No. 05-343 Date of Adoption Nnvpmhpr 10, 2005 AUTHORIZING A PROFESSIONAL SERVICES CONTRACT FOR ENGINEERING SERVICES WITH CME ASSOCIATES- CIVIC CENTER PARK IMPROVEMENTS PROJECT WHEREAS, the Borough of Carteret is in need of specialized engineering/environmental services related to the Civil Center Park Improvements Project; and WHEREAS, CME Associates, 3141 Bordentown Avenue, Parlin, New Jersey 08859, possesses the requisite experience and expertise to provide said services; and WHEREAS, CME Associates has submitted a proposal to provide said services at a total cost not to exceed $8,700.00; and WHEREAS, the Mayor and the Council have reviewed said proposal; and WHEREAS, the Chief Financial Officer has certified that funds are or will be available for said purpose. NOW, THEREFORE, BE IT RESOLVED by the Mayor and the Council of the Borough ofCarteret, County of Middlesex, State of New Jersey, as follows: I. The proposal from CME Associates for engineering/environmental services related to the Civic Center Park Improvements Project, at a total cost not to exceed $8,700.00 is hereby approved; 2. This action is approved as an award of a professional services contract pursuant to N.J.S.A 40A:II-5(1)(a); 3. A copy of this Resolution be forwarded to the Borough's Purchasing Department and CME Associates. As you are aware, we have already prepared plans for the improvements proposed which include a conversion of the baseball fields from the current natural grass surface to an artificial surface. We have had multiple conversations with the NJ DEP regarding jurisdiction of this project, and it was determined that since the project is located within the New Jersey Department of Environmental Protection (NJDEP) designated Coastal Zone, a NJDEP Coastal Zone General Permit (as found at NJAC 7.1 - 7.17) will be necessary. Within these regulations, we are required to address water quality. This proposal outlines the cost of services to prepare plans in conformance with the NJDEP standards and submit an application for the above referenced Coastal General Permit. Based upon previous research we have conducted, it appears that the Borough received a conveyance from the State of New Jersey, Bureau of Tidelands, to occupy lands formerly flowed by tide, in the area of the football field. We are anticipating that an additional conveyance may be necessary from the Bureau for the additional athletic field reconstruction and re-surfacing. Our scope of services will involve the following tasks: . As we discussed with the Department, this type of construction in the Coastal Zone appears to be rather unique, and the Department is somewhat unclear on the water quality requirements necessary for a field turf system. It has been our view that replacing natural turf with artificial turf will improve the water quality by the change alone. If, however, the Department doesn't view the issue the same way, we would need to include engineering of water quality measures and treatment devices, similar to the Vortechs box used at the Waterfront Park Access Road. Preparation of an application to the NJDEP for Coastal General Permit #7.17. This includes forwarding a standard notification to the Borough Construction Officer, to the Middlesex County Planning Board, Environmental Commission and to adjoining property owners. Three complete application copies will also be forwarded to the Borough Clerk, and per NJ DEP rules, it will be requested of the Clerk to distribute copies to the Borough Planning Board and Environmental Commission. The application is also to include a compliance statement to demonstrate how the project meets the applicable Coastal Permit Program Rules (NJAC 7:7-75). . Preparation of an application to the NJ Bureau of Tidelands for a conveyance Total Fee for Environmental SeNices ......................................................................... $8,700 Please note that this proposal covers the cost of the engineering, plan, and NJDEP application preparation for a Coastal General Permit. In the event the NJDEP requires an Individual Waterfront Development Permit, we will need to submit a separate proposal that will outline the additional costs associated with this type of permit application.
