RESOLUTION NO. 92 -3179
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY,
CALIFORNIA, ADOPTING THE SOLID WASTE MANAGEMENT COST RECOVERY
FEE
WHEREAS, the California Integrated Waste Management Act (Assembly Bill 939) requires that
each city in California develop and implement a solid waste source reduction program; and
WHEREAS, the City Council has adopted the City's Source Reduction and Recycling Element
(SRRE) and the Household Hazardous Waste Element (HHWE) in compliance with AB 939; and
WHEREAS, in response to AB 939, the City has implemented a curbside recycling program and
other source reduction programs; and
WHEREAS, AB 939 provides for each city to recover expenses related to the implementation of
solid waste source reduction programs; and
WHEREAS, the City is a defendant in the Transportation Leasing Co. v. State of California, et
al.; and
WHEREAS, the City in defense of the above mentioned case has incurred a substantial operations
cost to its solid waste management program; and
WHEREAS, the City, as a charter city, is able to recover costs for operating expenses related to
solid waste litigation in the form of user fees; and
WHEREAS, the City Council has reviewed the report detailing the cost of the AB 939
implementation and the Transportation Leasing litigation and has reviewed the Solid Waste Management
Cost Recovery Program:
NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA,
DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That the City Council hereby adopt the Solid Waste Management Program cost
recovery fee of $.89 per month for residential units and 7.9 percent for commercial accounts.
SECTION 2. That said fee be included as part of the regular refuse service fee, as collected by
the franchised hauler and the total gross proceeds returned to the City.
SECTION 3. That the City Clerk shall certify to the passage and adoption of this resolution and
enter it into the book of original resolutions.

Council of the City of Temple City at a regular meeting held on the 18th day of August, 1992, by the
following vote:
