The Council of the City of Medina met in regular session on Wednesday November 5, 1975 at
7:45 P.M.
Members present: Mayor Wayne Neddermeyer; Councilmen, Donald Deslauriers, Arthur Theis,
Robert Franklin, William Reiser; Clerk, Donna Roehl; Attorney Richard
Schieffer
Minutes of October 21, 1975 corrected as follows: Page 152, Item 9: Line 4 change the
word"allowing"to "allowed". Line 5 change to read:"that an agreement with the City for
roadway construction and maintainence should be approved "
Motion by Donald DesLauriers, seconded by William Reiser to accept and approve minutes
as corrected.
Motion carried unanimously
1. HENNEPIN COUNTY PARK
Ed Sorgatz of Hennepin County Park Reserve presented letter explaining request for"no park-
ing" signs on and area of Parkview and Hamel Roads due to the increasing number of cross
country skiers. Council advised that Park contact private property owners before request
could be approved by Council.
Robert Franklin expressed the need for Stop signs on the ends of park roads entering County
Rds. 19 and 24. Mr. Sorgatz stated he would relay the request to Headquarters.
Council also discussed the need for land alteration, building or any other permits required
by the City,should apply to the park as well. Mr. Sorgatz asked that a letter be forwarded
to the Superintendent stating the need for the park to secure the necessary permits before
work of any such nature is begun.
2. NUISANCE ORDINANCE
Richard Schieffer stated that he was collecting information and would draw up a sample ord-
inance which would include animal control and which the Council could revise as they wished.
Regarding a problem at Independence Beach, Dr. R.A. Olson, Medina Health officer felt that
he did not have authority to do anything because animals are not the primary eause of the
disease in question.
Regarding the James Dorn property in Hamel. Mr. Dorn has 10 days in which to act to rid
the building of rats, after which the City may secure the services of an exterminator
and charges fees of up to $100 against the property.
Regarding the time limit Independence Beach residents will have to connect to the sewer,
the present ordinance states "within 90 days or as soon as sewer is available". Ordinance
may be changed if council so desires.
3. JIM ERICSON
Letter of residnation was presented by Mr. Ericson stating he had secure employment else-
where. Higher wages and fringe benefits were cited as reasons and discussed.
Motion by Arthur Theis, seconded by Donald DesLauriers to accept the resignation of Jim
Ericson.
Motion carried unanimously
4. MINNEAPOLIS GAS COMPANY
Letter from Minnegasco was read stating that the policy has been not to secure permission
from a city to extend service from the main in the street to individual buildings. If the
City wishes to change the policy someone should contact Minnegasco to discuss the matter.
5. WRIGHT - HENNEPIN CONTRACT
Contract for installation of additional street lights in Medina Morningside was presented
by Arthur Theis for the proper signatures.
PUBLIC HEARING 9:00 P.M.
Jubert, Medina's representative to the Hennepin County Transportation Study Committee
presented background on work covered by the committee since January, 1975. He also
presented maps showing various north -south routes through Medina which had been discussed
by the committee and the Planning Commission.

