The attached documents reflect the amendments discussed. Also attached is a warrant register authorizing approval of the February hardship payments. RECOMMENDED ACTION: Adopt the proposed hardship policy and approve the February hardship payments. The process is not detailed in the Code, but an applicant must submit to the Treasurer "...in sufficient detail the facts and circumstances alleged to support the particular relief or waiver sought." The Treasurer is then required to review the application and submit it, along with a recommendation, to the Council. MCC 6-4-250 is attached. On January 14, 1999 the Council approved a process to handle utility hardship requests. It is unclear from the record how requests were handled prior to 1999. In late 2004, the Council discussed the issue informally. On January 27, 2005 the Council revisited the policy for review and approval of hardship payments. The Council voted to endorse the previously approved policy. A portion of the minutes of the January 14, 1999 and January 27, 2005 meetings, as well as the agenda bill for the January 27, 2005 meeting, are attached. The policy in effect since 1999 is attached. Staff has reviewed both the City Code and the current policy, considered the concerns expressed by Council members, and considered the need for a consistent and objective policy. Attached are a new application form and a revised policy for the Council's consideration. The revised application form and policy take into account not just the applicant's income, but also assets which they may own, other than the primary dwelling. The revised policy also requires Council approval of the annual renewal. RECOMMENDED ACTION: Adopt the proposed hardship policy.
