SUMMARY STATEMENT:
There has been some confusion as to the Council's intent and the proper interpretation of the
Scenic Route portion of the new Code. Two interpretations exist:
1. All of the Scenic Route requirements apply to construction within the 150 foot scenic route
boundary and that ONLY the design review requirement applies to any construction on any lot
any portion of which is in the Scenic Route but is outside of the 150 feet.
2. All of the requirements of the Scenic Route apply to any construction on any lot any portion of
which is in the 150 foot boundary of the Scenic Route.
The specific issue here is, of course, building height. Either way an applicant can apply for a
CUP to go to fifty feet outside of the 150 foot scenic route boundary. Under interpretation 1 this is
accomplished by designing the building accordingly. Under interpretation 2 this is accomplished
via a lot split at the 150 line that creates a lot in the scenic route and a lot outside of the scenic
route. The applicant then has to design two attached buildings (one on each lot) with a firewall
separating them. This leads to some awkward design and potentially some ugly buildings.
Attached is a letter from Don Bailey, detailing his intent as a member of the P&Z and primary
author of the relevant portion of City Code. Staff will apply the ordinance per your intent and will
clarify the language as a part of a "clean up" ordinance that we will prepare for your
consideration at a future date.
RECOMMENDED ACTION:
Confirm the Council's intent regarding the Scenic Route requirements, as described in the March
24 letter from Don Bailey.