George Wyse, alternate representative, stated that Medina had several alternatives
regarding a recommendation. 1. They could make no recommendation at all and the County
would decide a route. 2. They could ask that any route plan be withdrawn from consider-
ation at this time because Medina has- not completed land use plans.
Residents questioned the need for a north -south route and various alternatives were
suggested and discussed.
Jim Lane stated that as Medina has not yet adopted the Comprehensive Plan any decision
would be premature, also input should be received from surrounding communities as Medina‘
would be limiting itself to one proposed route while other municipalities would have
options.
Residents were reminded that this is a study on a county -wide basis with a need for input
from communities. Actual roadway construction is not contemplated for many years.
Motion by Donald DesLauriers, seconded by Arthur Theis to close the public hearing.
Motion carried unanimously
Motion by Robert Franklin, seconded by William Reiser to instruct representatives to
Transportation Study Committee to take back the followin information: 1. There is a
need for a north -south route to serve Medina and the surrounding communities. 2. Desig-
nation of a route through Medina should wait until Community Development Guide is adopted.
3. The County should seek input from the adjoining communities regarding any proposed
routes through Medina. 4. The County should continue to study these routes and forward
any information that is gathered to Medina.
Motion carried unanimously
7. ANNE DORWEILER
Dennis Burgess
Anne Dorweiler informed council that Mr. Burgess is seeking to combine Lots 2, 3, and 4
of his plat, Lakeshore Estates. Attorney felt that replatting would be necessary and
Council advised Ms. Dorweiler to convey information to Mr. Burgess along with the necestiity
of the road also being constructed. Attorney stated that he would discuss with Mr. Burgess'
engineer the lot lines and costs to replat.
Robert Franklin
Mr. Franklin presented information whereby he wishes to sell a portion of Lot 8 Block 29,
Lake Independence and to buy a portion of Parcel 9060. The sewer and water assessments -
would remain the same but Mr. Franklin would be charged for 20 feet and Mr. Fries would
be charged for 14 feet of the present 34 assessable footage.
Mr. Schieffer asked for time to consider how all lot combinations in the Independence
Beach area should be handled and what fees should be charged.
Motion by Arthur Theis, seconded by William Reiser to table the matter until Attorney has
time to determine proper procedure.
Motion carried. Robert Franklin abstaining.
Wayne Allen Plat
Anne Dorweiler presented letter from Herb Klossner, Hennepin County Engineer regarding
recommendations as to access to County Rd. 24 and alterations within County Right-of-way.
Anne Dorweiler was advised to reply stating the council would review recommendations. .
8. HENNEPIN COUNTY PARK TAX ABATEMENT
State hearing regarding abatement of property taxes in Medina has been rescheduled for
November 13th. Orono School Board has voted to disapprove the abatement. Robert Frank-
lin gave the following information regarding the property in question: The County took
possession in 1965 and made application for abatement in 1974. Taxes and penalties
amount to $8450 for the years 1969 through 1975.
Motion by Arthur Theis, seconded by Donald DesLauriers to adopt resolution 75-40,
opposing tax abatement for Pl.at:.'. 60018, Parcel 8020.

9, TAX LEVY
Discussion of combining the 1968, 1972, and 1974 Hamel Sewer and Water Debt Service Funds
and the abolition of the 1972 tax levy that has been assessed to pay a portion of the bond
expenses.
Motion by Robert Franklin, seconded by Donald DesLauriers to combine the 1968, 1972 and
1974 Hamel Sewer and Water Debt Service Funds, by the adoption of Resolution 75-41.
'Motion carried unanimously
Motion by Donald DesL uriers,seconded by Arthur Theis to adopt Resolution 75-42 regarding
notification to County that there are sufficient funds available to repay bonds and interest
.due in 1976.
Motion carried unanimously
Motion by Robert Franklin, seconded by William Reiser to amend 1976 budget levy by the
addition of $3000.00.
Motion carried unanimously
10. DEFERED ASSESSMENTS
Discussion of charging an additional interest rate on deferred special assessments.
Motion by Robert Franklin, seconded by Donald DesLauriers to charge interest rate (as per
project) on unpaid balance for each year.

11. METROPOLITAN TRANSIT STUDY
Motion by Robert Franklin, seconded by Arthur Theis to appoint Jim Johnson instead of Marvin
Johnson as Medina's representative to Metro Transit Study Committee along with Donald
PesLauriers, Council representative, previously appointed.
Motion carried unanimously
12. HENNEPIN COUNTY JAIL CHARGES
'Discussion of County raising jail service from $12 to $23 per day. Matter tabled until
November 18th.
13. BILLS
Motion by Arthur Theis, seconded by William Reiser to pay the bills. Payroll in the amount
of $4593.88 and Order Checks intheamount of$123,094.21.
Motion carried unanimously
14. WCCO
Letter from WCCO, dated October 28, 1975, regarding current status of radio tower hearing in
Washington D.C. was discussed.
Motion by Robert Franklin, seconded by William Reiser to accept letter as WCCO'S report as
to progress regarding hearing.

15. PUBLIC WORKS FACILITIY BUILDING
. Motion by Robert Franklin, seconded by Arthur Theis to authorize Mayor and Clerk to sign
contract with Ebert Construction and Supply to erect public works building, upon presentation
of proper insurance policies and engineers stamped drawings.
Motion carried unanimously
16. MINUTES OF OCTOBER 28, 1975
Motion by Arthur Theis, seconded. by Robert Franklin to approve minutes of meeting of Oct.28th.
Motion carried unanimously
