SUMMARY STATEMENT:
On November 2, 2005 City Council denied an appeal of the Planning & Zoning Commission
recommendation to approve the final plat for the Spring Mountain Meadows subdivision in the
Spring Mountain Ranch PUD. The appellants then filed suit for judicial review in the Fourth
Judicial District of the State of Idaho. Subsequent to this filing the parties to this issue, including
the City of McCall, have negotiated a tentative settlement.
The Settlement Agreement is confidential unless and until accepted by the City Council. A draft
resolution is attached. The proposed settlement agreement will be reviewed with Council in
Executive Session. The file for this agenda bill is substantial. It can be reviewed in the
Community Development Department at City Hall.
RECOMMENDED ACTION:
Adopt Resolution 06-09 and authorize the Mayor to sign all necessary documents.
