SUMMARY STATEMENT:
As a part of the approval of the Timber Crest Countryside subdivision the City entered into an
agreement with the applicant committing to accept building permit applications earlier than would
otherwise have been possible in return for the applicant electing to construct a 12-inch water line
in Boydstun Street to provide water to the subdivision for fire protection. The applicant has
provided for fire protection by alternative means and the applicant and the City amended the
performance agreement to make certificates of occupancy (rather than building permits)
contingent upon completion of the water line improvements. The applicant committed to the water
line construction (which was originally at the option of the applicant) in return for this amendment.
The amended agreement called for completion of the water line by April 1, 2006. Weather has
delayed construction and the applicant wishes to amend the agreement to change the date to
May 1, 2006.
The City Attorney has reviewed and approved the amendment to the performance agreement.
RECOMMENDED ACTION:
Approve the Second Amendment to the Performance Agreement and authorize the Mayor
to sign all necessary documents.
