Councilman Presents the following Ordinance Seconded by Councilman ORDINANCE AMENDING AND SUPPLEMENTING THECODE OF THE BOROUGH OF CARTERET BE IT ORDAINED BY THE Mayor and Council of the Borough of Carteret ("Borough") as follows: Section 1. The Code of the Borough of Carteret be and is hereby amended and supplemented to add the following new section to read as follows: Construction debris. A. It shalJ be illegal to place any construction debris out for municipal, or municipally contracted, curbside pick-up. It shall similarly be illegal for any municipally contracted garbage hauler, and/or any of its employees, to pick-up such material p1aced out for curbside disposal. The foregoing provisions notwithstanding, a residential homeowner who is personalJy performing a home repair/remodeling construction project, for which he/she has obtained the proper building permit(s) from the local construction department, may p1ace one (1) thirty-two (32) gallon receptacle of construction debris for curbside pick up once per week. B. Any vi01ation of the above provision shall be governed in accordance with the general penalty section of this Code. ,[ I, I II Section 2. All Ordinances and/or provisions thereof inconsistent with the provision of this Ordinance shall be and are hereby repealed as to the extent of any such inconsistencies. Section 3. If any section, subsection, part, c1ause or phrase of this Ordinance shall be declared invalid by judgment of any Court of competent jurisdiction, the section, subsection, part, clause or phrase shall be deemed to be sever able from the remainder of this Ordinance.
