agents or employees, or any other persons performing any of the work. (CME) will submit invoices to Client monthly and a final invoice upon completion of services. Payment is due upon presentation of invoice and is past due thirty days from invoice date. Client agrees to pay a finance charge of one and one-half percent per month. or the maximum rate allowed by law, on past due accounts. In the event that the invoice is not paid voluntarily and promptly, and must therefore be referred to an attorney or agency for collection, the Client agrees to pay a collection fee equal to the actual attorney or agency collection fee incurred by CME. Overtime rates are applicable after eight hours Monday through Friday, and all day Saturday and Sunday, and charged at one and one·half times the quoted rate. Holidays are charged at two times the quoted rate. Expenses incurred for reproduction, postage handling. photographs and for services including subconsultants equipment and facilities not furnished by CME are charged to the Client at cost plus ten percent Automobile travel may be charged at $.30 per mile. Standard of Care· Services perlormed by CME under this Agreement will be conducted in a manner consistent with that level of care and skill ordinarily exercised by members of the profession currently practicing under similar conditions. NO OTHER WARRANTY, EXPRESSED OR IMPLIED, IS MADE. Contaminated Material· It is understood that CME is not, and has no responsibility as a handler, generator, operator, treater or storer, transporter or disposer of hazardous or toxic substances found or identified at any site.
