MINUTES OF THE SPECIAL JOINT MEETING HELD BY THE TOWN COMMISSION AND THE
ARCHITECTURAL REVIEW AND PLANNING BOARD OF THE TOWN OF GULF STREAM ON
THURSDAY, DECEMBER 16, 1999 AT 8:45 A.M., IN THE TOWN HALL, 100 SEA

I. Call to Order. Mayor Koch called the meeting to order at 9:05

IV. Summary of changes made since the November Special Joint Meetin,
All changes that were made to proposed Ordinance 99/3 at the
meeting held on November 19, 1999 were approved except as follows:
1) Section 3. - Paragraph (5) of Sec. 56 -137 is changed to add a
reference to root systems that pose a substantial hazard to persons or
property.
2) Section 27 proposes changes in the front and rear setbacks in the
Core District to 30' in the front, 20' in the rear for interior lots,
30' in the rear on AlA and 25' in the rear for lots connected to ICWW.
Mayor Koch advised that at the time the original homes were built,
there were deed restrictions that required a 50' setback in the rear.
J) He pointed out that if this change were to be enacted, new houses that
are built in this area will be 30' closer to the water, blocking the
view of existing homes.
Following discussion on this matter, the Town Manager was directed to
re -write this section to provide for a 50' rear setback for lots
connected to the ICWW in the Core District and a 30' rear setback for
lots connected to the ICWW in all other Districts, with a Special
Exception provision for more shallow lots to have the setback computed
on a percentage of lot depth.
3) Section 29 - Sub - paragraph d. of Paragraph (2) of Sub - section (i) of

Sec. 70 -75 to be changed to read The first 5' of the building must be
one story in height.

All of the proposed amendments in Proposed Ordinance No. 99/3 that were
not addressed at the meeting held November 19, 1999 were approved with
the exception of the following:
1) Section 48 - Table 9. in Sec. 70 -187 the reference to basketball
goals is to be addressed in the North Ocean Blvd. Overlay District.
2) Section 60 - Item (7) Sub - section (b) of Sec. 70 -269 is to be
changed to read Internally lighted mailboxes.
Town Manager Garrison then advised that she had added in Section 1 a
new Sec. 42 -30 to the Code to address Construction Abandonment and a
new Sec. 42 -31 to provide that a permit would be required for
construction or reconstruction of driveways. In addition, she called
attention to Section 53 of the proposed ordinance wherein gray slate or
slate -style tile may be permitted on homes that are predominately
Georgian or British Colonial with Bermuda influences, suggesting that
this be subject to approval in a Level 2 Architectural /Site Plan Review.
She asked if these additions were acceptable and the Commissioners and
Board Members indicated they were.
With regard to a review of the provisions regarding boat lifts, the
Commissioners and the Board Members agreed that no changes should be
considered at this time as a considerable amount of research will be
necessary. It was determined that this matter will be considered at the
time of the next review of the Codes. In the interim, Mr. Van Dinter
may apply for a variance if he so desires.

VII. Adjournment. Mayor Koch adjourned the meeting at 10:10 A.M.
